Interim Measures of Xuzhou Municipality on Property Management of Urban Residential Areas
New urban residential areas and existing urban residential areas with a construction area of more than 20,000 square meters and complete facilities shall be subject to property management. Article 3 The municipal construction administrative department shall be responsible for the comprehensive coordination, supervision and guidance of the property management of residential areas in this Municipality. City, county (city), jiawang district real estate administrative departments in charge of the administrative area of urban residential property management, its main responsibilities are:
(a) to implement the laws, regulations, rules and policies of property management and formulate relevant property management measures;
(two) to participate in the acceptance of residential quarters, to guide and supervise the property takeover and the establishment of the owners' committee;
(3) Examining and approving the qualifications of property management enterprises;
(four) training full-time property management personnel;
(five) to supervise and inspect the management service activities of property management enterprises;
(six) responsible for the assessment of residential property management;
(seven) responsible for the supervision of residential parts and facilities maintenance fund (hereinafter referred to as the maintenance fund) collection and use;
(eight) to accept complaints about property management;
(nine) to investigate and deal with property management violations. The relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in the property management of residential areas.
The subdistrict office of the District People's Government shall assist the relevant administrative departments to supervise, guide and coordinate the property management of residential areas within their respective jurisdictions. Article 4 Property management shall follow the principle of combining owner's self-management with entrusted property management enterprise management. Fifth property management enterprises enjoy preferential policies for the tertiary industry in accordance with the relevant provisions of the state, province and city. Chapter II Self-management of Owners Article 6 An owners' committee shall be established in each residential area to self-manage the property on behalf of all owners.
Members of the owners' committee shall be elected by the owners' congress or the owners' congress attended by representatives of owners and property users, and the term of office shall be three years. According to the size of the living area, the owners' committee consists of five to fifteen members, with an odd number of members, one director, two deputy directors and several members.
The owners' committee shall, within fifteen days from the date of election, report the articles of association and the list of members to the property management administrative department for the record. Major issues involving residential property management shall be voted by more than 2/3 members of the owners' committee.
The owners' committee shall convene an owners' meeting or owners' representative meeting at least once a year, and it may be convened at any time upon the proposal of more than/kloc-0.5% of the owners or owners' representatives. Article 8 The owners' committee shall perform the following duties:
(a) the implementation of laws, regulations, rules and policies related to property management;
(2) Drafting the articles of association of the owners' committee;
(three) through bidding, recruitment and other forms to determine the property management enterprise to manage residential property, and conclude, change and terminate the property management entrustment contract with it according to law;
(four) to consider the annual business plan of the property management enterprise and the major measures of property management;
(five) to review the application for the use of maintenance funds by property management enterprises;
(six) to decide on major issues related to property management of property management enterprises;
(seven) according to the opinions and requirements of the owners and property users, supervise the management activities of property management enterprises;
(eight) presided over the formulation of the owners' convention, submitted to the owners' congress or the owners' congress for deliberation and approval, and urged the owners and property users to abide by the owners' convention and relevant regulations;
(nine) to convene the owners' congress or the owners' congress and report on the property management;
(ten) to assist the property management enterprises to implement various management measures;
(eleven) accept the supervision of the administrative department of property management, the owners' congress, the owners' congress and the owners and property users. Ninth owners' congress is composed of all owners of residential areas; If there are a large number of owners, the owners' representatives shall be elected in proportion to form the owners' meeting.
The owners' congress or owners' congress shall be attended by more than half of the owners or owners' representatives, and the decisions made shall be passed by half of the owners or owners' representatives. Tenth owners' congress and owners' congress shall exercise the following functions and powers:
(a) to elect and recall members of the owners' committee;
(2) Examining and adopting the articles of association of the owners' committee;
(3) Examining and approving the owners' convention;
(four) to listen to and consider the property management work report;
(five) to change or cancel the inappropriate decisions of the owners' committee.
