Is it reasonable to ask renters to pay property fees?

Article 42 of People's Republic of China (PRC) Property Management Regulations clearly stipulates: "The owner shall pay the property service fee according to the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement. For properties that have been completed but have not been sold or handed over to buyers, the property service fee shall be paid by the construction unit. "

According to the above provisions, it is the owner's obligation to pay the property service fee to the property management unit according to the property service contract, and the owner shall not refuse to pay it on the grounds of not living in the rental community or not accepting the property service. If there is an agreement between the owner and the lessee on the payment of the property service fee, it shall be in accordance with the agreement, that is to say, it is agreed in the contract who will pay it.

If the lessor and the lessee do not stipulate in the lease contract that the lessee shall pay the property fee to the property company, then the lessee's obligation is limited to the contents of the house lease contract, and there is no obligation to pay the property service fee, which shall be borne by you.

If the lessor and the lessee agree that the lessee shall pay the property service fee, the lessor has the right to require the lessee to bear the property service fee agreed in the contract. It is worth noting that it can be seen from the regulations that if the lessee fails to fulfill the corresponding obligations when it is agreed that the lessee will pay the property fee, the lessor still needs to bear joint and several liability for the payment of the fee.

As a lessee, he has the business of paying rent by performing the house lease contract, and the owner has the obligation to perform the property management contract and pay the property service fee. These two kinds of obligations have different sources and obligors, so they can't be confused. It is suggested that when signing a house lease contract in the future, the lessee should agree in writing who will pay the property service fee and other related matters.
