Measures of Harbin Municipality for the Administration of Credit Evaluation of Property Service Enterprises

Chapter I General Principles

Article 1 In order to promote the construction of the credit system of the property service industry in our city, promote the integrity and self-discipline of the property service enterprises, build a new market supervision mechanism with credit as the core, and safeguard the legitimate rights and interests of owners and property service enterprises, these measures are formulated in accordance with the relevant provisions of the Property Management Regulations, the Provisional Regulations on Enterprise Information Publicity, and the Regulations on Residential Property Management in Heilongjiang Province.

Article 2 These Measures shall apply to the credit evaluation and management of property service enterprises (including enterprises whose business scope includes property management or property service) engaged in property management and service activities within the administrative area of Harbin.

Article 3 The term "credit evaluation" as mentioned in these Measures refers to the activities of the property administrative department to evaluate the property management and service activities carried out by the property service enterprises in implementing laws, regulations, rules, normative documents and industry standards, fulfilling property service contracts and property management-related agreements, and observing the self-discipline standards of the property management industry.

The city's property service enterprises, with an independent legal person as the unit for credit evaluation; Property service enterprises entering the market from other places shall conduct credit evaluation with branches established in this city as the unit.

Article 4 Harbin Housing and Urban-Rural Development Bureau (hereinafter referred to as the municipal property department) is responsible for organizing the implementation of these Measures, and guiding and supervising the district and county (city) property departments (hereinafter referred to as the district and county property departments) to carry out credit evaluation related work.

District and county property departments are responsible for the audit of basic information of property service enterprises within their respective administrative areas and the collection, identification, evaluation and daily management of credit information, and guide and supervise street offices (township people's governments, the same below) to carry out credit evaluation related work.

Sub-district offices are responsible for auditing the basic information of property projects within their jurisdiction, guiding and supervising the daily management and service activities of property service enterprises in accordance with their statutory duties, and collecting relevant credit information.

Community neighborhood committees (villagers' committees, the same below) are responsible for assisting street offices in auditing the basic information of property projects and collecting relevant credit information.

Article 5 Harbin Property Management Association shall strengthen the self-discipline management of the industry, do a good job in the training of credit management of property service enterprises, and assist the municipal property administrative department to carry out credit evaluation management.

Chapter II Credit Information Management System

Article 6 The municipal property administrative department shall be responsible for the overall construction and maintenance of Harbin Smart Property Management Information System (hereinafter referred to as Smart Property System), and provide digital technical support for the credit evaluation of property service enterprises.

According to the management authority, the "Smart Property" system opens ports for municipal property authorities, district and county property authorities, street offices, community neighborhood committees, property management associations, property service enterprises, owners' committees (the same below), owners and other parties, and realizes the functions of credit information entry, filing, management, inquiry, use and release.

Article 7 The municipal property authorities, district and county property authorities, neighborhood offices, community residents' committees, property management associations and other relevant parties shall, according to their respective functions and duties, designate special persons to do a good job in the collection, identification, entry and daily management of credit information.

Chapter III Management, Collection and Identification of Credit Information

Article 8 Credit information management shall follow the following basic principles:

(a) the collection of credit information follows the principle of "who supervises and collects". The credit information of the realty service enterprise consists of the information declared by the enterprise's independent integrity and the information collected by the competent department of realty;

(2) The collection of credit information adheres to the principles of legality, objectivity, fairness, prudence, accuracy and timeliness;

(three) to safeguard the legitimate rights and interests of all parties in property management and service activities and to keep state secrets, business secrets and personal privacy.

Article 9 The credit information of a realty service enterprise mainly includes basic information, good information and bad information, and the specific content is set in the "smart property" system.

(1) Basic information

Basic information of the property service enterprise: mainly including the enterprise name, unified social credit code, registered address, office address, legal representative (the person in charge of the branch established in this city from other places, the same below), contact information, etc.

2. Basic information of the property project: mainly including project name, project address, construction period, building area, project type, project manager, property service contract signer and duration, service and charging standards, facilities and equipment used, etc.

(2) Good information

Property service enterprises operate in good faith and abide by the law in management and service activities, and obtain information such as commendation and awards, innovative achievements and good performance. Mainly includes:

1. Commendation by Party Committee, People's Congress, Government and CPPCC;

2. Commendation by the property management department;

3. Commendation by relevant administrative departments;

4. Commendation by the Property Management Association;

5. Carry out party building to lead property management;

6. Innovation, Excellence and advanced achievements in management services;

7. Publicity and praise of mainstream news media;

8. Other useful information identified.

(3) Bad information

Information such as violation of laws and regulations, breach of trust and breach of contract in the management and service activities of property service enterprises. Mainly includes:

1. The effective judgment or ruling made by the people's court or arbitration institution against the realty service enterprise due to management service fault;

2. The administrative punishment decision made by the property administrative department or the relevant administrative department on the property service enterprise due to the existence of illegal acts;

Article 10 The basic information and credit information declared by a realty service enterprise, as well as the credit information collected and recognized by the realty departments at all levels, shall be entered into the "smart property" system in accordance with regulations, and relevant documents, certificates, certificates, pictures, audio-visual materials and other supporting materials shall be attached.

Article 11 Collection and identification of basic information. The basic information of the realty service enterprise is filled in by the realty service enterprise through the "smart property" system, and uploaded after being audited by the district and county property authorities in the place of registration; The basic information of the property project is filled in by the property service enterprise through the "smart property" system and uploaded after being audited by the street office where the project is located.

