Chapter I General Provisions Article 1 In order to standardize the property management activities in this Municipality, safeguard the legitimate rights and interests of owners and property service enterprises, improve the level of property management, promote the healthy development of the property management industry, and create a harmonious, safe, civilized and tidy living and working environment, these Measures are formulated in accordance with the People's Republic of China (PRC) Property Law, the Regulations on Property Management, the Regulations on Property Management in Guangdong Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the property management activities within the administrative area of this Municipality.

The term "property management" as mentioned in these Measures refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area.

Owners who manage their own property or hire other managers to manage the property shall abide by the relevant provisions of these measures. Article 3 Property management shall adhere to the principle of combining owner autonomy with professional services, territorial management with industry management, and abide by the provisions of laws, regulations, rules and management protocols. Article 4 The people's governments of cities and counties (cities, districts) shall incorporate property services into the development planning, community construction and community management system of modern service industry; Establish and improve the socialized and market-oriented property management mechanism, and encourage the adoption of new technologies and methods to improve the property management and service level. Fifth city real estate administrative departments to organize the implementation of these measures, responsible for the establishment of the integrity management mechanism of property service enterprises, responsible for the supervision and management of property management activities in the city.

County real estate administrative departments responsible for the supervision and management of property management activities in this area; If there is no real estate administrative department, the people's government at or above the county level shall decide the supervision and management department of property management activities (hereinafter referred to as "real estate administrative department").

Neighborhood offices and town people's governments shall, jointly with the real estate administrative departments where the property is located, guide and assist the establishment of the owners' congress and the election of the owners' committee within the region, supervise the daily activities of the owners' congress, the owners' committee and the property service enterprises, and mediate and handle property management disputes.

Residents' committees and villagers' committees shall establish a coordination mechanism between owners, owners' committees and property service enterprises, and assist neighborhood offices and town people's governments in guiding and supervising community property management activities. Article 6 The relevant administrative departments of the people's governments of cities and counties (cities, districts) shall, in accordance with their statutory duties, strengthen the supervision and management of housing safety, property charges, public security and fire control, public order, environmental sanitation and the use of houses, facilities and equipment within the property management area.

Water supply, drainage, power supply, gas supply, communication, cable television and other franchised service units shall, in accordance with the relevant provisions and the contract, do a good job in special services within the property management area. Article 7 Property management industry associations shall strengthen self-discipline management according to law, standardize industry behaviors, implement industry service standards and standardize services, perform liaison, coordination and service duties, assist relevant government departments to mediate and handle property management disputes, urge the property service industry and employees to operate in good faith according to law, and promote the healthy development of the property industry. Eighth the establishment of the neighborhood offices, the town people's government, residents' committees, villagers' committees, owners' committees (owners' representatives), property service enterprises to participate in the joint meeting system. The joint meeting mainly coordinates and solves major problems in property management. The joint meeting shall be convened and presided over by the sub-district office and the town people's government. According to the specific issues of coordination, public security, justice, water supply, power supply, gas supply, communications and other relevant units can be invited to participate, and relevant departments at higher levels can also be invited to participate.

The joint meeting mainly coordinates and solves the following matters:

(a) serious personal injury and property loss accidents caused by man-made, natural disasters or other reasons in the property management area;

(two) disputes in the early property management;

(three) the owners' committee fails to perform its duties according to law;

(four) major disputes in the process of the change of the owners' committee;

(five) major disputes in the performance of the property service contract;

(six) other major disputes and disputes that need to be resolved through coordination. Ninth owners, property users, owners' committees, property services companies, construction units in the property management services disputes, you can apply for mediation of the people's mediation committee where the property is located, you can also bring a civil lawsuit according to law. Article 10 The municipal real estate administrative department shall establish a property service information platform (official WeChat account of the platform) to provide functions such as information release and electronic voting of owners' decisions. The funds for the construction and maintenance of the property service information platform (official WeChat account of the platform) are included in the departmental budget by the relevant departments. Chapter II Property Management Areas Article 11 When dividing property management areas, factors such as facilities and equipment, building scale and community construction should be considered. Property management is based on the Regulations of Guangdong Province on Property Management, and follows the principle of relative centralization and easy management. The specific division method is as follows:

(a) according to the scope of the red line map determined by the construction land planning permit, the property management area is divided. An independent property management area has been naturally formed and uncontroversial, and will not be re-divided;

(two) the property developed by stages or by more than two construction units, its supporting facilities and related sites should be divided into a property management area; Supporting facilities and related sites can be used independently and can be divided into different property management areas;

(three) different adjacent property management areas that have implemented property management, which are small in scale, can be merged into one property management area with the consent of their respective owners' meetings;

(four) the completed residential areas that have not implemented property management need to implement property management, and the neighborhood offices and town people's governments where the property is located shall determine the property management area after consulting the relevant owners.
