Detailed rules for the implementation of Pingdingshan urban and rural planning and construction management regulations

Article 1 In order to implement the Regulations on the Management of Urban and Rural Planning and Construction in Pingdingshan City, standardize the management of urban and rural planning and construction, improve the living environment, and promote the comprehensive, coordinated and sustainable development of urban and rural economy and society, these Detailed Rules are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC) and the Measures for the Implementation of the Urban and Rural Planning Law of People's Republic of China (PRC) in Henan Province, combined with the actual situation of this Municipality. Article 2 These Rules shall apply to the management of urban and rural planning and construction within the administrative area of this Municipality and the handling of illegal construction within the planning area. Article 3 The implementation of urban and rural planning and construction management should take people as the starting point and destination of urban development and run through the whole process of urban and rural planning and construction management.

The implementation of urban and rural planning and construction management should be based on laws, regulations, rules and approved urban and rural planning, and conform to the relevant technical standards and norms of urban and rural planning and construction management. Fourth urban and rural planning and construction management is an important responsibility of the people's governments at all levels. The unified leadership of the government, the director of the planning department, the cooperation of relevant units and public participation shall be implemented.

Any unit or individual has the right to put forward opinions and suggestions on the formulation, revision, implementation, supervision and inspection of urban and rural planning, inquire about the permitted contents of urban and rural planning and construction projects according to law, and have the right to report or accuse violations of urban and rural planning and construction management. Article 5 The competent departments of urban and rural planning of cities, counties (cities) and Shilong District shall be responsible for the management of urban and rural planning and construction within their respective administrative areas, and their legally established institutions shall be responsible for the management of urban and rural planning and construction within their respective jurisdictions in accordance with the relevant provisions authorized or entrusted.

Sub-district offices shall do a good job in stopping and handling illegal construction within their respective jurisdictions according to law.

Development and reform, housing and urban construction, urban management, ecological environment, market supervision and management, water conservancy, civil air defense, cultural relics, finance, public security and other relevant departments shall, according to their respective responsibilities, do a good job in urban and rural planning and construction management according to law. Article 6 The people's governments of counties (cities, districts) and the administrative committees of urban-rural integration demonstration zones and high-tech zones shall establish and improve the coordination and linkage mechanism for stopping and investigating illegal construction:

(a) regularly study and report on the comprehensive management of illegal buildings;

(two) to study and solve the main difficulties and outstanding problems in the process of investigating illegal construction, and urge the relevant departments to perform their duties according to law;

(three) to organize the centralized demolition of illegal buildings and the forced demolition of illegal buildings with great difficulty in law enforcement;

(four) according to the administrative needs of the organization to carry out joint law enforcement, coordination of illegal construction matters under the jurisdiction of multiple departments;

(five) to guide and coordinate other important matters. Article 7 The people's governments of counties (cities, districts) and the administrative committees of urban-rural integration demonstration zones and high-tech zones shall be responsible for the illegal construction and demolition work within their respective jurisdictions according to law, establish and improve the working mechanism of illegal construction and demolition, and formulate and improve relevant systems such as the responsibility system for illegal construction and demolition. Article 8 The people's governments of counties (cities) and Shilong District shall organize or instruct relevant departments to dismantle illegal buildings within their jurisdiction according to law.

Xinhua District, Weidong District, Zhanhe District People's government and urban-rural integration demonstration zone, high-tech zone management committee shall, according to the notice of the instructions of the Municipal People's government, organize relevant departments to dismantle illegal buildings within their respective jurisdictions according to law.

Illegal construction in the township and village planning areas shall be ordered by the township people's government to stop construction and make corrections within a time limit; If it is not corrected within the time limit, it can be cleared.

If the village (neighborhood) committee finds illegal construction within its jurisdiction, it shall immediately dissuade it and report to the handling organ in a timely manner.

The owners' committee and the realty service enterprise shall have the right to dissuade and report to the handling organ if they find illegal construction within their management scope. Article 9 The people's governments of counties (cities, districts) and the administrative committees of urban-rural integration demonstration zones and high-tech zones shall establish and improve the patrol control system for illegal construction, formulate patrol control schemes according to their respective responsibilities and jurisdictions, clarify the responsible person, responsible area, patrol time, patrol focus and specific measures, and timely discover and stop illegal construction. Tenth departments and staff responsible for illegal construction inspection shall abide by the following provisions:

(a) in accordance with the relevant provisions of the inspection, and earnestly make inspection records;

(two) to discourage, stop and report illegal construction in a timely manner, and to collect evidence by means of recording, video recording, photographing or on-site inspection; Belong to the regulatory responsibilities of the department, according to the procedures; Do not belong to the regulatory responsibilities of the department, promptly transferred to the relevant departments;

(three) found that the construction site is suspected of illegal construction of building materials, which belong to the regulatory responsibilities of the department, timely registration and tracking monitoring; If it does not belong to the regulatory responsibilities of this department, it shall immediately notify the relevant departments, and the departments that have received the notice shall immediately register on the spot and follow up and monitor.

After accepting the notification, transfer and assignment of illegal construction projects or cases, the relevant departments shall report the handling situation to the original notification, transfer and assignment departments in a timely manner.

If the jurisdiction over illegal construction is unclear or controversial, the relevant departments shall determine the jurisdiction through consultation or report it to the administrative organ at the next higher level for designation. Eleventh water supply, power supply, gas supply, design, construction, supervision and other relevant units shall, after receiving the notice from the people's government of the city or county (city, district) to assist in the demolition of illegal buildings, stop providing related services or construction operations in accordance with the relevant provisions of the Regulations on the Administration of Urban and Rural Planning and Construction of Pingdingshan City.
