Chapter I General Provisions Article 1 In order to regulate the property management activities in residential quarters, safeguard the legitimate rights and interests of owners and property service enterprises, improve the living environment and promote social harmony, these Regulations are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and the Regulations on Property Service Management of Hubei Province, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management of residential quarters and their supervision and management activities within the administrative area of this Municipality. Article 4 Sub-district offices and Township People's governments shall organize and guide the establishment of owners' congresses and the election of owners' committees in residential areas within their respective jurisdictions, guide and supervise the owners' congresses and owners' committees to perform their duties according to law, coordinate the relationship between property management and community management and community service, and mediate property management disputes.

Community residents' committees, owners' committees and property service enterprises shall, under the leadership of community party organizations, establish and improve the coordination and linkage mechanism of property management, and do a good job in the property management of residential quarters. Article 5 Sub-district offices and Township People's governments shall establish a joint meeting system for property management in residential quarters, specifically to solve the problems that need coordination in property management activities.

The joint meeting was convened by the sub-district office and the Township People's Government, and representatives from housing management, public security, civil affairs, justice, urban management, price control and other administrative departments and community neighborhood committees, owners' committees, property service enterprises, professional business units and other parties participated. Chapter II Owners' Congress and Owners' Committee Article 6 If a residential area meets one of the following conditions, the first owners' congress meeting shall be held and the owners' congress shall be established:

(a) the area of the exclusive part of the delivered house reaches 50% of the total construction area;

(two) the number of houses delivered has reached 50% of the total;

(three) within two years from the date of the first owner's occupancy and the proportion of households has reached 20%. Seventh in line with the conditions of the first owners' meeting, the construction unit shall submit a written declaration to the housing administrative department; Owners can also submit a written report to the housing administrative department for convening the first owners' meeting; The housing administrative department shall notify the subdistrict office and the Township People's Government in writing.

Sub-district offices and Township People's governments shall, within 30 days from the date of receiving the notice, organize the establishment of a preparatory group for the owners' congress, and organize the first meeting of the owners' congress within 60 days from the date of the establishment of the preparatory group in accordance with the relevant provisions of the state and the province.

The preparatory funds for the first owners' meeting shall be borne by the construction unit. Eighth owners' meeting can be in the form of collective discussion, but also in the form of written comments; The owners' meeting shall be attended by owners who account for more than two-thirds of the exclusive part of the residential area and the number of owners accounts for more than two-thirds.

In the form of written opinions, the written opinions shall be directly delivered to the owner; If it cannot be delivered directly, it shall be publicized in a prominent position in the residential area. Article 9 If the number of owners in residential areas exceeds 300, the owners' representatives can be elected by building, unit or floor, and the owners' meeting can be established. The responsibilities of the owners' meeting shall be decided by the owners' meeting.

Before attending the meeting of the owners' congress, the owners' representatives shall solicit the opinions of the owners they represent in writing in advance, and truthfully reflect the written opinions signed by the owners themselves at the meeting of the owners' congress. Article 10 The owners' committee shall be elected by the meeting of the owners' congress. The owners' committee consists of five to eleven members, each term of office shall not exceed five years, and members may be re-elected. The chairman and deputy directors of the owners' committee shall be elected by the owners' committee among all its members.

The owners' committee shall, within 30 days from the date of election, report the list of members of the owners' committee to the housing administrative department, sub-district offices and township people's governments for the record. Eleventh owners in any of the following circumstances, shall not serve as members of the owners' committee; Has served as a member of the owners' committee, street offices, Township People's government after investigation and verification, ordered to suspend their duties, the owners decided to terminate their duties as members:

(a) I, my spouse and immediate family members have an interest in the property service enterprise that provides services for this residential area;

(two) improper use of property behavior and has not been corrected;

(three) to seek other interests, which hinders the fair performance of duties and has not been corrected;

(four) other circumstances stipulated by laws, regulations and management regulations, the rules of procedure of the owners' congress. Article 12 When discussing and deciding on property management matters, the owners' committee shall convene a meeting of the owners' committee, and announce the agenda of the meeting in a prominent position in the residential area seven days before the meeting, so as to listen to the opinions and suggestions of the owners.

Matters decided by the owners' committee shall be signed by more than half of all members.

The owners' committee shall announce it in a prominent position in the residential area within three days from the date of making the decision.
