Regulations of Xuzhou Municipality on Elevator Safety Management

Chapter I General Provisions Article 1 In order to ensure the safe operation of elevators, prevent and reduce accidents, and ensure the safety of public life and property, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on Work Safety, the Regulations of the State Council Municipality on Safety Supervision of Special Equipment and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the manufacture, installation, renovation, maintenance, sale, use, daily maintenance, inspection and testing of elevators and their supervision and management activities within the administrative area of this Municipality. Article 3 The quality and technical supervision departments of cities, counties (cities), tongshan district and jiawang district (hereinafter referred to as quality supervision departments) shall be responsible for the safety supervision and management of elevators within their respective administrative areas.

Construction, real estate, safety supervision, price, public security and other administrative departments shall, according to their respective functions and duties, do a good job in elevator safety supervision and management. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over elevator safety management, urge and support the quality supervision departments to perform their duties of elevator safety management according to law, and establish a coordination mechanism for elevator accidents and major hidden dangers.

The quality supervision department shall, jointly with the departments of safety supervision and public security, formulate emergency plans for elevators, and report them to the people's government at the corresponding level for approval before implementation. Article 5 Units and inspection and testing institutions engaged in elevator manufacturing, installation, renovation, maintenance and routine maintenance shall obtain corresponding licenses according to law, and their employees shall obtain corresponding qualification certificates according to law. Article 6 Newly built elevators in schools, kindergartens, hospitals, stations, hotels, shopping malls, stadiums, exhibition halls, parks and other public places. Elevator safety operation monitoring system with the function of collecting operation parameters and images shall be equipped.

Newly installed elevators and existing elevators undergoing major maintenance or renovation in other buildings, such as houses, should be equipped with elevator safety operation monitoring system with operation parameter acquisition function, and it is encouraged to be equipped with elevator safety operation monitoring system with image acquisition function. Seventh to encourage elevator users, elevator daily maintenance units to participate in elevator safety liability insurance, improve the ability of accident compensation. Chapter II Manufacture, Installation, Modification, Maintenance and Sales of Elevators Article 8 Elevator manufacturing enterprises shall provide the following technical guidance and services to elevator users:

(1) elevator spare parts;

(two) technical services to ensure the normal operation of the elevator;

(three) emergency rescue and other professional skills training.

In case of frequent elevator failures, the elevator manufacturing unit shall make corresponding technical explanations in time and assist in troubleshooting. Article 9 The construction unit of a construction project shall perform the following duties for the procurement and installation of elevators:

(1) Entrust a qualified unit to design the building structure involving the use of elevators, so as to meet the special requirements for the installation and use of elevators such as embedded elevator shafts and guide rail brackets;

(two) to purchase elevators that meet the requirements of safety technical specifications, to ensure that the selection and configuration of elevators and the requirements of standby power supply are compatible with the requirements of building structure and use, and to ensure safety, first aid, fire fighting, barrier-free and other functions;

(3) specify the technical conditions for the selected elevator to be equipped with elevator safety operation monitoring system in the construction bidding documents. Article 10 The installation, modification and maintenance of elevators shall be carried out by the elevator manufacturing unit or the unit entrusted by it and agreed in the contract and obtained the corresponding license. Elevator manufacturing units are responsible for elevator quality and quality problems involving safe operation.

If the elevator is transformed by the unit that has obtained the corresponding license, the elevator transformation unit shall replace the nameplate of the elevator product, and indicate the name of the elevator transformation unit, the transformation date and the transformation qualification certificate number and other related information. The elevator transformation unit is responsible for the quality problems involved in the elevator quality and safe operation.

Elevator installation, renovation and maintenance business shall not be subcontracted or subcontracted. Eleventh elevator installation, renovation and maintenance of the construction unit shall inform the municipal quality supervision department in writing before the construction of the proposed elevator installation, renovation and maintenance.

The installation, renovation and major maintenance of elevators shall be supervised and inspected by elevator inspection and testing institutions in accordance with the requirements of safety technical specifications; Without supervision and inspection or unqualified supervision and inspection, it shall not be delivered for use. Twelfth elevator sales units shall establish a purchase inspection system and sales ledger, and report the catalogue of elevator products sold to the municipal quality supervision department for the record. Elevator sales units are responsible for the legality of the elevators they sell. Chapter III Use and Daily Maintenance of Elevators Article 13 The elevator users mentioned in these Regulations refer to units or individuals who actually exercise the right to operate elevators and perform the obligations of elevator management during the use of elevators.

Elevator use unit is not determined, the elevator shall not be put into use. Fourteenth elevator users are determined in accordance with the following provisions:

(a) the newly installed elevator has not been handed over, and the project construction unit is the elevator user;

(2) If the elevator owner entrusts a realty service enterprise or other manager to manage the elevator, the realty service enterprise or other manager is the elevator user;

(three) the elevator owner manages the elevator by himself, and if it belongs to a single owner, the elevator owner is the elevator user; If it belongs to multiple owners, the elevator users shall be determined through consultation.

If the elevator owner rents, lends or transfers the right to use the property by other means, it may be agreed that the property user is the elevator user.

If the elevator use unit is not clear, the neighborhood office and the Town People's Government where the elevator is located shall urge the elevator use unit to implement it within a time limit.
