Chapter I General Provisions Article 1 In order to strengthen the prevention and control of environmental noise pollution, protect and improve the living environment and ecological environment, safeguard human health, and promote the coordinated development of economy, society and environment, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Noise Pollution, the Regulations of Sichuan Province on Environmental Protection and other relevant laws and regulations, combined with the actual situation of Panzhihua City. Article 2 These Regulations shall apply to the prevention and control of environmental noise pollution within the administrative area of this Municipality. Article 3 The prevention and control of environmental noise pollution shall follow the principles of overall planning, prevention first, source control and comprehensive treatment. Article 4 The people's governments of cities and counties (districts) shall be responsible for the acoustic environment quality within their respective administrative areas. Article 5 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of environmental noise pollution within their respective administrative areas.

Development and reform, public security, natural resources and planning, housing and urban and rural construction, transportation, culture, radio and television and tourism, urban management, administrative law enforcement, market supervision and management departments shall, according to their respective functions and duties, supervise and manage the prevention and control of environmental noise pollution.

Township people's governments and sub-district offices shall, under the guidance of the relevant administrative departments of the county (District) people's governments, do a good job in the prevention and control of environmental noise pollution in their respective areas. Sixth residents' committees and villagers' committees shall assist the people's government in the prevention and control of environmental noise pollution.

Encourage the owners to stipulate the rights and obligations of environmental noise management in the property management area by formulating management regulations and other forms, and the owners shall abide by them.

The realty service enterprise shall discourage acts that violate the laws, regulations and management conventions on the prevention and control of environmental noise pollution in the realty service area. If dissuasion is ineffective, report to the supervision and management department concerned with the prevention and control of environmental noise pollution in a timely manner. Seventh any unit or individual has the right to report and complain about environmental noise pollution. The competent department of ecological environment, public security and other departments responsible for the supervision and management of environmental noise pollution prevention and control shall promptly handle and reply after receiving reports and complaints. Chapter II Supervision and Management of Prevention and Control of Environmental Noise Pollution Article 8 The competent department of ecological environment shall, in accordance with the national acoustic environment quality standards and in combination with the overall urban planning of the region, fully solicit the opinions of citizens, rationally divide the acoustic environment functional zones according to law, and implement them after being approved and promulgated by the people's government at the same level; If the regional function changes, the acoustic environment function area should be adjusted in time. Article 9 The competent department of ecological environment shall, jointly with relevant departments, gradually set up automatic noise monitoring and display facilities in areas where noise-sensitive buildings are concentrated and nearby squares, parks, traffic arteries and business districts, organize regional acoustic environmental quality monitoring, and regularly publish monitoring data and acoustic environmental quality reports to the public. Display facilities shall indicate the maximum limit of regional environmental noise. Article 10 The reconstruction and expansion of newly-built noise-sensitive structures and noise-sensitive structures shall conform to the national code for design of building sound insulation and use noise-reducing products and materials; The external environmental noise insulation quality of noise-sensitive structures and its supporting public facilities such as water supply, elevators, ventilation and underground garages shall meet the standards set by the state. Chapter III Prevention and Control of Industrial Noise Pollution Article 12 An industrial enterprise that discharges noise into the surrounding environment shall adopt measures such as rationally arranging fixed equipment, using low-noise equipment, adjusting operation time and improving production technology. And in accordance with the provisions, effective noise pollution prevention and control facilities such as sound absorption, noise elimination, sound insulation, vibration isolation and vibration reduction shall be configured to ensure that the emission meets the national environmental noise emission standards at the boundary of industrial enterprises. Article 13 An industrial enterprise shall, three months before using the fixed equipment that causes environmental noise pollution, report to the local competent department of ecology and environment the type and quantity of the equipment that causes noise pollution, the noise value discharged under normal circumstances, the use time and the noise pollution prevention measures taken, and provide technical data for the prevention and control of noise pollution. Article 14 In areas where noise-sensitive buildings are concentrated, it is forbidden to build, rebuild or expand industrial enterprises that produce environmental noise pollution, and it is forbidden to engage in activities that produce environmental noise pollution such as metal processing, stone processing, wood processing and automobile repair. Chapter IV Prevention and Control of Noise Pollution in Construction Article 15 Construction operations shall not exceed the environmental noise emission standards at the boundary of construction sites. Sixteenth it is forbidden to carry out night construction work that produces environmental noise pollution in areas where environmental noise-sensitive buildings are concentrated, except for emergency repair, emergency rescue and night construction work that is really necessary due to production process requirements or other special circumstances.

If construction must be carried out at night due to production process requirements or other special circumstances, the construction unit shall apply to the competent department of ecological environment where the project is located five working days before the construction operation. The competent department of ecological environment shall issue a night construction certificate within three working days from the date of accepting the application.

After obtaining the night construction certificate issued by the competent department of ecological environment, the construction unit shall announce the night operation project and the estimated construction time to the nearby residents before construction.
