Article 2 These Measures shall apply to the use and management of residential building maintenance funds collected within the administrative area of this Municipality in accordance with the Notice of the Municipal Real Estate Bureau, the Municipal Housing Reform Office and the Municipal Finance Bureau on the Collection of Maintenance Funds for Residential Building Facilities and Equipment.

Article 3 The Municipal Bureau of Land Resources and Housing Management (hereinafter referred to as the Municipal Bureau of Land Resources and Housing Management) shall be responsible for guiding and coordinating the use and management of public maintenance funds.

The Municipal Finance Bureau is responsible for supervising the use and management of public maintenance funds.

Maintenance fund management is managed according to the principle of "special account storage, earmarking, building accounts one by one, and accounting to households".

Article 4 The maintenance fund shall be used exclusively for the maintenance project of residential building facilities and equipment after the warranty period expires.

Article 5 After the establishment of the Property Management Committee (hereinafter referred to as the CMC), the CMC will open an account in a bank designated by the Municipal Bureau of Land and Housing Management on behalf of all owners in the property management area. When applying for opening an account, the CMC shall fill in the Application Form for Opening an Account for the Maintenance Fund of the Property Management Committee (see Annex II) and submit the following materials.

1, account opening application;

2, the approval document of the establishment of the CMC;

3. List of family property of the property owner;

4. The personal seal of the director of the management committee and the seal of the management committee;

5. Entrustment contract for property management services.

When the CMC entrusts a property management enterprise to handle account opening procedures, it shall also submit a written power of attorney.

2. The property management company can only carry out maintenance works after being appraised by an intermediary agency.

3. After the maintenance project is completed, it will be checked and accepted by the intermediary agency, and the qualified ones will be issued with certificates, and the unqualified ones will be required to be reworked.

4. The property management enterprise shall apply to the escrow unit for withdrawal of the maintenance fund with the maintenance project settlement invoice and the certificate issued by the intermediary agency.

Article 7 After the establishment of the CMC, the property management enterprise shall, at the beginning of each year, formulate plans and budgets for the maintenance of public facilities in houses and residential areas (including overhaul, medium repair and renovation), and report them to the CMC for approval before implementation. After the completion of the maintenance project, the property management enterprise shall go through the maintenance fund withdrawal procedures at the bank with the maintenance fund withdrawal certificate approved by the CMC; The CMC shall allocate the maintenance fund specifically according to the final accounts of completion, and include it in the owner's details.

In any of the following circumstances, except with the consent of the CMC, it shall also be reported to the county Guotufangguan Bureau for the record:

2. Withdraw the maintenance fund twice within one year.

In any of the following circumstances, the CMC shall convene a general meeting of owners to make a resolution on expenditure and report it to the County Bureau of Land and Housing Management for the record:

3. Withdrawal of maintenance funds within one year accounts for more than 30% of the total maintenance funds.

2. The maintenance cost of the facilities and equipment used in the * * * part of the residential building shall be shared by all property owners in the residential building in proportion to the construction area.

3. If the house has more than two unit doors, the maintenance cost of facilities and equipment exclusive to all owners of a unit door shall be shared by all owners of the unit door according to the proportion of the construction area owned; In residential buildings, the maintenance costs of facilities and equipment used by all property owners in a first-floor residential building are shared by all property owners in a first-floor residential building according to the proportion of their own construction area.

Development enterprises should bear the maintenance costs according to the above principles according to the proportion of unsold housing area to the total housing area.

Article 9 If the building maintenance fund is less than 00% of the first collection amount after use, the management committee shall propose to renew it. Article 10 When the CMC is merged, divided or revoked, it shall go to the escrow unit to handle the merger, division or revocation procedures of the CMC account with the approval certificate of the county Guotufangguan Bureau and the list of property owners.

When the property owner changes, the property right of the maintenance fund shall be changed at the same time. The original owner or the owner who changed the property right shall go through the registration of change with the transfer contract and the identity certificates of both parties, and the management committee shall go through the formalities of renaming the owner's detailed household in the escrow unit. The maintenance fund shall be settled by the transferor and the transferee according to the book balance of the subsidiary house.

If the property owner loses his original residence due to demolition and other reasons, he can go through the formalities of canceling the account. After the certificate is issued by the CMC, it shall be extracted from the escrow unit according to the balance of the maintenance fund subsidiary ledger. Among them, if it belongs to the after-sales maintenance fund of public housing, it shall be returned according to the cumulative proportion paid by units and individuals.

Eleventh escrow units should establish a maintenance fund inquiry system in the property area, and accept the owners' inquiries about the details of their maintenance funds.

The CMC shall announce the balance of the maintenance fund at the end of each year, including:

(1) The use and distribution of maintenance funds, including the contents of maintenance projects, total maintenance costs and costs shared by all property owners;

(2) Maintenance fund general ledger balance;

(3) Balance of maintenance fund subsidiary ledger.

Article 12 When the maintenance fund is idle, with the approval of the owners' meeting, the property management committee may purchase the national debt or other scope stipulated by laws and regulations, and it is strictly prohibited to use it for other purposes.
