Whether the private income and expenditure of property is illegal depends on the specific circumstances, as follows:

1. If the contract signed by the owners' committee and the property management company is a contract responsibility system, the owners have no right to require the disclosure of the details of property revenue and expenditure, and the owners pay a fixed property service fee to the property service enterprise, and the property service enterprise enjoys or bears the responsibility system of surplus or loss. The composition of property service fee includes property service cost, fixed taxes and fees and profits of property service enterprises;

2. If it is a contract gratuity system, the property must disclose the details of income and expenditure. Among the prepaid property service funds, the contract gratuity shall be paid to the property management enterprise according to the agreed proportion or amount, and the rest shall be used for the expenses agreed in the property service contract, and the balance or insufficient part shall be enjoyed or borne by the owner. If the remuneration system is implemented, the funds received in advance for property services include property service expenditure and remuneration of property management enterprises. Owners have the right to know the income and expenditure accounts of the entrusted service enterprises in the property area where they live, and the property company shall publicize the accounts, including the collection and use of maintenance funds.

Property service charges should follow the principles of rationality, openness and adaptability between fees and service levels, and distinguish the nature and characteristics of different properties. The owners and the realty service enterprise shall, according to the charging standards for realty service formulated by the competent price department of the State Council in conjunction with the administrative department of construction of the State Council, stipulate in the realty service contract.
