Rule number one In order to standardize the charging behavior of urban property management services in our province, promote the healthy and orderly development of the property management service industry, and safeguard the national interests and the legitimate rights and interests of property management units, owners and users. According to the relevant provisions of the state, combined with the actual situation in our province, the Interim Provisions on the Charge of Urban Property Management Services in Sichuan Province are formulated, hereinafter referred to as the Provisions.

Rule number two These Provisions shall apply to the charge management of socialized and specialized public services provided by various properties in urban residential areas and non-residential areas in our province. Public houses and institutions, enterprises and institutions directly managed by the government housing management department, and houses that implement property management after one-time housing reform, can be implemented with reference to these provisions.

The term "property management service fee" as mentioned in these Provisions refers to the fees charged by property management companies (units) registered by the administrative department for industry and commerce and qualified by the provincial construction administrative department, entrusted by property owners and users, for daily maintenance, repair and rectification of buildings and their equipment, public facilities, greening, sanitation, roads, public security and environmental appearance, and for providing other services related to residents' lives and public services.

Property management services are divided into three categories: public services, agency services and special services, namely: public services refer to the daily management services provided by property management units for the maintenance and repair of public facilities and equipment, greening management, sanitation and cleaning, and public security management; Agency service refers to the agency service of collecting water, gas, electricity, communication, cable TV and so on; Special services refer to other services and public services related to residents' lives that provide hundreds of millions of public services.

Rule three. The price department is the competent authority of urban property management service charges, and will supervise and guide the charges of property management units in conjunction with the property management administrative departments in accordance with the hierarchical management authority.

Article 4? Property management service charges implemented by property management units shall follow the principles of rationality, openness, fairness, high-quality pricing and high-quality and good price, and price monopoly and profiteering are strictly prohibited.

Article 5? Property management service charges take the form of government pricing, government-guided pricing and operator pricing according to the nature and characteristics of the services provided, and the property management company (unit) shall, jointly with the owners' committee, formulate charging standards and report them to the price department at the same level for approval or filing.

Article 6? Principles for approving the charging standards for property management services:

First, the public service charges for property management in ordinary residential areas (ordinary commercial houses, ordinary apartments, directly managed public houses, self-managed houses and houses after one-time housing reform) are subject to government pricing; Ordinary residential charges are subject to government pricing; Ordinary residential fees exceed 1 yuan/square meter/month, and shall be submitted to the Provincial Price Bureau for approval.

Two, high-grade apartments, villas, complex buildings, office buildings, commercial buildings, property management service charges to implement government guidance.

Three, to provide special service charges for car owners (unless otherwise stipulated by the price department) by the operator and car owners negotiated pricing.

Four, the price departments at all levels in the approval of property management services, according to the nature, characteristics and management depth of property management projects, classification for approval. The specific charging standard is approved in combination with the Guiding Standard for Classification and Classification of Urban Property Management Services in Sichuan Province (Annex I).

Article 7? The cost content of property management services.

The property management fees approved by the government and guided by the government are collectively referred to as property management service fees, and their cost components are as follows:

1, wages and welfare expenses of property management and service personnel; The establishment of management and service personnel depends on the actual needs of their management scale, management area, service items, scope and posts. The salary standard and welfare benefits of employees are determined according to the local economic development level and the relevant provisions of the labor department.

2. Daily operation, maintenance and maintenance expenses of public facilities: the expenses required to ensure the normal operation and maintenance of water supply, power supply, gas, elevators, central air conditioning, power generation and distribution systems, fire protection systems, sewage systems, monitoring systems and road toll public parts shall be verified according to actual expenditures.

3. Greening management fee: according to the greening management area, investment and maintenance management fee, approved according to the actual expenditure.

4. Cleaning and sanitation expenses: The cleaning and regular cleaning of public areas shall be approved according to actual expenses.

5. Security expenses: the expenses of clothing, equipment and equipment for security personnel shall be approved according to the relevant regulations of the public security department.

6. Office expenses: the office expenses of the property management unit shall be approved according to the actual expenditure.

7. Depreciation expense of fixed assets of the property management unit: according to the fixed assets of the property management unit, it shall be verified in accordance with the relevant provisions of the state.

8. Taxes and fees: charged according to national statutory taxes and fees.

9. Profit: The cost profit shall be calculated at 3-5% of the sum of the above 1-7 expenses, and shall be formulated by the government; The cost profit is calculated at 5- 10% of the sum of the above 1-7 expenses. Property management service fee is calculated according to the construction area per square meter per month. Households that have purchased commercial housing and have not yet moved in after obtaining property rights will be charged half of the property management service fee if they entrust their property management, and no fees will be charged if they are not entrusted.

10, which was rated as an excellent property management community of the Ministry and the province, the property management service fee can be appropriately floated on the basis of the prescribed standards within the validity period (two years).

If a property management enterprise is entrusted by water supply, gas supply, power supply, communication, optical fiber network and other enterprises to collect the fees for water, gas, electricity, communication, cable TV, etc., it shall charge the entrusted enterprise an agency service fee at a rate not exceeding 3% of the price, and shall not charge the owner or user separately.

Article 8? Property management service charges shall be subject to operating charges and price management, and a license for operating charges shall be issued.

Article 9? The property management unit shall sign an entrusted management contract with the owners' committee; Establish and improve the financial management system, so that the charging items, charging standards and revenue and expenditure are open; Announce the income and expenditure of property management service fees to the owners every six months, submit the income and expenditure of the current year to the price department at the end of the year, and accept the supervision of the price, property management department and the owners.

Article 10? The following acts in violation of these provisions shall be punished by the price supervision and inspection organs at all levels in accordance with the relevant provisions of the state.

First,? Unauthorized pricing, unauthorized increase in fees;

Second,? Set up charging items without authorization, and collect fees at random;

Third,? Not according to the provisions of the approval and application for a license fee, not clearly marked;

Four, provide hunger services that do not match the quality and price, only charge no service or reduce the service content, and reduce the quality of service;

Five, other acts in violation of these provisions.

Article 11? The Provincial Price Bureau and the Provincial Construction Committee shall be responsible for the interpretation of these Provisions.

Article 12? These Provisions shall come into force as of the date of promulgation. ?
