How long is the work-related injury appraisal file kept?

Records of work-related injury identification and labor ability appraisal shall be kept for 50 years.

Work-related injury identification is an administrative confirmation by the social insurance administrative department (now the Human Resources and Social Security Bureau) whether the accidental injury (or occupational disease) of employees belongs to work-related injury or is regarded as work-related injury according to the authorization of the law. Employees enjoy the treatment of work-related injury insurance, and it is the premise to get relief through legal channels in case of disputes.

Labor ability appraisal refers to the comprehensive evaluation of the degree of disability and loss of labor ability of injured workers by labor appraisal institutions (labor ability appraisal committees) according to the national appraisal standards (that is, the appraisal of the degree of disability and the degree of self-care obstacles), which is the basis and premise for giving insurance benefits to injured workers.

According to the Measures for Identification of Work-related Injuries in Ministry of Human Resources and Social Security and the Administrative Measures for Appraisal of Work Ability of Workers with Work-related Injuries in Ministry of Human Resources and Social Security and the State Health Planning Commission, the files for identification of work-related injuries and appraisal of work ability are kept for 50 years respectively.

Measures for the administration of labor ability appraisal of workers with work-related injuries

Article 4 The labor ability appraisal committee shall perform the following duties:

(1) Hire medical and health experts, establish a medical and health expert database, and train and manage experts;

(two) the organization of labor ability appraisal;

(three) to make the conclusion of labor ability appraisal according to the expert group's appraisal opinions;

(four) to establish a complete appraisal database and keep the appraisal work files for 50 years;

(five) other duties as prescribed by laws, regulations and rules.

Measures for determination of work-related injuries

Twenty-fourth after the end of the work-related injury identification, the social insurance administrative department shall keep the relevant information of the work-related injury identification for 50 years.
