Specific procedures for the use of housing maintenance funds:

2. Make a plan and confirm it by the owner: the applicant has made a maintenance, renewal and transformation plan, and the transformation plan has been approved by the owner whose exclusive part accounts for more than 2/3 of the total construction area and more than 2/3 of the total number of people within the scope of maintenance funds. The applicant will entrust the owner's agent to apply for maintenance funds for comments, maintenance and renovation plan, and the owner's written voting certificate to be publicized in the community for seven days. During the publicity period, if the owner has any objection, he will complain to the management center.

3. On-site inspection: the staff of the management center went to the community for on-site inspection and kept the video materials;

4. Application for expenses: The applicant applies for expenses to the management center with relevant materials.

5. Appropriation of use funds for the first time: after the approval of the Municipal Housing Security and Housing Administration, the project funds (70% of the project budget) will be allocated to the "use account" opened by the applicant in a special bank, and the funds in the "use account" account can only be allocated to the construction unit.

6. Organization and implementation: the applicant or relevant owners organize the implementation of the maintenance, renovation and reconstruction plan.

7. Completion acceptance: After the project is completed, the realty service enterprise, the owners' committee, the owners' representative and the construction unit will accept the project, and sign the acceptance sheet for maintenance, renewal and renovation.

8. Payment for the use of the final payment: The applicant shall fill in the Distribution List of Settlement Expenses of Maintenance, Renewal and Reconstruction Projects according to the settlement expenses of the projects, and publicize the distribution list and the completion acceptance list of the maintenance, renewal and reconstruction projects in the community for seven days. If the owner has no objection at the expiration of the publicity period, the applicant shall go through the formalities of applying for the final payment of the project with relevant materials to the management center, and pay the final payment of the project to the applicant after the approval of the Municipal Housing Security and Housing Authority.

Maintenance, renovation and renovation projects in any of the following circumstances, the property service enterprise, the owners' committee or the community residents' committee shall adopt the tender method to determine the maintenance unit:

(a) the total cost of maintenance, renovation and transformation exceeds 300 thousand yuan;

Thirty-first the following expenses can be charged from the special maintenance funds:

Article 32 During the period when the special maintenance fund is entrusted by the maintenance fund management institution, in case of an emergency that seriously affects the normal use of the owners, the realty service enterprise shall immediately report to the maintenance fund management institution, and the maintenance fund management institution shall verify and notify the commercial bank that opened the account to allocate the funds in advance within 24 hours, and the expenses shall be paid from the relevant owners' special maintenance fund account.

In the event of an emergency as specified in the first paragraph of this article during the management of special maintenance funds by the owners' committee, the realty service enterprise shall immediately report to the owners' committee and inform the local neighborhood offices (town governments) at the same time, and the owners' committee shall, in accordance with the provisions of the emergency withdrawal plan for special maintenance funds, pay the expenses from the relevant owners' special maintenance fund accounts.

In case of emergency as stipulated in the first paragraph of this article, the community residents' committee shall immediately report to the maintenance fund management institution, which shall verify and notify the commercial bank that opened the account to allocate funds in advance within 24 hours, and the expenses shall be charged from the relevant owners' special maintenance fund account.

Thirty-third special maintenance funds have not been handed over to the owners' committee for management, and the allocation of special maintenance funds shall be carried out in accordance with the following procedures:

(a) the realty service enterprise or the community residents' committee shall apply to the maintenance fund management institution for appropriation with the special maintenance fund use plan filed by the Municipal Housing and Urban-Rural Development Bureau;

(two) maintenance fund management institutions according to the transfer application and the owner's account balance. 70% of the special maintenance funds allocated in accordance with the provisions;

(three) after the completion of the maintenance project, the realty service enterprise or the community residents' committee shall publicize the final accounts of the project in the community for 7 days, and apply to the maintenance fund management institution for allocating the balance of the project with the consent of the owners' committee. The final accounts of projects that the owners' committee disagrees with shall be audited by qualified social intermediary institutions.

