Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations of the State Council on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations in order to strengthen the safety management of the sale and discharge of fireworks and firecrackers, ensure the safety of the public, people and property, reduce air pollution and improve environmental quality. Article 2 These Regulations shall apply to the safety management of the sale and discharge of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The people's governments of cities and counties (districts) shall be responsible for the safety management of the sales and discharge of fireworks and firecrackers within their respective jurisdictions.

The Town People's Government and sub-district offices shall strengthen the organization, coordination, guidance and supervision of the safety management of fireworks sales and discharge. Fourth safety production supervision and management departments are responsible for the supervision and management of fireworks and firecrackers safety production; The public security organ is responsible for the safety management of fireworks and firecrackers; Urban management law enforcement departments shall assist public security organs in the management of urban fireworks and firecrackers.

Housing and urban and rural construction, transportation, environmental protection, education, civil affairs, market supervision, postal services and other departments shall, in accordance with their respective responsibilities, do a good job in the safety management of fireworks sales and discharge according to law.

Supply and marketing cooperatives shall strengthen the safety management of fireworks and firecrackers business activities of enterprises in this system. Fifth other organs, organizations, enterprises and institutions, residents' committees, villagers' committees, owners' committees and property service organizations shall cooperate with the safety management of fireworks and firecrackers. Sixth city and county (District) people's governments and their relevant departments shall organize publicity and education on the safety management of fireworks and firecrackers, and guide citizens to discharge fireworks and firecrackers in accordance with the law, civilization and safety. During major festivals, increase the publicity of fireworks sales and safety management.

Radio, television, newspapers, Internet and other media shall publicize the safety management of fireworks and firecrackers for public welfare.

Schools and guardians of minors shall educate minors on the safety of fireworks and firecrackers. Outside the areas specified in the preceding paragraph, the people's governments of cities and counties (districts) may, according to the actual situation of their respective administrative areas, determine other areas where the sale and discharge of fireworks and firecrackers are prohibited; Involving high-tech development zones, it shall be determined by the local people's government after soliciting the opinions of the Administrative Committee of the High-tech Development Zone. After the sales and discharge areas of fireworks and firecrackers are determined, the county (District) people's government shall make an announcement to the public. Article 8 It is forbidden to sell and set off fireworks and firecrackers in the following places outside the areas specified in Article 7 of these regulations:

(1) State organs;

(2) cultural relics protection units;

(three) transportation hubs such as stations and airports, urban rail transit and railway line safety protection zones, and motor vehicle parking lots;

(4) Underground spaces such as urban roads, overpasses and underpasses;

(5) Units that produce, store and sell inflammable and explosive articles;

(6) Medical institutions, schools, kindergartens, sanatoriums and institutions for the aged;

(seven) key fire prevention areas such as parks, forests and grasslands;

(8) Safety protection zones for power transmission and transformation facilities;

(nine) key units of fire safety and crowded places;

(ten) other places where the sale and discharge of fireworks and firecrackers are prohibited as determined by the people's governments of cities and counties (districts);

(eleven) other laws and regulations prohibit the sale of fireworks. Ninth heavy pollution weather warning and emergency response period, it is forbidden to set off fireworks.

The Municipal People's Government shall timely release the early warning and emergency response information of heavy polluted weather through the news media to remind the public not to set off fireworks and firecrackers during this period. Tenth enterprises engaged in the wholesale and retail of fireworks and firecrackers shall, in accordance with the relevant provisions of the "Regulations on the Safety Management of Fireworks and Firecrackers" in the State Council, apply to the municipal and county (district) safety production supervision and management departments for administrative license according to law. Article 11 Fireworks and firecrackers wholesale enterprises shall, in accordance with the relevant provisions of the state, establish and improve the responsibility system for production safety, various safety management systems and operating procedures, establish and strictly implement the contract management and flow registration system, improve the contract management and flow registration files, and keep them for three years for future reference. Twelfth enterprises engaged in the wholesale of fireworks and firecrackers should purchase fireworks and firecrackers from enterprises that produce fireworks and firecrackers, and supply fireworks and firecrackers to operators engaged in fireworks and firecrackers retail. Operators engaged in the retail of fireworks and firecrackers should buy fireworks and firecrackers from enterprises engaged in the wholesale of fireworks and firecrackers.

Enterprises and retail operators engaged in the wholesale of fireworks and firecrackers shall not purchase and sell fireworks and firecrackers illegally produced and operated.

Enterprises engaged in the wholesale of fireworks and firecrackers shall not supply fireworks and firecrackers to operators engaged in the retail of fireworks and firecrackers, and the retail of fireworks and firecrackers shall be set off by professional fireworks and firecrackers operators in accordance with national standards. Operators engaged in the retail of fireworks and firecrackers shall not sell fireworks and firecrackers that should be set off by professional fireworks and firecrackers operators in accordance with national standards.
