Article 7 (Responsibility for Prevention and Control of Dust Pollution in Construction Projects, Greening Construction and House Demolition)

Housing construction, road and pipeline construction, greening construction and house demolition construction units shall include the cost of dust pollution prevention and control in the project budget, and clarify the responsibility of dust pollution prevention and control of the construction unit in the construction contract signed with the construction unit.

Article 8 (General Dustproof Requirements for Construction Projects)

Construction projects in central cities, new towns, central towns, tourist areas (spots) and large passenger distribution points shall meet the following requirements for dust pollution prevention and control:

(a) in the construction site, cement, lime soil, gravel and other materials that are prone to dust pollution should be piled up, and a closed enclosure not lower than the pile height should be set around; The outer side of engineering scaffold must be closed with dense mesh safety net.

(two) within 30 days after the completion of the project, the construction unit shall level the construction site and remove the accumulated soil and debris.

(3) The air compressor shall not be used to clean the dust of vehicles, equipment and materials.

(4) The ground on the construction site should be hardened.

(5) During the construction operation that produces a large amount of mud, corresponding mud pits and mud ditches shall be provided to ensure that the mud does not flow out, and the waste mud shall be transported by sealed tank trucks.

Article 9 (Dust Prevention Requirements for Building Construction)

Housing construction in central cities, new towns, central towns, tourist areas (spots) and large passenger distribution points shall meet the following requirements in addition to the requirements for the prevention and control of dust pollution as stipulated in Article 8 of these Measures:

(1) A hard closed fence of not less than 2m should be set around the construction site.

(two) in the construction site, set up vehicle cleaning facilities and supporting drainage and mud precipitation facilities; Transport vehicles are not allowed to leave the construction site before the mud is cleared.

(3) If the removal of construction waste and engineering muck cannot be completed within 48 hours, a temporary storage yard shall be set at the construction site, and dust-proof measures such as fencing and covering shall be taken for the temporary storage yard.

Article 10 (Dustproof Requirements for Road and Pipeline Construction)

The construction of roads and pipelines in central cities, new towns, central towns, tourist areas (spots) and large passenger distribution points shall meet the following requirements in addition to the requirements for the prevention and control of dust pollution as stipulated in Article 8 of these Measures:

(a) new construction, overhaul of road projects, the construction site should be set up not less than 2 meters of hard closed enclosure.

(two) roads and pipelines construction pile soil for more than 48 hours, should take cover and other dust pollution prevention and control measures.

(three) when using pneumatic drill to dig the ground or clean up the construction site, water should be sprinkled on the ground.

Article 11 (Dustproof Requirements for House Demolition)

Demolition of houses in central cities, new towns, central towns and tourist areas (spots) shall meet the following dustproof requirements:

(a) when the weather forecast wind speed reaches more than 5, the house blasting or house demolition shall be stopped.

(2) When demolishing or blasting a house, water or spray shall be sprayed on the demolished or blasted house; When the house is demolished manually, sprinkling water or spraying measures may lead to the loose structure of the house and endanger the safety of the construction personnel.

(three) in the construction site, set up vehicle cleaning facilities and supporting drainage and mud precipitation facilities; Transport vehicles are not allowed to leave the construction site before the mud is cleared.

(four) if the construction waste cannot be removed within 48 hours, dust prevention measures such as covering and sprinkling should be taken.

Article 12 (Management of Prevention and Control of Dust Pollution in Construction Operation)

The construction administrative department shall, in accordance with the provisions of Article 8, Article 9 and Article 11 of these Measures, incorporate the requirements for the prevention and control of dust pollution into the technical specifications for building construction and demolition construction; The municipal competent department shall, in accordance with the provisions of Article 8 and Article 10 of these Measures, incorporate the requirements for the prevention and control of dust pollution into the technical specifications for road and pipeline construction.

Construction units engaged in building construction, road and pipeline construction and house demolition shall, in accordance with the provisions of Article 8, Article 9, Article 10 and Article 11 of these Measures, formulate plans for the prevention and control of dust pollution, establish corresponding responsibility systems and operation record books, and designate specific persons to be responsible for the prevention and control of dust pollution on the construction site.

