Legal analysis: Building a house on the foundation of a house can dig a basement. However, as long as the civil construction project of rural homestead belongs to the scope of urban planning area, it should go through the formalities of civil air defense examination and approval according to law.

Legal basis: According to Article 8 of the Regulations on the Management of the Development and Utilization of Urban Underground Space in Changchun, the construction units of single and completed underground space construction projects shall apply to the competent departments of urban and rural planning, land, construction, public utilities, real estate, civil air defense and the fire control institutions of public security organs for relevant procedures according to law. No unit or individual is allowed to dig underground space without authorization. The property management of underground space shall be implemented with reference to relevant laws and regulations.
