Regulations of Xiamen Municipality on Fire Control

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and in light of the actual situation of this Municipality in order to strengthen fire control work, prevent and reduce fires, and ensure personal and property safety. Article 2 The fire control work shall implement the policy of putting prevention first and combining prevention with elimination, promote the socialization of fire control work and implement the responsibility system for fire control safety. Article 3 The people's governments at all levels shall lead the fire control work in a unified way, incorporate the development of fire control into the national economic and social development plan, and ensure that the construction of fire control infrastructure and the equipment level of fire control teams meet the needs of national economic and social development.

Urban fire protection planning must be incorporated into the overall urban planning. Fourth city public security organs in charge of the city's fire control work. Public security fire control institutions established by public security organs at or above the district level are specifically responsible for fire control management and supervision.

The fire control work of airplanes, trains, ships and forests shall be the responsibility of the competent departments, with the assistance of public security fire control institutions. Article 6 People's governments at all levels or relevant departments and units shall commend and reward units or individuals that have made outstanding contributions or made remarkable achievements in fire control work. Chapter II Fire Control Responsibility Article 8 Public security fire control institutions at all levels shall perform the following duties according to their functions and powers:

(a) the implementation of fire laws and regulations, to carry out fire publicity and education, inspection and guidance of fire control work;

(two) to participate in the preparation and implementation of urban fire planning, and supervise the implementation of urban fire planning;

(three) responsible for the fire design review and fire supervision in the construction process of new construction, expansion, reconstruction, building interior decoration and other construction projects, and carry out the completion acceptance of the fire protection part of the project;

(four) to organize fire inspection, supervise and order the rectification of fire hazards;

(five) to organize and direct fire fighting, be responsible for the investigation and identification of fire causes, and make fire statistics;

(six) to participate in social assistance;

(seven) other duties as prescribed by laws and regulations. Article 9 The legal representative or principal person in charge of an organ, organization, enterprise or institution is the first person in charge of fire safety of the unit, who is responsible for the fire safety of the unit and performs the following duties:

(a) to formulate and implement the fire safety responsibility system, fire prevention plan and safety measures such as the evacuation of personnel in case of fire;

(two) according to the provisions of the state equipped with fire fighting equipment, the implementation of regular maintenance, maintenance measures, to ensure that it is in good condition and effective, improve fire prevention conditions, to carry out fire safety inspection, timely eliminate fire hazards;

(three) to manage the full-time fire brigade, mass voluntary fire brigade or firemen of this unit;

(four) to carry out fire safety education and fire training for employees;

(five) organize fire self-help, protect the scene of the fire, and assist in the investigation of the cause of the fire. (1) Damaging obsolete facilities or changing the use of fire control facilities without authorization;

(two) in the building (room) aisle with fire or storage of flammable and explosive materials;

(three) in violation of the provisions of the electrical wiring and installation of electrical equipment;

(four) unauthorized dumping of liquefied petroleum gas residue or damage to gas pipelines;

(five) unauthorized use of open flames in fire dangerous places.

The guardian shall conduct fire prevention education for the ward. Chapter III Fire Prevention Article 13 State organs, public organizations, enterprises and institutions and neighborhood (village) committees shall establish and improve the fire prevention management system, provide firefighters in accordance with regulations, and conduct regular fire prevention inspections to eliminate fire hazards. Fourteenth streets, towns and enterprises and institutions in accordance with the provisions of laws and regulations and the need to establish full-time or voluntary fire brigade, to assist in the local area, the unit of fire prevention and fighting.

Full-time or volunteer fire brigades shall receive professional guidance and training from public security fire control institutions and carry out professional training. In case of major fire, you must obey the unified mobilization and command of public security fire control institutions. Article 15 Before underwriting, an insurance institution shall make necessary investigations on the fire safety of the subject matter insured.

Insurance institutions can check the fire safety status of the subject matter insured according to the insurance contract, put forward written suggestions to the insured and the insured in time to eliminate fire hazards, and send a copy to the public security fire control institutions.

In the event of a fire accident, the insured insurance institution shall cooperate with the public security fire control institution to conduct a fire investigation.

The relevant business personnel and insurance agents of insurance institutions shall receive fire protection knowledge training. Sixteenth buildings are used by more than two units, the property owner and the user shall establish a fire safety organization or entrust a property management agency to coordinate the fire safety work.
