Regulations of Guangxi Zhuang Autonomous Region on Property Management (revised on 20 12)

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, ensure the rational use of property, improve the living environment and promote social harmony, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other relevant laws and administrative regulations, and in combination with the actual situation of this autonomous region. Article 2 These Regulations shall apply to property management activities and their supervision and management within the administrative area of this Autonomous Region.

The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area. Article 3 The administrative department of housing and urban and rural construction of the people's government of the autonomous region shall be responsible for the supervision and management of property management activities in the autonomous region.

The real estate administrative departments of the people's governments at the city and county levels with districts shall be responsible for the supervision and management of property management activities within their respective administrative areas.

Public security, civil affairs, judicial administration, urban and rural planning, environmental protection, price, urban management, industrial and commercial administration, quality and technical supervision and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the management and service of property management activities. Article 4 Township People's governments and sub-district offices shall, under the guidance of the real estate administrative departments of the people's governments at the county level, be specifically responsible for guiding the establishment of the owners' congress and the change of the owners' committee in their respective jurisdictions, coordinating the relationship between property services and community management and community services, and mediating property disputes among owners, owners' committees and property service enterprises.

Villagers' committees and residents' committees shall assist township people's governments and sub-district offices to do a good job in property management. Article 5 Property management industry associations shall strengthen industry self-discipline management according to law, standardize industry behaviors, maintain market order and fair competition, promote property service enterprises and employees to operate according to law and provide honest services, and promote the healthy development of the property management industry. Chapter II Owners, Owners' Congress and Owners' Committee Article 6 The owners mentioned in these Regulations include:

(a) the owner of the house recorded in the house ownership certificate;

(two) the person who has obtained the ownership of the exclusive part of the building in accordance with the provisions of the third section of Chapter II of the Property Law of People's Republic of China (PRC);

(three) the person who has not registered the ownership of the house but has legally occupied the house based on certain legal facts. Seventh owners in property management activities, enjoy the following rights:

(a) in accordance with the provisions of the realty service contract, accept the services provided by the realty service enterprise;

(two) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property management;

(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;

(four) to participate in the owners' meeting and exercise the right to vote;

(five) to elect members of the owners' committee and enjoy the right to be elected;

(six) to supervise the work of the owners' committee;

(seven) to supervise the realty service enterprise to perform the realty service contract;

(eight) the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and related sites;

(nine) to supervise the management and use of special maintenance funds for * * * parts of the property and * * * facilities and equipment;

(ten) other rights stipulated by laws and regulations. Eighth owners in the property management activities, fulfill the following obligations:

(a) abide by the management regulations and the rules of procedure of the owners' congress;

(two) abide by the rules and regulations of the use of * * * parts and facilities, the maintenance of public order and environmental sanitation in the property management area;

(three) to implement the decisions of the owners' congress and the decisions of the owners' committee authorized by the owners' congress;

(four) in accordance with the relevant provisions of the state and the autonomous region to pay special maintenance funds;

(five) to pay the property service fee on time;

(six) other obligations stipulated by laws and regulations. The first property management area in Kujou Hajime established the owners' meeting. The owners' meeting is composed of all owners.

If the owner is unable to attend the meeting of the owners' congress for some reason, he may entrust an agent to attend the meeting of the owners' congress in writing. Article 10 If the construction area of the exclusive part delivered for use reaches more than 50% of the total construction area in the property management area, or if the first house has been delivered for two years, the construction unit shall report in writing to the real estate administrative department of the people's government at the county level within 30 days. The report shall include the following materials needed to prepare for the first owners' meeting:

(a) the owner's house ownership list;

(two) a copy of the construction land planning permit and the construction project planning permit;

(three) the completion and acceptance of housing construction and the delivery of ancillary facilities and equipment for the record;

(four) the property service room configuration certificate;

(5) Other necessary documents and materials.

If the construction unit fails to report in writing in time, the owners who have delivered more than 20% of the exclusive parts may jointly submit a written request to the real estate administrative department of the people's government at the county level for convening the first meeting of the owners' congress.

After receiving the written report of the construction unit or the written request of the owner, the real estate administrative department shall promptly inform and prepare for the first meeting of the owners' congress in conjunction with the township people's government or the subdistrict office.
