Acceptance criteria and related matters

1. First of all, it must be made clear that taking over the house is the right of the owner, and the right can be waived or postponed. It is the developer's obligation to hand over the house or not, and the obligation must be fulfilled on time.

2. The main process of normal house collection on site: show the owner's certificate (purchase contract, etc.). )-Check and collect documents related to house delivery-Ask for keys-Check the house (including residential planning)-Sign the house handover book-Leave.

3. You don't need to sign for the room notice. Notice of repossession is the developer's breach of contract to prove that he has not delivered the house (although it can't be proved in theory, the relevant departments have recognized the certificate, and the owner can't help it. ) and warnings to car owners.

4. Never sign the delivery book before you get the key at the delivery site. Due to the current characteristics of our country, in the case of disputes over housing delivery, it is rare for the owners to win the case, as long as the owners have signed the housing handover book, even if the housing does not meet the delivery conditions.

5. The delivery certificate includes the household acceptance form of residential project quality, residential instruction manual and residential quality guarantee. If any of the above items are missing, the owner has the right to refuse to accept the house. However, these certificates can be easily issued to the owners only by the developers unilaterally, and these are not the key certificates to prove that the house is qualified.

6. "Comprehensive acceptance" refers to the comprehensive acceptance of quality, design, planning, fire protection and environmental protection of completed residential areas organized by the Construction Committee. According to the law, houses that have not passed the comprehensive acceptance of completion cannot be delivered for use. Therefore, comprehensive acceptance is the key to formal delivery.

According to the national regulations, after the completed house is accepted by the developer, it will be accepted by the quality supervision station for the record, and then it can be handed over after comprehensive acceptance.

The current acceptance procedure in Changsha is the other way around: after the developer organizes the acceptance, the Construction Committee will organize the joint acceptance (we don't think the comprehensive acceptance will be cancelled), and then submit it to the quality supervision station for acceptance and filing, and issue the Record Form for Completion Acceptance of Construction Projects before handing over the house.

Therefore, the owner who can't check the record form of construction project completion acceptance has the right to refuse to accept the house. When consulting the record form of construction project completion acceptance, you only need to consult the "record opinions" on the last page. If the "Filing Opinion" indicates that some of them have been filed and there are conditions to be delivered, it means that the house cannot be delivered yet. Although the house has obtained the record form for the completion acceptance of the construction project at this time, the owner still has the right to refuse to accept the house.

7. The comprehensive acceptance of the house does not necessarily mean that it is qualified. Many cases show that some houses have obtained all the acceptance documents signed by the government before they have started construction. We don't mean to judge the government. We just remind the owners not to just read some documents, but to visit them in person. Because our country is still in the stage of self-help to a great extent. On-site inspection of the house, the owner has the right to request access to the building construction drawings. Because the owner has the right to know the real situation of the house. Without reference to the construction drawing, it is impossible to know whether the house is constructed according to the drawing, whether it meets the standards approved by the state, and whether the actual situation of the house is in line with the proper situation. Construction drawing documents can be obtained from the developer or the property company (the developer should deposit the relevant drawings with the property).

8. If the quality of the house (including design and planning) is unqualified, it means that the house does not meet the delivery conditions. Since it can't be delivered if it doesn't meet the requirements, the owner has reason to refuse to sign the house handover book (of course, if the quality problem is within the owner's tolerance, you can also consider taking the house first and then rectifying it). At the same time, letters (telegrams or express mail) should be sent to the developer and the property management company within the agreed time limit, requiring the developer to bear the liability for breach of contract for delaying the delivery of the house, and requiring the property management company to bear the liability for breach of contract for the losses caused by the owner's failure to fulfill the acceptance obligation when the house is closed. Take this as evidence.

9. When closing the house, you should ask for the property maintenance fund payment voucher stamped with the special seal of the maintenance fund window and the deed tax payment voucher stamped with the special seal of the deed tax revenue, and obtain it within a reasonable period of time. If the developer does not pay the maintenance fund and deed tax to the relevant government departments, he will not be able to obtain the above two certificates, so the owner will not be able to obtain the real estate license.

10. The owner has the right to refuse to sign the owners' convention formulated by the property management company, which does not constitute a reason for the developer not to hand over the house. As the name implies, the owners' convention must be formulated by the owners to regulate their behavior. Property management companies serve and obey the owners, and have no right to formulate any system to restrain the owners' behavior.
