Article 2 Supporting kindergartens in urban residential areas refer to kindergartens that need supporting construction in old city reconstruction, new district construction, village withdrawal and residential construction, including kindergartens that need supporting construction according to the planning requirements in the development of commercial residential areas and the construction of affordable housing (including resettlement houses) invested by the government (hereinafter referred to as supporting kindergartens).

Article 3 The administrative departments of development and reform, natural resources and planning, construction and education in all districts and counties shall, in accordance with the division of responsibilities, do a good job in the construction and management of supporting kindergartens, and ensure the synchronous planning, synchronous design, synchronous construction, synchronous acceptance and synchronous delivery of supporting kindergartens and newly-built residential quarters. If there are problems such as delaying construction, shrinking construction, stopping construction, not building, not paying, etc., before the rectification is in place, the residential area shall not go through the completion acceptance filing procedures.

Article 5 In the special plan for the layout of preschool education facilities, kindergartens shall be built in accordance with the Standard for Planning and Design of Urban Residential Areas (GB 50 180-20 18), and the scale shall be calculated according to the school radius, planned population or construction area of urban residential areas. In principle, 1 standard kindergarten will be built in the new district, with 9- 12 classes and a population of 5,000. On the premise of meeting the service radius, optimize the scale of densely populated areas and give full play to the service efficiency of public education resources. Need to take care of the needs of infants and young children, appropriately expand the scale of supporting kindergartens on the original basis.

For sporadic residential construction or group development areas with non-piece development land, and small-scale residential areas with planned residential construction area or population that can't meet the requirements of supporting construction standards, according to the principle of "small area and large supporting facilities", the number of students is scientifically calculated according to the planning standards and regional resident population, and the land for early childhood education is planned separately or kindergartens are planned in adjacent large blocks in combination with the actual situation.

Sixth supporting kindergarten construction projects must strictly abide by the basic procedures of project construction, and report to the development and reform department for approval, approval or filing.

Article 7 When examining and approving projects, the development and reform department shall make clear the construction content, scale and standards of supporting kindergartens according to the special planning of preschool education facilities layout, detailed planning of land and space and relevant construction standards; Natural resources and planning departments shall specify the location and construction requirements of supporting kindergartens when issuing planning conditions. For the plots that need to support the construction of kindergartens, the land supply should be clear about the land area, specific location, construction requirements, construction period, decoration standards, ownership units after completion, delivery methods, regulatory requirements and other contents of supporting kindergartens, and be clear in the land transfer announcement. Before signing the land transfer contract, the bidder should first sign a construction agreement with the supporting kindergarten property unit.

Supporting kindergarten land should be independent, and non-kindergarten buildings or facilities should not be arranged in the mainland within the scope of land use; It is not allowed to set up any above-ground entrances and exits and underground facilities within the scope of supporting kindergarten land.

Article 8 When the development and reform department approves the project and the natural resources and planning department reviews the design scheme of residential community construction projects, it shall determine the location of supporting kindergartens according to the planning conditions and the standards such as Design Code for Nurseries and Kindergartens (JGJ39-20 16) and Kindergarten Construction Standard (JB 175- 20 16). The natural resources and planning departments inform the education departments to participate in the review in the form of joint review.

Supporting kindergartens should have sufficient sunshine, independent functions, clear boundaries with other land in residential areas, and provide safe and smooth entrances and exits separately.

Supporting kindergartens shall be designed and constructed in accordance with the relevant national and provincial architectural design standards and seismic design specifications, so as to meet the requirements of fire protection, anti-terrorism, sanitation and environmental protection, and appropriately reserve space for free movement of personnel and parking of vehicles. At the same time, the particularity of preschool education should be fully considered, and the design and construction of activity venues, green spaces and related environments should be done well to ensure the safety of children and faculty.

Article 9 The construction department shall invite the education administrative department to participate in the supervision of kindergarten construction. The development and reform department, the construction department or the project construction unit shall invite the education department to participate in the kindergarten acceptance.

Article 10 According to the principle of "whoever develops and builds will improve the supporting facilities", the supporting kindergartens shall be built by the development and construction units to ensure that the construction of supporting kindergartens and the development and construction of residential areas are carried out simultaneously. The construction unit shall build the residential area of the supporting kindergarten project by stages, and the supporting kindergarten shall be planned, designed, approved, constructed, accepted and completed simultaneously with the first phase of the residential area project. If the kindergarten facilities are not built in accordance with the construction project planning permit or the existing residential projects in the residential area are not completed simultaneously, the natural resources and planning departments shall not verify the completion plan and make rectification within a time limit according to law.

Kindergartens with independent land use should match the development sequence of surrounding residential quarters and define the construction subject according to the requirements of the local people's government.

Eleventh to encourage the development and construction units to decorate supporting kindergartens and configure the facilities in the park. If the matching kindergarten decoration is not included in the general contract, the decoration contractor can enter the site for decoration construction only after the quality acceptance of the main structure division of the kindergarten building is qualified. The decoration standard of supporting kindergartens shall not be lower than that of provincial kindergartens, and the decoration scheme shall be approved by the local education department.

Article 12 After the completion of the supporting kindergarten (including the renovation project agreed in the contract), the construction unit shall promptly hand over the kindergarten to the education department of the jurisdiction for management and use, and the education department of the jurisdiction shall organize it as a public kindergarten, but it shall not be organized as a profit-making kindergarten. The local people's governments and relevant departments should do a good job in the establishment of institutions and the allocation of teachers.

Thirteenth natural resources and planning departments are responsible for obtaining the land use right of supporting kindergartens from residential development plots, and the land use right shall be handled according to the kindergarten land. At the same time, according to the property right unit specified in the land transfer contract or land allocation decision, the initial registration of supporting kindergartens is directly handled, and the registration and certification information is shared with the tax authorities.

Fourteenth supporting kindergartens belong to public education resources, and no unit or individual may dismantle or leave them idle without authorization, and may not rent, sell, transfer, mortgage or change their uses. If it is really necessary to expropriate or occupy kindergartens due to urban construction and transformation, they should be rebuilt nearby or easily according to the principle of first building and then demolishing, and the normal conservation and education work shall not be affected or interrupted.

Once the kindergarten supporting land planning is determined, no unit or individual may occupy or change it without authorization. If it is really necessary to adjust, the relevant planning shall be adjusted according to legal procedures. The adjusted planned land area shall not be less than the original area, and it shall be reported to the people's government at the same level for approval after examination and approval by the departments of education, natural resources and planning.

Fifteenth district education departments shall, in conjunction with the administrative departments of construction, natural resources and planning, development and reform, finance and comprehensive law enforcement, conduct joint inspections on the construction and use of supporting kindergartens. If it is found that the supporting kindergartens are not well planned, should be built but not delivered, are not run by public kindergartens, are idle or used for other purposes, they shall be ordered to make rectification and be held accountable according to laws and regulations.

Sixteenth supporting kindergarten enrollment should give priority to meet the needs of school-age children in this residential area. The charging standards for supporting kindergartens shall be formulated by the local development and reform department in conjunction with relevant local departments in accordance with the relevant provisions of the state and the province.

Seventeenth supporting kindergartens are independent school units, and their security and property services have an independent system. Supporting kindergartens are independent land, managed independently and free of residential property management fees.

Eighteenth districts and counties should be based on these measures, combined with the actual adjustment and improvement of local supporting kindergarten construction management implementation measures, to make specific provisions on planning, design, construction, transfer, holding, recycling, construction and so on.
