Legal. According to Article 41 of the Property Management Regulations.

1. The owner shall pay the property service fee according to the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement. Property that has been completed but has not been sold or handed over to the property buyer shall be paid by the construction unit.

2. During the delivery period, the construction unit needs to pay the property fee. After the delivery of the house, regardless of whether the owner actually lives, the property management company has provided property services, and the owner cannot refuse to pay the property fee because the house has not been delivered. The property fee that caused the owner not to move in was paid by the construction unit, and the owner did not need to pay it.