Where the basic information changes, the realty service enterprise shall fill in the change information through the "smart property" system within 10 working days from the date of change, and upload it after being audited by the original certification department in accordance with the provisions of the preceding paragraph.

Article 12 Collection and determination of good information. Property service enterprises with good reporting information should fill in the information themselves through the "smart property" system within 30 days after the information is generated, and upload it according to the corresponding score after being identified by the district and county property authorities in the place of registration.

Thirteenth bad information collection and identification, in the following ways:

1. In the daily supervision and management, if the sub-district office rectifies the management service problems existing in the property service enterprises within a time limit, it shall be filled in by the sub-district office and uploaded according to the corresponding score after being confirmed by the local district and county property authorities.

2. In the daily supervision and management, if the district/county property department makes an administrative penalty, makes a written informed criticism, and makes rectification within a time limit, it shall be notified by the district/county property department and uploaded according to the corresponding score after being identified by the municipal property department.

3. 4. Article 14 The pre-publicity, objection, review and publication of bad information shall be conducted in accordance with the following procedures:

(1) Pre-publicity. After the bad information is uploaded, it will be pre-publicized to the relevant property service enterprises, and the publicity period will be 5 working days.

(2) objection. If the realty service enterprise has any objection to the bad information, it shall submit a written application for review to the original information reporting department within the pre-publicity period, and provide corresponding evidence. If it fails, it will be regarded as approval.

(3) review. The original information reporting department shall complete the review within 5 working days from the date of receiving the written application for review. If there is an error after verification, the review result will be uploaded to the appraisal department for confirmation, and it will be corrected or revoked within 5 days; If the verification is correct, the original determination result shall be maintained and the parties concerned shall be given a written reply.

(4) announcement. Bad information that has been pre-publicized without objection or verified without error will be officially released to the public through the "intellectual property" system.

(4) When the publication period of bad information expires, the information shall be removed and deleted from the credit portal website and the inquiry interface, and transferred to the enterprise electronic credit archive for preservation, and no publicity or inquiry shall be provided.

Article 16 Credit information involving business secrets, personal privacy and laws and regulations that should be kept confidential shall not be publicly released.

Seventeenth credit information is entered into the "smart property" system to form an electronic credit file, and no unit or individual may modify, add or delete it without authorization.

Chapter IV Credit Evaluation of Property Service Enterprises

Article 18 The full credit score of a realty service enterprise is 120. Among them, 20 points will be added for good information, and 100 will be deducted for bad information.

Article 19 The accumulated bonus points for good information of a realty service enterprise shall not exceed 20 points, and if it exceeds 20 points, it shall be calculated according to 20 points. It shall be implemented in accordance with the Scoring Standard for Good Information Collection of Property Service Enterprises (Table 1).

Article 20 The penalty for bad information of a realty service enterprise shall be calculated as 100, and deducted to 0. Specific in accordance with the "bad information collection of property service enterprises that scoring standards" (Table 2).

Article 23 The credit rating of a realty service enterprise is divided into five grades: AAA, AA, A, B and C according to the score. The specific criteria are as follows:

(five) refused to hand over the relevant information, property and assets.

Article 25 The credit rating of a realty service enterprise shall be assessed once a year, starting from June 65438+1 October1and ending on February 65438+February 3 1, and recalculated the following year.

City property administrative departments in the first quarter of each year to complete the last year's credit rating of property service enterprises, and finally determine the annual credit rating of property service enterprises through the "smart property" system, and sort according to the credit score; And recorded in the enterprise electronic credit file, announced to the public through the "intellectual property" system.

Chapter V Trustworthy Incentives and Dishonest Punishment

Twenty-eighth property service enterprises credit rating evaluation results, as an important reference for the implementation of classified supervision, property project bidding, property work evaluation and other work to be comprehensively used.

Article 29 A realty service enterprise with a credit rating of AAA may, under the same conditions, take the following measures within one year from the date of publication of its confidence rating:

(a) in government procurement, financial project arrangement, public resource allocation and other activities, under the same conditions, the following personnel are given priority;

(two) the property management departments, property management associations to organize the implementation of various recognition awards, Pingxian Pingyou and other activities plus points, and give priority to or recommend;

(three) to participate in the bidding of property projects to give 5 credit points;

(four) advocate the owners' congress to give priority to the selection of property service enterprises;

(5) Other incentive measures that can be taken according to law.

Thirtieth for the credit rating of AA-level property service enterprises, under the same conditions, the following measures can be taken within one year from the date of publication of the confidence level:

(a) property management departments, property management associations to organize the implementation of various recognition awards, Pingxian Pingyou and other activities to make appropriate points or consideration;

(two) to participate in the bidding of property projects to give 3 points of credit;

(3) Other incentive measures that can be taken according to law.

Thirty-first for a property service enterprise with a credit rating of A, under the same conditions, the following measures can be taken within one year from the date of publication of the confidence rating:

(a) normal participation in various market operations;

(two) the implementation of universal supervision, increase the frequency of inspection.

Article 32 A realty service enterprise with a credit rating of B may, under the same conditions, take the following measures within one year from the date of publication of its confidence rating:

(a) real estate departments at all levels as the focus of supervision and inspection;

Article 33 A realty service enterprise with a credit rating of C may, under the same conditions, take the following measures within one year from the date of publication of its confidence rating:

(a) the street office will inform the relevant owners, owners' committee (property management committee) and community residents' committee of the credit information to remind them of the credit risk, and may, in combination with the specific actual situation, put forward a written proposal to the owners' meeting to terminate the property service contract or not to renew it;