Thirty-fourth special maintenance funds have been handed over to the owners' committee for management, and the allocation of special maintenance funds shall be handled in accordance with the following procedures:

(a) the realty service enterprise according to the maintenance, renovation and transformation projects put forward the use plan, the use plan shall be approved by more than 2/3 of the relevant owners;

(II) The realty service enterprise submits an application for advance maintenance funds to the owners' committee with relevant materials, and if the owners' committee agrees to advance maintenance funds, it shall report the relevant materials to the Municipal Housing and Urban-Rural Development Bureau for the record;

(3) The owners' committee shall notify the special account management bank to allocate the expenses not exceeding 70% of the approved budget amount with the filing certificate of the Municipal Housing and Urban-Rural Development Bureau;

(four) after the completion of the maintenance project, the property service enterprise shall publicize the final accounts of the project within the community for 7 days. With the consent of the owners' committee and the filing of the Municipal Housing and Urban-Rural Development Bureau, the owners' committee shall notify the special account management bank to allocate the balance of maintenance expenses. If the owners' committee has any objection to the final accounts of the project, it shall submit it to a qualified social intermediary institution for audit.

Article 35 If the actual amount of maintenance funds is lower than the pre-allocated amount, the balance shall be paid into the special maintenance fund account within 15 working days.

Article 36 If the final accounts of maintenance fund projects exceed 10% of the budgeted amount or exceed 10,000 yuan, they shall be re-declared according to the procedures for using maintenance funds.

Thirty-seventh City Housing and Urban-Rural Development Bureau shall strengthen the supervision and inspection of the management and use of special maintenance funds, and promptly investigate and deal with violations and illegal acts in the process of management and use of special maintenance funds.

Thirty-eighth the management and use of special maintenance funds shall be subject to the supervision of the financial and auditing departments according to law.

Chapter V Legal Liability

Thirty-ninth in violation of the provisions of these measures, the State Council "property management regulations", "Zhejiang property management regulations", "Ningbo residential property management regulations" and other laws, regulations and rules have been punished, from its provisions.

Forty-first special maintenance funds departments, management agencies and their staff do not perform their duties or abuse their powers, the competent department shall order them to make corrections, and the directly responsible person in charge and other responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VI Supplementary Provisions

Forty-second public housing mentioned in these rules includes public housing directly managed by real estate management departments and public housing managed by units.

Article 44 The term "medium repair and above" as mentioned in these Rules refers to:

(a) the main load-bearing wall structure is partially damaged and needs to be demolished and reinforced;

(two) the roof and outdoor wall of the whole building need waterproof or thermal insulation construction;

(three) the cornice of the whole building has fallen off to more than 30% of the cornice area of the whole building and needs maintenance;

(four) the whole building or unit * * * part of the ground, doors and windows and stair handrails need to be repaired as a whole due to damage;

(five) the road surface in the property management area is damaged by more than 30% and needs to be repaired as a whole;

(six) the whole building or unit sewer pipe aging, damage, need to update and transform;

(seven) intelligent system, fire control system, etc. Need to be replaced as a whole, or the one-time cost of replacement, maintenance and renovation exceeds 20% of the original cost;

(eight) to replace the elevator, or to replace or repair the main parts of the elevator, and the one-time cost exceeds 20% of the original price of the elevator;

(nine) the walls and gates in the property management area are damaged and need to be repaired and updated as a whole.

Forty-fifth public housing sold before the implementation of these rules has paid maintenance funds, and the maintenance funds will be included in the owner's ledger as the first deposit.

Before the implementation of these rules, the property community has set up elevator renewal funds or intelligent facilities and equipment maintenance funds, and the funds are still earmarked for elevator renewal and intelligent facilities and equipment maintenance, or according to the resolution of the owners' meeting.

Before the implementation of these rules, special funds for property management have been paid in residential quarters, which will be used as the overall fund for special maintenance of residential quarters, and will be used for the maintenance, renewal and transformation of * * * parts and facilities and equipment in residential quarters.

Before the implementation of these rules, the maintenance funds for demolition and resettlement houses that should be paid or paid in accordance with the regulations should be used as a whole for the maintenance, renewal and transformation of the parts and facilities of the corresponding demolition and resettlement communities.
