Regulations of Shaanxi Province on Property Service Management (202 1 Revision)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other relevant laws and administrative regulations, combined with the actual situation of this province, in order to build a property service management system under the framework of community governance led by Party building, promote the construction of harmonious communities, standardize property service management activities and safeguard the legitimate rights and interests of owners and property service providers. Article 2 These Regulations shall apply to the property service management and its supervision and management activities within the administrative area of this province. Article 3 The term "property service management" as mentioned in these Regulations refers to the activities that the owners employ property service providers according to the property service contract to provide the owners with services such as maintenance, environmental sanitation and management and maintenance of relevant order in the property service area.

Property service providers include property service enterprises and other managers. Article 4 This province will bring property service management into the community governance system, and follow the working principles of party leadership, government leading, community condominium, owner autonomy, participation of all parties, consultation and construction, and scientific and technological support. Article 5 Give full play to the leading role of grass-roots party organizations. The grass-roots committees of street and township (town) parties shall set up grass-roots party organizations in communities, owners' committees, property management committees and property service providers to carry out party activities in accordance with the provisions of the Articles of Association of China. Strengthen the guidance and supervision of community party organizations, residents' committees and villagers' committees to owners' committees, property management committees and property service providers. Establish and improve the deliberation and coordination mechanism under the leadership of community party organizations, with the participation of residents' committees, villagers' committees, owners' committees, property management committees and property service providers, and take the lead in ensuring that property service management activities are carried out in an orderly manner according to law. Article 6 The competent department of housing and urban-rural construction of the provincial people's government shall be responsible for the supervision and management of property service management activities in the province and perform the following duties:

(a) to publicize and implement the laws, regulations and policies on property service management, formulate relevant policies on property service management in this province according to law and organize their implementation;

(two) to guide and supervise the city and county (city, district) housing and urban and rural construction departments to carry out property service management;

(three) responsible for the guidance and supervision of the province's maintenance fund management;

(4) Formulating temporary management regulations, management regulations, methods for the preparation and operation of the owners' meeting, voting rules for the first owners' meeting, rules for the procedure of the owners' meeting, methods for selecting candidates for the owners' committee, methods for electing the owners' committee, property service contracts and other demonstration texts and guiding standards for property services;

(five) to establish and improve the training system for members of the owners' committee, property management committee and property service personnel;

(six) to establish and improve the public service platform for property service management, and to establish and open the general owner decision-making network information system in the province in a timely manner;

(seven) to guide the property service industry associations to formulate and implement self-discipline norms;

(eight) to perform other duties of supervision and management in the management of property services.

The housing and urban-rural construction departments of cities and counties (cities, districts) with districts shall perform the following duties:

(a) to publicize and implement the laws, regulations, policies and systems related to the management of property services;

(two) supervision and management of property service providers and their employees within their respective jurisdictions;

(three) to guide and supervise the collection, management and use of maintenance funds within the jurisdiction;

(four) the organization within the jurisdiction of the owners' committee, property management committee members and property service personnel training;

(five) to guide the sub-district offices or township (town) people's governments to implement the related work of property service management;

(six) to supervise the construction unit to fulfill the responsibility of construction quality warranty, and to supervise and inspect the activities such as building decoration;

(seven) to guide and supervise the property service industry associations within their jurisdiction to carry out activities according to law;

(eight) to perform other duties of supervision and management in the management of property services. Seventh relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the supervision and management of the property service area:

(1) The development and reform department, together with the housing and urban-rural construction department and the market supervision and management department, is responsible for formulating the government-guided property service charging policy;

(two) the public security organs are responsible for the supervision and inspection of public security management and other related work;

(three) the civil affairs department is responsible for guiding the community residents' committees and villagers' committees to play a guiding and supervising role in the owners' assembly, owners' committees, property management committees and property service providers;

(four) the emergency management department is responsible for fire fighting and other emergency rescue work, and the fire rescue agency is responsible for the specific implementation;

(five) the health department is responsible for the prevention and response of public health emergencies;

(six) the natural resources department is responsible for the identification of buildings that violate the plan;

(seven) the ecological environment department is responsible for the supervision and inspection of environmental pollution;

(eight) the comprehensive law enforcement department of urban management is responsible for investigating and dealing with illegal construction, damage to green space, random graffiti, advertising and other acts that affect the city appearance and environment;

(nine) the market supervision and management department is responsible for the supervision and inspection of price publicity, illegal charges, special equipment safety, market measurement and other acts;

(ten) the civil air defense department is responsible for investigating the destruction and occupation of civil air defense engineering facilities, and supervising and inspecting the use of units to perform the maintenance and management responsibilities of civil air defense engineering facilities;

(eleven) water, electricity, gas, heating, communications and other public service supervision departments responsible for the relevant supervision and inspection work;

(twelve) other relevant departments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of the property service area.

The people's governments at or above the county level shall establish and improve the system of complaints and reports on illegal acts in the realty service area, publish a unified telephone number for complaints and reports, and deal with relevant illegal acts in the realty service area in a timely manner according to law.
