Measures of Zhangjiakou Municipality on Property Management

Chapter I General Provisions Article 1 In order to standardize property management service activities, safeguard the legitimate rights and interests of owners and property service enterprises, improve people's living and working environment, and promote the construction of intelligent and harmonious communities, these measures are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management and other laws and regulations, combined with the actual situation of our city. Article 2 These Measures shall apply to the use, maintenance, service, supervision and management of properties within the administrative area of this Municipality.

The term "property management" as mentioned in the present Measures refers to the activities of owners and property service enterprises to maintain, conserve and manage the houses, supporting facilities, equipment and related sites within the property management area, and maintain environmental sanitation and related order by hiring property service enterprises.

Property management area shall be provided with property services by property service enterprises, and a written property service contract shall be signed to provide services according to the contents of the contract. Article 3 Property management shall follow the principles of territorial management, owner autonomy and professional service. The county people's government should incorporate property management services into the development planning of modern service industry and the comprehensive management system of smart community, and implement the operation of group property service mode; Establish a "five-in-one" joint meeting system for property management under the guidance of housing and urban-rural construction departments, supervision of sub-district offices (township people's governments), organization and implementation of community neighborhood committees, and participation of owners and property service enterprises.

Advocate owners to choose property service enterprises through an open, fair and just market competition mechanism; Encourage the adoption of new technologies and methods, improve the level of property management and services by relying on science and technology and Internet technology, and promote the standardized and orderly development of property management services in our city. Chapter II Supervision and Management Article 4 The Municipal Housing and Urban-Rural Development Bureau is responsible for the overall coordination, policy formulation, inspection and guidance of the city's property management service activities. Perform the following duties:

(a) to study and formulate the city's property management related supporting policies and property service industry norms;

(two) to guide and supervise the property management of the housing and urban-rural construction departments in counties;

(three) responsible for the construction of the credit system of the city's property service enterprises and their responsible persons;

(four) responsible for the formulation and supervision of the city's residential special maintenance fund policy;

(five) other duties as prescribed by laws, regulations and rules. Fifth county housing and urban construction department is responsible for the supervision and management of property management services within their respective administrative areas. Perform the following duties:

(a) to be responsible for the daily supervision of property management services in this region, and to guide and supervise the neighborhood offices and township (town) people's governments within their respective jurisdictions to perform their duties of property management supervision;

(two) responsible for the area of property projects to undertake inspection and filing;

(three) to carry out the collection, verification and supervision of credit information of property service enterprises and project leaders;

(four) responsible for the collection, use and management of residential special maintenance funds in this area;

(five) responsible for mediation of property disputes;

(six) other duties according to law. Article 6 Sub-district offices and township (town) people's governments shall set up special property management institutions or be equipped with full-time personnel to perform the following property management duties:

(a) to supervise and guide the owners' congress to prepare for the establishment of the general assembly, the formal meeting and the election of the owners' committee;

(two) responsible for the filing and daily supervision of the owners' congress and the owners' committee;

(three) to assist the county housing and urban construction departments to do a good job in the supervision of property service enterprises, property acceptance and filing, property service enterprises and responsible persons credit information collection and other work;

(four) the establishment of property emergency maintenance service mechanism, convene a joint meeting of property management, and mediate the contradictions and disputes between community residents' committees, owners and property service enterprises;

(five) other duties as prescribed by laws and regulations. Seventh community residents committee shall perform the following duties of property management:

(a) organize and participate in the preparatory establishment meeting and formal meeting of the owners' congress, and verify the election of the owners' committee. Responsible for the review and filing of the temporary management regulations, management regulations and rules of procedure of the owners' meeting designated by the construction unit;

(two) responsible for organizing the owners of residential quarters in the region to sign the preliminary realty service contract, and the connection between the signing and implementation of the realty service enterprise and the new realty service contract after the expiration of the preliminary realty service contract;

(three) to participate in property inspection and make records;

(four) according to major property matters, put forward the topic of the joint meeting of property management;

(five) to mediate disputes between owners and property service enterprises;

(six) to supervise and evaluate the daily services of property service enterprises. Article 8 Relevant functional departments of city and county planning, urban management, public security and fire control, quality supervision and price control, and franchised service units such as power supply, water supply, gas supply, heating, communication network and cable TV shall, in accordance with laws, regulations and relevant provisions, cooperate with each other to do a good job in property management, and announce the service hotlines of various departments and the ways of receiving complaints and reports. Chapter III Owners, Owners' Congress and Owners' Committee Article 9 The owner of a house is the owner.

Owners enjoy the following rights in property management activities:

(a) in accordance with the provisions of the realty service contract, accept the services provided by the realty service enterprise;

(two) proposed to convene a general meeting of owners, and put forward suggestions on matters related to property management;

(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;

(four) to participate in the owners' meeting and exercise the right to vote;

(five) to elect members of the owners' committee and enjoy the right to be elected;

(six) to supervise the work of the owners' committee;

(seven) to supervise the realty service enterprise to perform the realty service contract;

(eight) the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and related sites;

(nine) to supervise the management and use of residential special maintenance funds;

(ten) other rights stipulated by laws and regulations.
