Is it legal to ask for a deposit when decorating a house or property?

Legal analysis: the state has no clear regulations on this, but considering that some owners do not act according to the requirements when decorating, it will harm the interests of the community. It is reasonable for the property management company to charge a certain decoration deposit, and it can remind the owners to decorate according to the regulations. As the deposit is refundable, there is no harm to the owner of the decoration as required. If the owner and the property management company agree in the property management contract that the owner should pay the decoration management fee, then the owner should pay the management fee according to the contract; If there is no such agreement between the two parties, then the property management company cannot charge the owner the decoration management fee.

Legal basis: Article 277 of the Civil Code of People's Republic of China (PRC). Owners can set up owners' meetings and elect owners' committees. The specific conditions and procedures for the establishment of the owners' congress and the owners' committee shall be in accordance with the provisions of laws and regulations.

The relevant departments of the local people's government and the residents' committee shall give guidance and help to the establishment of the owners' congress and the election of the owners' committee.
