According to Articles 10 and 16 of the Measures for the Administration of Property Service Charges (Development and Reform Price [2003] 1864) and Articles 41, 42, 43 and 56 of the Chongqing Property Management Regulations, the purchase and sale contract signed by the residential construction unit and the property buyer and the preliminary property service contract all involve contents, service standards and charging standards. However, if the owner can't close the house or postpone it due to the reasons of the construction unit, the losses caused shall be borne by the construction unit.
At the same time, according to the preliminary property management contract signed, the owner is required to pay the full property management fee to the property management company in the case of not moving in after renovation, but he can apply to the property management company to pay the property management fee according to the standard of vacant houses.
