Under what circumstances can I refuse to pay the property fee?

Owners who enjoy the property services provided by property management companies shall bear the obligation to pay property service fees. Even if the service provided by the property management company is defective, the owner may not refuse to pay the property fee on this ground, but may ask the property management company to reduce the property fee within the scope of the service defect. Generally speaking:

1. If the property management service is not in place, the owner has the right to ask for property fee reduction, but has no right to refuse to pay.

2. If the owners' committee fails to select a property management company according to legal procedures and signs a property contract without authorization, the owners have no right to refuse to pay the property management fee.

Assuming that the owners' meeting decides to approve the contract, the contract has legal effect; Even if the owners' meeting denies the validity of this contract, the owners should pay the corresponding property fees according to the factual services provided by the property management company.

3. The owner has not signed a property service contract with the property management company, and the owner still needs to pay the property fee.

This includes three meanings, namely:

(1) The owner himself did not sign, but the property management committee signed a property contract with the property management company;

The owners' committee and the property management enterprise selected by the owners' congress sign a property service contract, which is binding on all owners of the community. Therefore, property management companies do not need to sign separate contracts with each owner.

(2) The industry committee has not signed a contract with the property enterprise;

If the owners' committee has not signed a property service contract with the property company, but the owners have actually accepted the property service, the owners shall pay the corresponding fees to the property company according to the actual service price.

(3) Pre-property service contract

According to the law, the preliminary property service contract takes effect for the property buyer. In other words, although the owner (that is, the property buyer) has not signed a property service contract, he should also pay the corresponding property fee.

4. For the delivered house, the owner shall not refuse to pay the property fee on the grounds that it is uninhabited.

Property management regulations stipulate that if the construction unit and the owner have delivered the property in accordance with the agreed delivery method, the property service fee shall be borne by the owner. As for whether the owner actually lives, I won't ask.

Under the current legal framework, the prerequisite for the owner to pay the property service fee is whether he has accepted the services of the property management company, and if so, he should pay a fee commensurate with the service level. At the same time, the owner's behavior of taking over the house is directly presumed by the law to have accepted the service.

Therefore, the owner can refuse to pay the property service fee only in two cases:

1, the owner did not take over the house and did not handle the house handover procedures;

2. The property management company doesn't provide property services at all.
