Measures of Zhangzhou Municipality on Property Management

Article 1 In order to strengthen the management of construction waste, maintain and improve the city appearance and environmental sanitation, and promote the construction of ecological civilization, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the disposal activities such as the delivery, transportation, consumption and utilization of construction waste in the urban built-up areas and county (city) people's governments of this Municipality.

The specific scope of urban built-up areas and areas subject to urbanization management shall be determined by the people's governments of cities and counties (cities) and announced to the public.

The term "construction waste" as mentioned in these Measures refers to muck, garbage and other wastes generated by units and individuals in the process of building, rebuilding, expanding, decorating, repairing and dismantling various buildings and structures, as well as roads, bridges, pipe networks, greening and water conservancy projects.

If the construction waste specified in the preceding paragraph belongs to hazardous waste, it shall be disposed of in accordance with relevant laws and regulations. Article 3 The disposal of construction waste shall follow the principles of reduction, recycling, innocuity, and whoever produces and bears the responsibility for disposal. Article 4 The people's governments at the city and county levels shall strengthen their leadership, determine and implement the management objectives of construction waste, coordinate the planning, layout and construction of construction waste disposal facilities, and ensure the capital investment in construction waste management. Article 5 The competent department of urban management of the Municipal People's Government is the competent department of construction waste management in this Municipality, and is responsible for the supervision and management of construction waste in this Municipality. The competent department of urban management of the people's government at the county level is responsible for the supervision and management of construction waste in this area.

The competent departments of housing, urban and rural construction, transportation and water conservancy of the people's governments at the city and county levels shall be responsible for the supervision and management of construction waste on construction sites according to their respective duties.

The traffic administrative department of the people's government of the city or county and the public security organ shall be responsible for the supervision and management of construction waste transportation activities according to their respective duties.

The competent department of natural resources of the Municipal People's Government is responsible for the planning and approval of the construction waste disposal site.

The departments of development and reform, ecological environment, finance, market supervision and emergency management of the municipal and county people's governments shall, according to their respective responsibilities, do a good job in the management of construction waste.

Neighborhood offices and township (town) people's governments shall, under the guidance of the competent department of urban management of the people's governments at the city and county levels, do a good job in the daily management of construction waste within their respective jurisdictions. Article 6 The competent department of urban management of the Municipal People's Government shall be responsible for establishing a construction waste service management information platform, realizing the dynamic management of the following information and making it public:

(a) construction waste delivery and demand information;

(two) construction waste disposal approval, transportation vehicles and construction waste disposal site information;

(3) Construction waste related administrative law enforcement information.

Municipal People's government housing and urban and rural construction, natural resources, ecological environment, transportation, traffic management of public security organs, water conservancy and other competent departments. Should be in accordance with their respective responsibilities, timely grasp and provide relevant information on the information platform specified in the preceding paragraph, and promote the whole process control of construction waste.

Encourage construction waste delivery and demand subjects to adjust and utilize construction waste through the information platform. Article 7 This Municipality implements the source classification system of construction waste. The Municipal People's Government shall formulate standards and schemes for the classification of construction waste and promote the classification of construction waste.

This Municipality promotes new technologies, new materials, new processes and new standards, such as prefabricated buildings, fully decorated houses and green building design standards, to promote the reduction of the source of construction waste.

If construction waste can be directly used, it should be directly used; If it cannot be directly utilized, it should be comprehensively utilized or disposed of harmlessly.

Encourage resource-based disposal enterprises to use mobile equipment to treat construction waste on site. Article 8 The responsible person system for construction waste management shall be implemented in this Municipality:

(a) the construction unit is responsible for the construction waste generated by the construction project;

(two) the construction unit is responsible for the construction waste generated by the demolition project;

(three) the village (neighborhood) people decorate houses, and the construction waste generated by the self-built houses and non-residential decoration of individuals who do not need to apply for construction permits according to law, and the area where property management is implemented, the property service enterprise entrusted by them is the responsible person; In areas where property management is not implemented, the owner is the responsible person. Ninth construction units, construction units or construction waste transport units shall apply to the competent department of urban management of the Municipal People's government, and obtain the permit for the disposal of urban construction waste before disposal.

The competent department of urban management of the Municipal People's Government shall make a decision of approval or disapproval within 20 days after receiving the application. If approved, an approval document shall be issued; If it is not approved, it shall inform the applicant and explain the reasons.

The specific conditions for examination and approval of urban construction waste disposal shall be implemented in accordance with the relevant provisions of the state. Article 10 The construction unit of a construction project shall equip the construction waste management personnel at the construction site, and strengthen the management of the construction site in accordance with the following provisions:

(a) according to the classification scheme to collect and pile up construction waste;

(two) timely backfill engineering muck, removal of construction waste, can not be timely backfill or removal, the implementation of dust, seepage, landslide and other measures;

(three) the implementation of mud separation, standardize the discharge of engineering mud, conditional should be dried;

(four) hardening the entrance road of the construction site, equipped with vehicle washing equipment, to ensure that the transport vehicles are clean and tidy;

(5) Other requirements stipulated by laws and regulations.
