Legal basis: Article 4 of the Regulations on Funeral Management: Cremation should be carried out in areas with dense population, less cultivated land and convenient transportation; Where cremation conditions are not met, burial is allowed. Areas where cremation and burial are allowed shall be designated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, and the civil affairs departments of the people's governments at the corresponding levels shall report to the civil affairs departments of the State Council for the record.

There are funeral expenses for burial. In areas where cremation is prescribed by the state, the insured must be cremated after death, otherwise funeral expenses and pensions will not be paid. If cremation is not carried out in areas where cremation is not carried out, you can only get it if you go to the Civil Affairs Bureau to issue a certificate that cremation is not carried out.

Article 27 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Personal Injury Compensation Cases clearly stipulates the calculation standard of funeral expenses, that is, "the funeral expenses are calculated in six months according to the average monthly salary standard of employees in the last year where the sued court is located."
