Article 1 In order to standardize the use of carports and garages, maintain social order and city appearance and environmental sanitation, and ensure smooth urban traffic, these Provisions are formulated in accordance with the relevant provisions of the state and the province and in combination with the actual situation of this Municipality. Article 2 These Provisions shall apply to the use and management of carports and garages in urban areas of this Municipality and built-up areas of counties (cities). Article 3 The garage mentioned in these Provisions refers to the ancillary buildings (structures) used for supporting residential construction and parking non-motor vehicles or motor vehicles according to the planning requirements. Article 5 The owner or non-owner of the garage shall use the garage according to its designed purpose, and shall not change the use nature of the garage. If it is really necessary to change, it shall obtain the consent of the interested parties, report to the planning and other relevant departments for approval, and go through the relevant procedures. Article 6 A lease contract shall be signed for renting a carport garage according to law, and the lessor shall go through the registration formalities with the administrative department of housing management where the carport garage is located within 10 days from the date of signing the lease contract. Article 7 When applying for garage lease registration, the following documents shall be submitted:

(a) proof of ownership or use right of the garage;

(two) the applicant's identity card or other valid documents;

(3) The lessee's resident identity card or other valid documents.

Ninth in any of the following circumstances, the garage shall not be rented:

(a) the ownership of the carport garage is controversial;

(two) there is no certificate of ownership of the carport garage or other legal proof of ownership;

(three) has been notified to be included in the scope of urban planning and demolition, ready for demolition;

(four) without the consent of the mortgagee, it has been mortgaged as an asset;

(5) Belonging to illegal construction;

(six) does not meet the safety standards of the carport garage, which affects the safety of use;

(seven) there are other circumstances that prohibit rental according to law. Article 10 Community residents' committees and realty service enterprises shall strengthen the inspection of the use of carports and garages within the management area, and report the acts in violation of these Provisions to the relevant administrative departments in a timely manner. Eleventh in violation of the provisions of Article 5, without changing the nature of the carport garage, the planning administrative department shall give a warning to the owner or non-owner users and order them to make corrections within a time limit; If no correction is made within the time limit, a fine of more than 50 yuan and less than 500 yuan shall be imposed. Those who live in the carport garage or use the carport garage to open a shop shall be fined not less than 2,000 yuan in 500 yuan.

In areas where the power of administrative punishment for urban management is relatively concentrated, the power of punishment as prescribed in the preceding paragraph shall be exercised by the administrative law enforcement department for urban management. The relevant administrative departments receive complaints and reports about the illegal use of carports and garages, and shall investigate and deal with matters within the scope of their duties within 5 working days, and feed back the investigation results to the complainant; For matters that do not belong to the investigation of this department, the complainant shall be informed to complain and report to the relevant administrative departments. Fourteenth relevant administrative departments and their staff do not perform their duties according to law, or do not perform their duties and procedures according to regulations, and shall be dealt with by their superior competent departments or supervisory organs according to law.
