Decision of the Standing Committee of Nanchong Municipal People's Congress on Amending the Regulations of Nanchong City on Urban Landscaping and other three laws and regulations

First, the "Nanchong City Landscaping Ordinance" is amended as:

(1) Paragraph 2 of Article 5 is amended as: "The departments of development and reform, ecological environment, natural resources and planning, housing and urban and rural construction, transportation, water affairs, forestry and urban management shall, according to their respective functions and duties, do a good job in the supervision and management of urban landscaping according to law."

(2) Paragraph 1 of Article 9 is amended as: "The people's governments of cities and counties (cities, districts) shall organize the administrative departments of urban and rural planning and urban landscaping to prepare special greening plans such as urban green space system planning, natural mountain protection planning, urban greenway system planning, urban park green space planning, urban road greening planning, etc."

(3) Delete the first paragraph of Article 16: "The design, construction and supervision of urban greening projects and greening projects affiliated to construction projects shall be undertaken by units with corresponding qualifications."

(4) Article 34 is amended as: "Whoever, in violation of the provisions of Article 24 of these regulations, transplants or cuts down urban trees without authorization shall be ordered to make corrections, compensate for the losses, and may also be fined less than twice the amount of compensation."

(5) Item 5 of Article 35 is amended as: "Whoever violates the provisions of Item 11 and damages the greening facilities may be fined from 2,000 yuan to 10,000 yuan."

(six) the first paragraph of Article 38 is amended as: "The urban green space mentioned in these Regulations includes park green space, attached green space, square land, protective green space and regional green space, and their meanings are respectively:

"(a) open to the public in the city, with recreation as the main function, with certain recreational facilities and service facilities, with comprehensive functions such as improving ecology, beautifying landscape, popular science education and emergency avoidance.

"(two) the attached green space refers to the green space attached to all kinds of urban construction land (except square land).

"(three) the square land refers to the planning green space with the functions of recreation, commemoration, assembly and hedging in urban public places.

"(4) Protective green space refers to green space with ecological, sanitary, isolation and safety protection functions, including urban sanitary isolation belt, road protective green space, urban high-pressure corridor green belt, windbreak forest and urban group isolation belt.

"(5) Regional green space refers to all kinds of green spaces that play an important role in ensuring the integrity of urban and rural ecological and landscape patterns, residents' leisure and recreation, facilities safety and protection and isolation, including scenic and recreational green spaces, ecological conservation green spaces, regional facilities protection green spaces and production green spaces. "Two, the" Nanchong city environmental sanitation management regulations "are as follows:

(1) Paragraph 5 of Article 5 is amended as: "The functional departments of development and reform, public security, ecological environment, housing and urban and rural construction, natural resources and planning, transportation, market supervision and management shall, according to their respective responsibilities, do a good job in the supervision and management of urban environmental sanitation."

(2) Article 12 is amended as: "The system of responsible areas and responsible persons shall be implemented in the management of urban environmental sanitation, and the responsible areas and responsible persons shall be determined in accordance with the following provisions:

"(a) the implementation of property management in residential areas, responsible for the property service enterprises; For residential areas without property management, the owners shall be responsible;

"(two) rivers, lakes, reservoirs (ponds), artificial channels, hydraulic structures, by the use, operation or management units responsible;

"(three) scenic spots, tourist attractions, highways, railways, airports, stations, ports, docks and their facilities, by the management unit;

"(four) parks, wetlands, green spaces, shopping malls, hospitals, hotels, hotels, cultural and entertainment venues, sports venues, farmers' markets, shops and other places, by the property owners or business management units responsible;

"(five) organs, organizations, schools, enterprises and institutions within the scope of the red line planning area, by the unit responsible for;

"(six) the construction site is the responsibility of the construction unit, and the land to be built is the responsibility of the owner;

"(seven) the public areas in economic development zones, science and technology parks, bonded zones and independent industrial and mining zones shall be in charge of the park management units;

"(eight) temporary occupation of roads or public places, by the occupier.

"The environmental sanitation of urban roads, bridges, underpasses, public squares, public waters and other public areas shall be the responsibility of the environmental sanitation management institution or the subdistrict office and the town (township) people's government.

"The area of responsibility and responsible person is not clear or controversial, determined by the county (city, district) urban management administrative department; Cross-county (city, district) shall be determined by the municipal administrative department of urban management. "

(3) Article 21 is amended as: "The local people's governments at or above the county level shall promote the classification of domestic waste as a whole, establish a domestic waste treatment system of classified delivery, classified collection, classified transportation and classified disposal, and realize the effective coverage of the domestic waste classification system."

(4) Article 46 is amended as: "In violation of the provisions of Article 17 of these regulations, vehicles carrying loose or fluid substances driving on urban roads have failed to adopt closed protective facilities, and if they leak or spill, they shall be ordered to clean up and correct; On behalf of the removal, the expenses shall be borne by the violator; Impose a fine of 2,000 yuan to 20,000 yuan; Refuses to correct, vehicles are not allowed to drive on the road. If the vehicle tires drive into urban roads with mud and cause pollution, they shall be ordered to make corrections and be fined 100 yuan but not more than 500 yuan. "

(5) Article 49 is amended as: "Whoever, in violation of the provisions of Article 20 of these regulations, engages in all kinds of engineering construction and outdoor operations, fails to stop the operation within the specified scope or fails to remove the generated garbage in time, thus affecting environmental sanitation, shall be ordered to make corrections within a time limit and be fined not less than 20,000 yuan but not more than 100,000 yuan; Those who refuse to make corrections shall be ordered to stop work for rectification. "

(6) Article 51 is amended as: "Whoever, in violation of the provisions of Article 24 of these regulations, fails to transport domestic garbage according to the prescribed time and route shall be fined between 200 yuan and 1,000 yuan; Discarding, scattering and dumping domestic garbage at will along the way shall be ordered to clear and correct; On behalf of the removal, the expenses shall be borne by the violator; Impose a fine of 2,000 yuan to 20,000 yuan; If you refuse to correct it, the vehicle may not drive on the road. "
