Measures of Nanning Municipality on Property Management in Residential Areas

Chapter I General Provisions Article 1 In order to strengthen the management of urban residential areas, maintain public order in residential areas, and create a clean, civilized, safe and convenient living environment, these measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the property management of residential areas within the planned area of this Municipality. Article 3 The term "residential area" as mentioned in these Measures refers to a residential area mainly consisting of residential houses and corresponding supporting public facilities and non-residential houses.

The term "property" as mentioned in these Measures refers to all kinds of houses and supporting public facilities, equipment and public venues in residential areas.

The term "households" as mentioned in these Measures refers to the owners or users of houses in residential areas. Article 4 Nanning Real Estate Management Bureau is the administrative department in charge of property management in Nanning, and is responsible for the property management of the whole city.

Planning, construction, public security, sanitation, landscape, municipal, water supply, power supply and other relevant departments shall be responsible for the guidance, supervision and inspection of residential property management within the scope of their respective duties. Article 5 The management of urban residential areas in this Municipality adopts a socialized, professional and service-oriented property management mode, and implements a management system that combines the industry management of competent departments, independent management of residents and professional services of property enterprises. Chapter II Residential Property Management Institutions Article 6 When a residential area is put into use and the occupancy rate reaches more than 50%, the development and construction unit shall, under the guidance of the property management department, set up a residential property management committee (hereinafter referred to as the CMC) in time.

The CMC is elected by the first residents' congress or the residents' congress in residential areas through consultation.

The CMC shall register with the administrative department of property management within 05 days from the date of its establishment. Article 7 The CMC represents the interests of residents and safeguards their legitimate rights and interests. Under the guidance of the property management department, the CMC is responsible for formulating the articles of association of the CMC, hiring property management companies, inspecting and supervising property management companies, and assisting property management companies in property management. Article 10 Rights of property management enterprises:

(three) to discourage and stop acts that damage other people's property or hinder property management, and to demand compensation for the losses caused;

(six) to carry out diversified operations and paid services. Article 11 Obligations of property management enterprises:

(a) to perform the entrusted management contract, manage the maintenance of the entrusted houses, facilities and public parts, and undertake the public security, fire fighting, greening, maintenance and cleaning of residential areas and the daily necessary convenience services for residents;

(two) accept the supervision of the CMC and residents, and submit major management measures to the CMC for deliberation and decision;

(three) accept the guidance and supervision of the real estate management department, other relevant departments and street offices;

(four) to assist the neighborhood committees where the residential areas are located to do a good job in community management, community service and community spiritual civilization construction;

(a) the planning and completion of residential areas;

(2) as-built drawings of single buildings, structures and equipment;

(3) Completion drawing of underground pipe network;
