Property right compensation for water inflow in underground storage

Legal analysis: the property entering the underground storage room shall be liable for compensation. "Property Management Regulations" stipulates that property management companies have certain security obligations for residential areas. According to China's current property management laws and regulations, property management charging standards and property management methods, the security scope of property management companies for the whole community is the security work of public facilities and equipment in the whole community. Although the Property Management Regulations stipulate that the property management company has certain security obligations, the security services agreed in the Property Management Service Contract only refer to the security of the property management company for maintaining public order and property use in the property management area. For the necessary normal preventive safety activities, this security obligation should be limited, necessary and relative, and should not be understood as an absolute and comprehensive security obligation. When a property company violates the general property security obligation and causes property losses in the management area, it shall determine the liability and specific compensation amount according to the degree of breach.

Forty-sixth of the property management area in violation of public security, environmental protection, property decoration and use of relevant laws and regulations, property management enterprises should be stopped, and timely report to the relevant administrative departments.

After receiving the report from the property management enterprise, the relevant administrative departments shall stop the illegal acts or deal with them according to law.

Forty-seventh property management companies should assist in the safety work within the property management area. When a safety accident occurs, the property management enterprise shall, while taking emergency measures to assist the rescue work, report to the relevant administrative departments in a timely manner.

Property management enterprises shall abide by the relevant provisions of the state when hiring security personnel. Security personnel shall perform their duties when maintaining public order in the property management area, and shall not infringe upon the legitimate rights and interests of citizens.
