Article 1 In order to strengthen the safety management of residential housing lease, protect the personal and property safety of citizens, legal persons and other organizations, and maintain public safety and social order, these Measures are formulated in accordance with the Regulations on the Safety Management of Housing Use in Zhejiang Province, the Regulations on the Residence Registration of Floating Population in Zhejiang Province, the Measures for the Administration of Residential Housing Lease Registration in Zhejiang Province and relevant laws, regulations and rules, and in light of the actual situation of this Municipality. Article 2 These Measures shall apply to the safety management activities of residential house leasing within the administrative area of this Municipality. Article 3 The term "residential house" as mentioned in these Measures refers to the house that is used or used for living after being rented. Excluding hotel rooms and public rental housing. Article 4 The people's governments of cities and counties (cities, districts), the Administrative Committee of Wenzhou Economic and Technological Development Zone and the Administrative Committee of Oujiangkou Industrial Cluster Zone shall strengthen the organization, leadership and comprehensive coordination of the safety management of residential housing rental within their respective administrative areas (administrative regions), and urge all relevant departments (institutions) to perform their duties according to law. Fifth public security organs are responsible for the lease registration of residential houses, public security management and residence registration management of floating population.

The fire department is responsible for the implementation of the statutory duties of residential housing fire protection, strengthen supervision and management, and guide and urge relevant subjects to perform their duties of fire protection.

The competent department of housing and urban and rural construction is responsible for the construction safety of residential houses and the supervision and management of real estate brokers.

Natural resources and planning, comprehensive administrative law enforcement, emergency management, market supervision and management departments shall, in accordance with their respective responsibilities, do a good job in the safety management of residential housing leasing. Article 6 Township People's governments (street offices) shall integrate the human resources of the agencies dispatched by the relevant competent departments, and implement normalized and grid management on the rental safety of residential houses; Lead the organization to carry out the investigation and rectification of the hidden dangers of residential housing rental; According to the entrustment of the public security organs, do a good job in the registration of rental houses and floating population; Conduct fire safety inspection of residential buildings according to law. Fire rescue agencies may entrust township people's governments (street offices) that meet the statutory conditions to organize and impose administrative penalties on violations of fire safety management according to law. Article 7 Residents' committees, villagers' committees, owners' committees, real estate brokerage agencies, property service enterprises and relevant employers shall cooperate with relevant competent departments and township people's governments (street offices) to do a good job in the safety management of residential housing rental, promptly dissuade illegal acts, and report to the township people's governments (street offices) or relevant competent departments in a timely manner if dissuasion fails.

Residents' committees and villagers' committees may formulate conventions on the lease management of residential houses or incorporate relevant contents into community conventions and village rules and regulations; With the consent of the owners' congress, the owners' committee may incorporate the relevant provisions on the management of residential housing lease into the community management statute and implement self-management of residential housing lease. Eighth residential housing rental, should take a room originally designed for residential use as the minimum rental unit, and shall not be rented after being built separately. The per capita use area of each room is not less than 4 square meters, and the actual number of people living in each room is not more than 2, except for the legal relationship with the lessee such as maintenance, support and maintenance obligations. Ninth residential houses originally designed for kitchen, bathroom, balcony, storage room, basement and other non-residential space, shall not be rented for human habitation. Tenth residential buildings and ancillary facilities shall meet the requirements of building safety. The lessor shall fulfill the obligation of house maintenance and ensure the safety of residential houses and indoor facilities; Unless otherwise agreed by both parties to the lease. Eleventh residential buildings should meet the requirements of fire safety. Both parties to the lease shall bear the responsibility for fire safety according to law. Twelfth residential housing lease shall comply with the provisions of public security management, and both parties shall bear the responsibility for public security according to law. Article 13 Where more than 10 beds are rented out in the same suite or building, the lessor shall, in accordance with the requirements of relevant fire control technical standards, establish a fire control safety management system, determine specialized management personnel, and implement fire control safety management responsibilities.

If the lessor is unable to fulfill the relevant obligations stipulated in the preceding paragraph, it shall entrust a real estate brokerage institution and other units or individuals to manage it. Real estate brokerage institutions and other units or individuals shall perform the obligations of the lessor within the scope entrusted by them and bear corresponding legal responsibilities. Fourteenth residential housing in any of the following circumstances, shall not be leased or sublet:

(a) illegal construction;

(2) changing the use of the house without authorization;

(four) other circumstances stipulated by laws, regulations and rules. Fifteenth residential housing lessors and sublessors shall perform the following obligations:

(a) to ensure that residential houses have basic living functions and meet the requirements of building and fire safety;

(two) comply with the provisions of fire safety management;

(three) shall not be leased to the personnel who can not provide legal and valid identification;

(four) for residential housing lease registration; If the lessee is a floating population, it shall also submit the information of the lessee in accordance with the Regulations on Residence Registration of Floating Population in Zhejiang Province, and inform the lessee to voluntarily declare residence registration;

(five) it is found that the lessee and the residential user are suspected of engaging in illegal acts by using the residential house, which shall be stopped and reported to the relevant competent authorities in a timely manner;

(six) to cooperate with and assist the relevant administrative organs, institutions and organizations to implement administrative management according to law;

(seven) other obligations stipulated by laws, regulations and rules.
