The circular stipulates that all commercial houses owned by real estate development enterprises should be used for public leasing and may not be sold or transferred. The single lease term of external lease shall not exceed 20 years, and shall not exceed the self-sustaining period stipulated in the land transfer contract.

In addition, the "Notice" also stipulates that unsold commercial houses that have been completed and accepted can apply to Foshan Housing and Construction Bureau for identification as self-sustaining commercial houses. Commercial housing owned by enterprises shall not be divided or mortgaged separately during the self-sustaining period. An enterprise shall not collect rent for more than one year at a time.

In terms of leasing operations, the Notice stipulates that housing enterprises can set up leasing management departments to carry out self-sustaining commercial housing leasing operations, and can also cooperate with housing leasing enterprises and real estate brokers. Before renting, the enterprise needs to submit the "Foshan Enterprise Self-sustaining Commercial Housing Rental Scheme". For the specific price, please refer to the guiding rent standard of housing rental market issued by Foshan Land and Urban Construction and Water Affairs Bureau (Profit).

In addition, all self-sustaining commercial houses of enterprises should be used for rental, and the rent for more than one year should not be charged at one time, and the self-sustaining commercial houses should not be sold in disguised form or bundled. In addition to the deposit, rent, property management fees and other reasonable expenses arising from the use of the house, the enterprise shall not charge additional fees to the lessee in any name.

In terms of lease contracts, enterprises need to sign lease contracts online through the lease platform in accordance with the "Foshan Housing Lease Contract Registration and Filing Rules (Trial)". The lease contract shall specify the self-sustaining period of the enterprise leasing the house, and the lease period of the house shall not exceed the self-sustaining termination period of the enterprise.

Illegal enterprises shall not participate in land bidding.

In principle, enterprises should apply for a certificate of immovable property rights in units of buildings, allowing overall mortgage. The certificate should indicate that "the self-sustaining commercial house of the enterprise shall not be divided, sold, transferred or mortgaged separately during the self-sustaining period."

In violation of the relevant provisions of the "Notice" of enterprises, by the district land and urban construction, water (profit) Bureau identified, ordered to rectify. Enterprises that refuse to rectify will be included in the "blacklist" of Foshan land market enterprises. Once included in the list, the enterprise, its controlling shareholder and its newly established enterprise shall not participate in any land bidding activities in Foshan in the latest year.

Regarding the transfer of enterprise-owned housing, the Notice also stipulates that enterprises can collectively transfer their own commercial housing when they are facing bankruptcy liquidation or merger and reorganization, or when their own commercial housing is auctioned due to litigation. However, individuals who accept the transfer of self-sustaining commercial housing by enterprises may not change the planned use of self-sustaining commercial housing during the self-sustaining period.
