Who is responsible for the leakage of floor heating and who will repair it?

Legal analysis: the maintenance of floor heating leakage can be divided into three situations:

1. The floor heating is installed with the consent of the developer. If the owner has not changed it privately, the developer shall be responsible for the floor heating during the warranty period. Upstairs, you can find a property company for maintenance, and downstairs, you can find a claim from the developer.

2. If the floor heating leaks due to the owner's decoration or laying of water pipes, the upstairs residents should find out the cause of the leakage and repair it in time, and should also be responsible for the losses caused by their misconduct to the downstairs residents.

3. If the equipment in the house leaks due to aging, the upstairs and downstairs owners and the property management company project will bear part of the maintenance responsibility.

Legal basis: Article 296 of the Civil Law of People's Republic of China (PRC) stipulates that if a realty holder uses an adjacent realty to carry out activities such as water supply and drainage, transportation and pipeline laying, he shall try his best to avoid causing damage to the adjacent realty holder.
