Interim Measures of Hefei Municipality on Property Management of Residential Quarters

Chapter I General Provisions Article 1 In order to strengthen the property management of residential areas in this Municipality, clarify the rights and obligations of owners and property management enterprises, ensure the rational use of residential properties, maintain public order in residential areas, and create a good living environment, these measures are formulated in accordance with relevant national laws and regulations and the Interim Measures for the Property Management of Urban Residential Areas in Anhui Province, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the property management of residential areas within the urban planning area (including development zones) of this Municipality. Article 3 The term "property" as mentioned in these Measures refers to all kinds of houses in residential areas and their supporting public facilities and public venues.

The term "residential property management" as mentioned in these Measures refers to the maintenance, repair and renewal of houses and their equipment, public facilities, greening, sanitation, transportation, public security and environmental appearance management projects in residential areas.

The term "owners" as mentioned in these Measures refers to the owners of residential houses and non-residential houses in residential areas. Article 4 Property management in residential quarters shall be based on the principle of combining owner autonomy with professional services of property management enterprises. Fifth Hefei City Real Estate Management Bureau is the competent department of residential property management in this Municipality. Hefei Property Management Office (hereinafter referred to as the Municipal Property Office) is responsible for the property management of residential areas in this Municipality.

City appearance, planning, public security, industry and commerce, price, landscape, municipal and other departments and neighborhood offices where residential areas are located shall, according to their respective responsibilities, coordinate in the property management of residential areas in this Municipality. Chapter II Self-management of Owners Article 6 When the occupancy rate of residential quarters reaches more than 50% after delivery, the Municipal Property Office shall organize the first owners' meeting or owners' congress with the development and construction units to elect the owners' committee.

The old residential area is organized by the neighborhood office where the residential area is located in conjunction with the municipal property office, and the first owners' meeting or owners' congress is held to elect the owners' committee.

The owners' committee shall perform its duties on behalf of all owners of residential areas in accordance with laws, regulations, rules, owners' conventions and the articles of association of the owners' committee. A residential area set up an owners' committee. Article 7 The owners' congress is composed of all owners. In residential areas with a large number of owners, the owners' representatives can be elected in proportion to form the owners' meeting.

Only more than half of the owners or owners' representatives have the right to vote can the owners' congress or owners' congress be held.

The right to vote for the owner of the house is one household, one vote; One vote for the construction area of non-residential houses 100㎡, and one vote for each certificate below 100㎡. Article 8 The owners' congress or the owners' congress shall exercise the following functions and powers:

(a) to decide or approve major issues involving the interests of the owners;

(two) to approve or amend the owners' convention;

(three) to elect or recall members of the owners' committee;

(four) to approve the articles of association of the owners' committee;

(five) to listen to and consider the work report of the owners' committee;

(six) to supervise the work of the owners' committee;

(seven) to change or cancel the inappropriate decision of the owners' committee.

The decision of the owners' congress or owners' congress must be passed by more than half of the voting rights held by the owners or owners' representatives present at the meeting. Article 9 The owners' committee consists of a chairman, vice-chairmen and members, the number of whom is odd, but not less than 5. The term of office of the owners' committee is 3 years, and members may be re-elected at the expiration of the term. Article 10 The owners' committee shall, within 0/5 days from the date of election, register with the Municipal Property Office with the following documents:

(1) An application for registration of the establishment of the owners' committee;

(two) the list of members of the owners' committee;

(3) Articles of association of the owners' committee.

City real estate office shall complete the registration within 15 days from the date of accepting the application for registration; Not in conformity with the provisions of these measures shall not be registered. Eleventh owners' committee is responsible for the owners' congress or the owners' congress and reports its work, and exercises the following functions and powers:

(a) to convene and preside over the owners' congress or the owners' congress;

(two) to formulate the articles of association of the owners' committee;

(three) to consider the special expenses of public facilities in residential areas and the maintenance expenses of public parts of houses;

(4) Selecting and appointing a property management enterprise through public bidding, and signing a contract with it to entrust the management of residential property;

(five) to consider the annual plan for residential property management and the maintenance plan for major projects formulated by the property management enterprise;

(six) to supervise the property management, maintenance and repair of residential areas by property management enterprises;

(seven) to examine and approve the specific provisions of residential property management.

The matters specified in items (2), (3) and (5) of the preceding paragraph must be approved by the owners' congress or the owners' congress. Article 12 The meeting of the owners' committee shall be convened by the chairman of the owners' committee according to the needs of the work, and the meeting notice and relevant materials shall be delivered to all members 7 days before the meeting.

The meeting of the owners' committee shall be held only when more than half of all members are present. The owners' committee made a decision to implement the principle that the minority is subordinate to the majority. Thirteenth owners' convention is binding on all owners and users of residential areas. The owners' convention includes the following contents:

(a) the name, address, area and number of residential areas;

(two) the status of public places and public facilities;

(three) the convening procedure of the owners' congress or the owners' congress and the way to decide on major issues in the residential area;

(four) the rights and interests of the owners in the residential area to use their houses, public places and public facilities;

(five) the owners' right to participate in the property management of residential areas;

(six) the owners' right to supervise the owners' committee and the property management enterprise;

(seven) payment of residential property maintenance, maintenance costs and management services;

(eight) the code of conduct that the owner should abide by;

(nine) the responsibility for violating the owners' convention;

(10) Other related matters.

The model text of the owners' convention shall be uniformly distributed by the Municipal Property Office. The owners' congress or the owners' congress may make amendments and supplements according to the actual situation of this residential area, and report to the municipal property office for the record.
