Regulations of Hangzhou Municipality on the Administration of City Appearance and Environmental Sanitation (revised in 2005)

Chapter I General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation and create a clean, beautiful and civilized city environment, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations of the State Council on the Administration of City Appearance and Environmental Sanitation and other relevant laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the areas where urbanization management is implemented within the administrative area of Hangzhou.

The scope of urbanization management shall be delineated and promulgated by the district and county (city) people's governments and reported to the Municipal People's governments for the record.

The city appearance and environmental sanitation management authority of the State-level Development Zone Management Committee and the West Lake Scenic Area Management Committee shall be implemented in accordance with the Regulations of Hangzhou Economic and Technological Development Zone and other relevant local regulations. Article 3 The city appearance and environmental sanitation work of this Municipality shall follow the principles of unified leadership, hierarchical management, public participation and social supervision. Article 4 People's governments at all levels shall strengthen the leadership, organization, coordination and supervision over the work of city appearance and environmental sanitation.

District and county (city) people's governments shall be responsible for the city appearance and environmental sanitation work within their respective jurisdictions. Sub-district offices and Township People's governments shall, in accordance with the provisions of the district and county (city) people's governments, be responsible for the city appearance and environmental sanitation work within their respective jurisdictions. Fifth Hangzhou city appearance and environmental sanitation administrative department (hereinafter referred to as the city appearance and environmental sanitation department) is responsible for the supervision and management of the city appearance and environmental sanitation.

District, county (city) city appearance and environmental sanitation departments under the leadership of the people's government at the same level, responsible for the supervision and management of city appearance and environmental sanitation within their respective jurisdictions.

Urban management administrative law enforcement organs at all levels or county (city) city appearance and environmental sanitation, planning and other competent departments (hereinafter referred to as administrative law enforcement organs) that do not exercise the power of administrative punishment relatively centrally shall impose administrative penalties on acts that violate the provisions on the administration of city appearance and environmental sanitation according to law.

Other relevant administrative departments shall, in accordance with their respective responsibilities, coordinate the implementation of these regulations. Sixth administrative departments and administrative law enforcement organs shall implement the law enforcement responsibility system and fault investigation system in the management of city appearance and environmental sanitation.

The supervisory organs of the people's governments at all levels in this Municipality shall carry out administrative supervision over the administrative departments, administrative law enforcement organs and their staff according to law. Article 7 People's governments at all levels shall incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan, improve the facilities of city appearance and environmental sanitation, provide public services of city appearance and environmental sanitation, ensure the funds needed for the construction and management of city appearance and environmental sanitation and increase them year by year, so as to adapt the cause of city appearance and environmental sanitation to the needs of the city's economic and social development and the people.

People's governments at all levels shall encourage and support scientific and technological research on city appearance and environmental sanitation, popularize and apply advanced technologies, and improve the level of city appearance and environmental sanitation. Eighth city appearance and environmental sanitation departments shall, according to the needs of the development of city appearance and environmental sanitation, organize the preparation of local city appearance and environmental sanitation professional planning, and incorporate it into the overall urban planning. Article 9 All units and individuals have the right to enjoy good city appearance and environmental sanitation, and they also have the obligation to maintain the city appearance and environmental sanitation.

All units and individuals shall respect the work of city appearance and environmental sanitation workers, and shall not hinder or obstruct them from performing their official duties.

City appearance and environmental sanitation workers shall abide by professional ethics and operate in a civilized manner. Article 10 The competent departments of city appearance and environmental sanitation at all levels and the administrative departments of culture, radio, film and television, press and publication, education and health, as well as the operating or managing units of public places such as airports, stations, docks and tourist attractions, should strengthen publicity and education on city appearance and environmental sanitation and enhance the public's awareness of maintaining city appearance and environmental sanitation.

The publicity columns (columns) of radio, television, newspapers and other publicity media and public places in this Municipality shall arrange the publicity contents of city appearance and environmental sanitation. Eleventh to promote and encourage community residents' committees to organize community residents to formulate conventions for the maintenance of city appearance and environmental sanitation, mobilize community residents to actively participate in the management of city appearance and environmental sanitation, and create a clean, beautiful and civilized community. Twelfth people's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in the work of city appearance and environmental sanitation. Chapter II Responsibility for City Appearance and Environmental Sanitation Article 13 This Municipality implements the responsibility system for city appearance and environmental sanitation. The relevant units and individuals shall, in accordance with the provisions of these regulations, maintain the city appearance and environmental sanitation in the area of responsibility. Article 14 The area of responsibility for city appearance and environmental sanitation refers to the corresponding area around buildings and structures owned, used or managed by relevant units and individuals or other facilities, places and areas within a certain range.

The specific scope of the city appearance and environmental sanitation responsibility area shall be determined by the district and county (city) people's governments. Fifteenth city appearance and environmental sanitation responsibility area responsible person is determined in accordance with the following provisions:

(a) the environmental sanitation cleaning of urban roads, streets, public squares and other urban public areas, public toilets, garbage transfer stations and other environmental sanitation public facilities shall be the responsibility of the district, county (city) city appearance and environmental sanitation department or its entrusted operation and maintenance unit;

(two) the implementation of property management in residential areas, by the property management companies; There is no property management of residential areas, by the community residents committee is responsible for;

(three) the river and its ancillary facilities, coastal greening (public green space), by the use and management of units responsible for;

(4) Tunnels, highways, railways, underpasses, bridges and their ancillary facilities shall be the responsibility of the business management units;

(five) culture, sports, entertainment, tourist attractions, parks (public green spaces), airports, stations, docks and other public places, by the management, management, property rights units responsible;

(six) commodity trading markets, shopping malls, supermarkets, restaurants, exhibitions and other places and surrounding areas, by the business management unit;

(seven) the business premises and surrounding areas of organs, organizations, military units, enterprises and other units and individual industrial and commercial households shall be responsible for the units or individual industrial and commercial households;

(eight) the construction site is the responsibility of the construction unit, and the land to be built is the responsibility of the owner unit;

(9) Street facilities such as newsstands, bus shelters, telephone booths and outdoor advertisements, as well as overhead pipelines, poles and lines, shall be the responsibility of the property right unit or management unit.

In accordance with the provisions of the preceding paragraph, the area with unclear responsibilities shall be responsible by the local sub-district offices and township people's governments. The responsibility of the urban-rural fringe or the administrative border is unclear, and the determination of the responsible person is controversial, which shall be determined by the district and county (city) people's government; Cross regional determined by the competent department of city appearance and environmental sanitation.
