Article 41 of the Property Management Law stipulates that:
The owner shall pay the property service fee in accordance with the provisions of the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement. Property that has been completed but has not been sold or handed over to the property buyer shall be paid by the construction unit.
As long as the property buyers and developers handle the handover procedures and get the keys, they will become the owners, and they will start to pay property fees. Although the owner does not live, the maintenance and cleaning expenses in the public area where the house is located still exist, and the charging standard of property fees is approved by the price department. The property fees of all houses should be charged according to the standard, which should not be higher than the standard approved by the price department. Property management fee is necessary for the maintenance of the whole community and the normal and continuous operation of the community, not the operating income of the property company. If one or several owners don't pay the property management fee, it will inevitably lead to the property management fee making ends meet, and the property company can't maintain the maintenance and management of the community due to lack of funds, which will damage the interests of all owners.
Circumstances that can refuse to pay the property fee:
(1) The property management enterprise provides services by itself in the property management service contract. Without the consent of the owners' committee or owners, the owners or users may not pay the fees.
(2) The owners may refuse to pay more than the government-guided price for the property service charges.
(3) If the property management enterprise fails to perform the obligations stipulated in the property service contract, the owner may not pay or pay less the corresponding property service fee.
(4) Property management companies raise property service charges without authorization, and some owners who raise them without authorization may not pay them.
⑤ If the property service contract stipulates that the service fee should be paid first, and the property management enterprise fails to provide the corresponding service, the owner may not pay the corresponding service fee.
