Regulations of Jiangxi Province on Property Management
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area. Article 3 Property management shall follow the principles of openness, fairness, honesty and credit, market competition and standardized service. Fourth provincial people's government housing and urban and rural construction departments responsible for the supervision and management of property management activities in the province.
City, county (District) people's government real estate departments responsible for the supervision and management of property management activities within their respective administrative areas, perform the following duties:
(a) to provide business guidance to the owners' congress and the owners' committee;
(two) to supervise and manage the qualification and service quality of the realty service enterprise, supervise and manage the bidding of realty service, sign the realty service contract, and supervise and manage the fees;
(three) supervision and management of special maintenance funds and residential property quality warranty funds deposited and used;
(4) Accepting and handling complaints against property service enterprises and employees;
(five) the supervision and management of property use and maintenance;
(6) Other supervisory and administrative duties.
Municipal, urban management, price, industry and commerce, city appearance and environmental sanitation, urban and rural planning, public security, meteorology, civil air defense, quality and technical supervision, environmental protection, civil affairs and other departments and water supply, power supply, gas supply and other enterprises shall, according to their respective functions and duties, do a good job in the management and service of property management according to law. Article 5 Sub-district offices and Township People's governments shall establish property management systems in their respective jurisdictions, specifically guide and supervise the owners in their respective jurisdictions to set up owners' congresses and elect owners' committees according to law, supervise the owners' congresses and owners' committees to perform their duties according to law, mediate property management disputes according to law, and coordinate the relationship between property management and community management.
Community residents' committees and villagers' committees shall assist neighborhood offices and township people's governments in carrying out relevant work of property management according to law.
The realty service enterprise shall cooperate with the neighborhood offices and Township People's governments to carry out the related work of realty management. Refuses to cooperate, the street offices and Township People's governments shall submit them to the real estate departments of the people's governments of cities and counties (districts) for handling according to law. Article 6 Property management industry associations shall strengthen industry self-discipline management according to law, standardize industry behaviors, maintain market order and fair competition, promote property service enterprises and employees to operate according to law and provide honest services, and promote the healthy development of the property management industry. Seventh facilities are incomplete, the environmental quality is poor, and there is no property management in the original residential area. The local city and county (District) people's government shall take measures to carry out rectification and gradually implement property management. Chapter II Owners, Owners' Congress and Owners' Committee Article 8 The owner of a house is the owner.
Owners enjoy the following rights in property management activities:
(a) in accordance with the provisions of the realty service contract, accept the services provided by the realty service enterprise;
(two) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property management;
(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;
(four) to participate in the owners' meeting and exercise the right to vote;
(five) to elect members of the owners' committee and enjoy the right to be elected;
(six) to supervise the work of the owners' committee;
(seven) to supervise the realty service enterprise to perform the realty service contract;
(eight) the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and related sites;
(nine) to supervise the management and use of special maintenance funds for * * * parts of the property and * * * facilities and equipment;
(ten) other rights stipulated by laws and regulations.
The spouse, parents or adult children of the owner who lives in the property management area shall enjoy the owner's rights stipulated in the preceding paragraph with the written authorization of the owner himself. Ninth owners in the property management activities, fulfill the following obligations:
(a) abide by the management regulations and the rules of procedure of the owners' congress;
(two) abide by the rules and regulations of the use of * * * parts and facilities, the maintenance of public order and environmental sanitation in the property management area;
(three) to implement the decisions of the owners' congress and the decisions of the owners' committee authorized by the owners' congress;
(four) to comply with the provisions of the state and the province on housing decoration;
(five) in accordance with the relevant provisions of the state to pay special maintenance funds;
(six) to pay the property service fee on time;
(seven) other obligations stipulated by laws and regulations.
The owner shall not fail to perform his obligations on the grounds of giving up his rights.
