Provisions of Dalian Municipality on the Administration of Administrative Fees of Foreign-invested Enterprises

Article 1 In order to strengthen the management of administrative fees of foreign-invested enterprises and improve the investment environment, these Provisions are formulated in accordance with the relevant provisions of the state and the Measures for the Administration of Administrative Fees in Liaoning Province and the Measures for the Administration of Administrative Fees in Dalian. Article 2 The term "administrative fees" as mentioned in these Provisions refers to the fees charged by administrative organs, judicial organs and institutions authorized by laws and regulations from foreign-invested enterprises (including institutions of foreign economic organizations within the administrative area of Dalian) in accordance with national laws and regulations.

Institutional fees refer to the compensatory fees charged by institutions for providing special services for foreign-invested enterprises according to the management authority granted by laws and regulations. Article 3 Dalian Municipal Price Bureau and Finance Bureau are the competent departments of administrative fees within their respective administrative areas (hereinafter referred to as the competent departments of fees). Article 4 The establishment, standard formulation and adjustment of administrative fees of foreign-invested enterprises shall be implemented after the relevant municipal departments or county (city) and district people's governments and their subordinate functional departments submit an application to the competent department of fees for examination and approval according to the prescribed procedures. Article 5 Before charging foreign-invested enterprises, administrative charging departments and units (hereinafter referred to as charging units) shall apply to the price department for the License for Administrative Charging in Liaoning Province (hereinafter referred to as the license) with the approved charging items, charging standards and relevant materials, and charge according to the charging items and charging standards specified in the license. Article 6 The following provisions must be implemented when charging units:

(a) with the "license fee" charges;

(2) The toll collector wears the Toll Collector's Card;

(three) the use of administrative fees issued by the municipal finance department;

(four) after the end of each charging behavior, the charging personnel should fill in the charging contents in detail in the "Charge Register" issued by the price department to foreign-invested enterprises.

The toll collector's card is uniformly printed by the Municipal Price Bureau; The "Charge Register" is jointly printed by the Municipal Price Bureau, the Finance Bureau and the Supervision Bureau. Article 7 Foreign-invested enterprises must fulfill their obligation to pay fees if the charging activities of collecting units conform to the provisions of Article 6; Enterprises with foreign investment have the right to refuse to pay fees that do not meet the provisions of Article 6, and may report to the price, finance and supervision departments. Eighth charging departments should regularly supervise and inspect the charging activities of the collecting units, and conduct an annual inspection of administrative fees. The fee income of the collecting unit must be turned over to the financial budget or financial special account according to the regulations, and the management of two lines of revenue and expenditure shall be implemented. Article 9 If a charging unit commits one of the following acts, the charging department shall, according to the relevant provisions of laws, regulations and rules, give a warning according to the seriousness of the case, stop its charging behavior, withdraw its charging license and charging bills, and order it to return the illegally collected money to the foreign-invested enterprise. If it cannot be returned, it shall be confiscated and turned over to the treasury, and a fine of less than twice the illegal amount shall be imposed:

(a) no "license" fees;

(two) ultra vires approval or establishment of administrative fees;

(three) ultra vires approval or to formulate and adjust administrative fees;

(four) after the administrative fees are revoked or adjusted, they are still charged according to the original items and standards;

(five) to deposit, savings, mortgage, fund-raising, sponsorship and other forms of charges;

(6) Forging, altering, lending or transferring licenses, quasi-purchasing books of bills and charging bills;

(seven) refusing or obstructing the inspection or failing to truthfully reflect the situation and provide relevant information when accepting the inspection. Article 10 If a collection unit and its staff neglect their duties, abuse their powers or engage in malpractices for selfish ends in the performance of fee-collecting business activities, they shall be given administrative sanctions by their units or relevant authorities; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated by judicial organs according to law. Eleventh charging departments should regularly prepare the "Dalian foreign-invested enterprises administrative fees manual", as the basis for collecting units. During the preparation of the manual, the newly added or changed charging items and charging standards shall be released by the charging department through the news media. Twelfth these Provisions shall be interpreted by the Dalian Municipal Price Bureau and the Finance Bureau in accordance with their respective responsibilities. Thirteenth these Provisions shall come into force as of the date of promulgation.