Construction units engaged in housing construction and house demolition shall report the dust pollution prevention and control scheme to the district and county construction administrative departments where the project is located for the record three working days before the project starts, and publish the dust pollution prevention and control scheme in a prominent position around the construction site before the project starts, and keep the published content clear and complete from the publication period to the end of the project construction. Construction units engaged in road and pipeline construction shall report the dust pollution prevention and control plan to the district and county municipal authorities where the construction is located for the record three working days before the project starts.

Article 13 (Dustproof Requirements for Material Transportation)

Units and individuals that transport materials that are prone to dust pollution within the scope of central cities, new towns, central towns and tourist areas (spots) shall use closed vehicles for transportation. Do not have the conditions for closed transportation, it shall entrust a unit or individual that meets the conditions for closed transportation.

Transport units and individuals shall strengthen the maintenance of mechanical sealing devices of vehicles to ensure the normal use of equipment, and materials shall not leak, scatter or fly along the way during transportation.

Vehicles transporting construction waste and engineering muck do not meet the requirements of closed transportation, and the city appearance and environmental sanitation management department shall not issue construction waste and engineering muck disposal certificates.

Article 14 (Dustproof Requirements for Wharf, Yard and Open-air Warehouse)

Docks, yards and open-air warehouses in central cities, new towns, central towns and general towns that are prone to dust pollution shall meet the following dust-proof requirements:

(1) Ground hardening.

(two) the use of concrete walls or ceilings for storage, and the storage area is equipped with spraying or other dust suppression measures.

(3) When working with closed conveying equipment, dust-proof facilities such as dust suction and spraying shall be set at the discharging and discharging place, and the normal use of dust-proof facilities shall be maintained.

(four) set up a special vehicle cleaning site at the exit, equipped with transportation vehicle washing and cleaning facilities.

(five) divide the material area and road boundaries, timely remove scattered materials, keep the road clean and tidy, and clean it in time.

If the existing wharves, yards and open-air warehouses that are prone to dust pollution within the scope of central cities, new towns, central towns and general towns do not meet the requirements specified in the preceding paragraph, their owners or operators shall, within six months after the implementation of these measures, carry out transformation in accordance with the provisions of the preceding paragraph.

Article 15 (Requirements for Road Cleaning and Dust Prevention)

Road cleaning operations within the scope of central cities, new towns and central towns shall meet the following dust-proof requirements:

(1) Except in rainy days or when the lowest temperature is below 4 degrees Celsius, the carriageways of urban main roads should be washed at least 1 time every day, and the sidewalks of main roads should be washed at least 1 time every three days.

(two) urban trunk roads, highways and elevated roads should be cleaned by mechanized water spraying, and other roads should be encouraged to be cleaned by mechanized water spraying.

(three) the use of manual cleaning, shall comply with the city appearance and environmental sanitation service standards.

The city appearance and environmental sanitation management department and the municipal administration department shall incorporate the requirements for the prevention and control of dust pollution in the process of road cleaning into the technical specifications for cleaning operations.

Article 16 (Dust Prevention Measures for Plant Planting and Maintenance)

Plant planting and maintenance in central cities, new towns and central towns shall meet the following dust-proof requirements:

(a) planting street trees, digging tree holes within 48 hours can not be planted, tree holes and planting soil should be covered and other dust pollution prevention and control measures. After planting street trees, the removal of residual soil and other materials should be completed on the same day. If the removal cannot be completed, it should be overwritten.

(2) For greening construction of more than 3,000 square meters, a hard enclosed enclosure of not less than 2 meters shall be set around the green space, and vehicle washing facilities and supporting drainage and mud sedimentation facilities shall be set on the construction site. Transport vehicles can only leave the construction site after mud removal and flushing.

The greening management department shall incorporate the requirements for preventing and controlling dust pollution into the technical specifications for greening construction and maintenance.

Article 17 (Greening and Laying Bare Soil)

The exposed silt in the central city should be afforested or paved. The responsible person shall be determined in the following ways:

(a) bare mud within the scope of the unit shall be afforested or paved by the unit.

(two) the bare mud in the residential area shall be greened or paved by the property management enterprise entrusted by the owner.

(3) The exposed mud land of municipal roads, rivers and public green spaces managed by the municipal, water and greening management departments shall be organized by the municipal, water and greening management departments for greening or paving respectively.

Article 18 (Supervision and Inspection)

The municipal or district/county environmental protection department shall strengthen the supervision and management of the prevention and control of dust pollution, and other relevant administrative departments shall strengthen the supervision and inspection of dust pollution sites and facilities. For comprehensive dust pollution prevention and control work, the municipal or district/county environmental protection department may organize relevant administrative departments to conduct joint law enforcement inspection.

