Regulations of Changchun Municipality on the Administration of Urban Housing Safety
The district construction administrative departments are the competent departments of housing safety management in their respective jurisdictions.
Construction, economy, planning, production safety supervision, public security, industry and commerce administration, commerce, development and reform commission (bureau) and other relevant departments shall, according to their respective responsibilities, do a good job in housing safety management. Chapter II Safety Management of House Use Article 5 The owner of a house is the person in charge of house safety.
The user (unit) of allocated real estate is the person responsible for the safety of allocated real estate.
The person in charge of housing safety shall use the house reasonably according to the design purpose of the house to ensure the original integrity, seismic performance and structural safety of the house. Sixth before the demolition of houses, the owner of non-residential houses shall apply to the municipal housing safety department; The owner of a residential house shall apply to the competent department of housing safety in the district where it is located, and the house can only be removed after obtaining the permit for house removal. Construction projects that have obtained construction permits according to law are no longer allowed to demolish houses.
The term "house demolition and reconstruction" as mentioned in these Regulations refers to the act of changing the load-bearing structure of houses, increasing the design load of houses, and installing facilities and equipment that affect the safety of houses.
The load-bearing structure as mentioned in these Regulations refers to the main structural members and their connecting nodes that directly transfer their own weight and various external forces to the foundation, including load-bearing walls, uprights, columns, frame columns, piers, floors, roofs, foundations, beams, roof trusses and suspension cables. Seventh to apply for the "Housing Demolition Permit", the following materials shall be submitted to the competent department of housing safety:
(1) an application;
(2) The legal identity certificate of the applicant;
(3) the certificate of ownership of the house or the record certificate of quality acceptance or the whole house safety appraisal report;
(four) the demolition design plan put forward by the original design unit or the design unit with corresponding qualification grade; Does not involve the change of the load-bearing structure of the house and there is no design scheme, it shall provide the house safety appraisal report that the demolition and transformation part does not affect or the reinforcement does not affect the use safety of the house;
(5) Other materials required by laws and regulations.
If the user of the house applies, he shall also submit the consent of the owner of the house. Eighth housing safety authorities shall, within twenty working days from the date of accepting the application, approve the qualified ones and issue the "Housing Demolition Permit"; Do not meet the requirements, it shall explain the reasons in writing. Ninth the applicant shall carry out the construction in accordance with the demolition location and scope approved by the house demolition permit.
If the applicant changes the site beyond the scope of demolition and reconstruction, it shall re-apply in accordance with the examination and approval procedures. Tenth after the completion of the house demolition and reconstruction, the applicant shall submit the relevant materials of quality acceptance to the competent department of housing safety for the record within 30 days (except for the basic construction procedures). Eleventh city housing safety departments shall regularly organize relevant departments to inspect the housing safety of public places such as education, health, sports, culture, transportation and commercial services. For houses with potential safety hazards, the person responsible for housing safety shall be ordered to make rectification within a time limit. Article 12 The person in charge of housing safety and the property management enterprise shall do a good job in the management of housing use safety within the scope of management, stop the unauthorized demolition and alteration of the load-bearing structure of the house, and refuse to accept the management, and shall report to the competent department of housing safety in a timely manner.
If the user of the house finds that there are hidden dangers in the house, he shall inform the person in charge of the house safety or report to the competent department of the house safety. Chapter III Management of Housing Safety Appraisal Article 13 Housing safety appraisal refers to the appraisal and judgment of housing safety status by legally established housing safety appraisal institutions (hereinafter referred to as appraisal institutions).
The appraisal conclusion made by the appraisal institution is the basis for determining the safety status of the house. Fourteenth in any of the following circumstances, the person in charge of housing safety shall apply to the appraisal institution for housing safety appraisal:
(1) Changing the load-bearing structure of the house;
(two) increase the design load of the house;
(three) the installation of facilities and equipment that affect the safety of housing use;
(four) due to construction, production and business activities affect the safety of surrounding houses;
(five) the house continues to be used beyond the designed service life;
(six) natural disasters or fire, explosion and other accidents affect the safety of the house;
(seven) there are signs that endanger the safety of housing use;
(eight) education, health, sports, culture, transportation, business services and other public places have not been used for a certain number of years for housing safety appraisal;
(nine) other things that may endanger the safety of the house and need to be identified.
The above appraisal objects include water towers, chimneys, pools, retaining walls and other structures.
The time limit for safety appraisal in public places shall be stipulated separately by the Municipal People's Government.
In the circumstances specified in items 1, 2 and 3 of the first paragraph of this article, if there is a demolition design scheme put forward by the original design unit or a design unit with corresponding qualification grade, it is not necessary to apply for housing safety appraisal.