The units or individuals under inspection shall truthfully report the situation, provide information related to the inspection contents, and shall not conceal, refuse or obstruct the supervision and inspection of relevant management personnel.

Article 19 (Announcement)

If the relevant units or individuals fail to take effective dust prevention measures in accordance with the provisions of these Measures, the relevant administrative departments shall order them to make corrections within a time limit, and the Municipal Environmental Protection Bureau may regularly announce the illegal list to the public.

Article 20 (Complaints and Reports)

The municipal or district/county environmental protection department and the relevant administrative departments shall set up a hotline to receive reports and complaints from the public about dust pollution. The municipal or district/county environmental protection department or the relevant administrative department shall, after accepting the reports and complaints of dust pollution, rush to the scene for inspection in time and inform the informant or complainant of the treatment results. If it is verified through investigation, the municipal or district/county environmental protection department or the relevant administrative department shall reward the informer or complainant.

Article 21 (Penalties for Violation of Dust Prevention Regulations in Building Construction and House Demolition)

In violation of the first, third, fourth, fifth, sixth and seventh items of Article 8, second and third items of Article 9, second and third items of Article 10, and first, second and third items of Article 11, the construction unit fails to take measures in house construction, road pipeline construction and house demolition. If serious dust pollution is caused, a fine of 1 10,000 yuan but not more than 20,000 yuan shall be imposed. If the construction unit refuses to make corrections, the construction administrative department may order it to stop work for rectification.

In violation of the provisions of the second paragraph of Article 8, the first paragraph of Article 9, the first paragraph of Article 10, and the fourth paragraph of Article 11 of these measures, if the construction unit fails to take effective dust prevention measures in house construction, road pipeline construction and house demolition, it shall be handled by the city appearance and environmental sanitation management department or the construction administrative department in accordance with the provisions of relevant laws, regulations and rules.

In violation of the provisions of the third paragraph of Article 12 of these measures, failing to record or publish the dust pollution prevention and control plan according to the regulations, the construction administrative department shall order it to make corrections within a time limit and may impose a fine of more than 1000 yuan 1000 yuan.

Article 22 (Penalties for Violation of Dust Prevention Regulations for Material Transportation)

Violation of the provisions of Article 13 of these Measures on the prevention and control of dust pollution in material transportation shall be handled by the public security traffic management department, the city appearance and environmental sanitation management department or the urban traffic management department in accordance with the provisions of relevant laws, regulations and rules.

Article 23 (Penalties for Violation of Dust Prevention Regulations of Yard)

In violation of the provisions of Article 14 of these measures, the docks, storage yards and open-air warehouses do not meet the requirements for the prevention and control of dust pollution, and the municipal or district/county environmental protection department shall order them to make corrections within a time limit. If they refuse to make corrections, they shall be fined more than 1000 yuan 1000 yuan; If serious dust pollution is caused, a fine of 1 10,000 yuan but not more than 20,000 yuan shall be imposed.

Article 24 (Penalties for Violation of Provisions on Road Cleaning and Dust Prevention)

In violation of the provisions of the first paragraph of Article 15 of these measures, if the road sweeping operation does not meet the requirements for the prevention and control of dust pollution, the city appearance and environmental sanitation administrative department or the municipal administrative department shall order it to make corrections according to the division of responsibilities, and may impose a fine of not less than 3,000 yuan from 300 yuan.

Article 25 (Penalties for Violation of Dustproof Regulations on Plant Planting and Maintenance)

In violation of the provisions of the sixteenth paragraph of these measures, plant planting and maintenance operations do not meet the requirements of dust pollution prevention and control, and the greening management department shall order it to make corrections, and may impose a fine of more than 5,000 yuan in 500 yuan. Refuses to correct, by the greening management department shall be ordered to stop work for rectification.

Article 26 (Penalties for Violation of Dustproof Provisions on Bare Soil Greening)

In violation of the provisions of the first paragraph of Article 17 of these measures, if the relevant unit fails to afforest or lay bare mud within its scope, the district or county environmental protection department shall order it to make corrections within a time limit, and if it refuses to do so, the district or county environmental protection department shall organize it to afforest or lay it on its behalf, and the expenses required shall be borne by the violator, and a fine of 1000 yuan but not more than 20,000 yuan may be imposed.
