Interim Provisions of Ningbo Municipality on the Administration of the Use of Civil Air Defense Works (revised 20 10)

Article 1 In order to strengthen the management of the use of civil air defense projects and improve the overall protection capability of the city, these Provisions are formulated in accordance with the People's Republic of China (PRC) Civil Air Defense Law and the Measures for the Implementation of the People's Republic of China (PRC) Civil Air Defense Law in Zhejiang Province, combined with the actual situation of this Municipality. Article 2 The term "civil air defense works" as mentioned in these Provisions refers to underground protective buildings built separately to ensure civil air defense command, medical aid and shelter of personnel and materials in wartime, and basements built in combination with ground buildings that can be used for air defense in wartime. Article 3 These Provisions shall apply to the use, maintenance and management of civil air defense works within the administrative area of this Municipality. Article 4 The competent department of civil air defense (hereinafter referred to as the competent department of civil air defense) shall be responsible for supervising and inspecting the use, maintenance and management of civil air defense projects within its administrative area.

Construction, planning, finance, development and reform, industry and commerce, fire protection and other relevant departments shall, according to their respective responsibilities, coordinate the implementation of these Provisions. Article 5 Civil air defense projects are an integral part of national defense projects, which are arranged for use by the government in wartime and managed by project management units in peacetime. Article 6 The maintenance and management of civil air defense works shall be carried out according to the following division of labor:

(a) command, communication, main roads and other civil air defense projects are maintained and undertaken by the competent department of civil air defense;

(two) the civil air defense projects of organs, social organizations, enterprises and institutions shall be maintained and undertaken by the units to which the projects belong;

(three) the civil air defense works built in residential quarters and other real estate development projects according to law shall be managed by the property service enterprises entrusted by the owners' committee or the construction unit. Seventh civil air defense engineering maintenance and management units must fulfill the following obligations:

(a) to determine the full-time or part-time civil air defense engineering maintenance and management personnel;

(two) establish and improve the system, regular maintenance, to ensure that the project is in good condition and the import and export, ventilation;

(three) the establishment of maintenance management records, improve the engineering and technical files, and shall not disclose or lose engineering data, materials and documents. ;

(four) the implementation of the responsibility system for fire prevention and flood control;

(five) to stop acts that endanger the safety of civil air defense projects and facilities or reduce the protection efficiency of civil air defense projects; Those who do not listen to dissuasion should report to the competent civil air defense department in time. Article 8 The maintenance and management of civil air defense projects shall conform to the technical regulations for the maintenance and management of civil air defense projects and meet the following standards:

(a) the engineering structure is in good condition;

(2) The interior of the project is clean without leakage, the air is fresh, and the drinking water meets the hygiene requirements;

(3) The protective airtight equipment and facilities have good performance;

(four) the wind, water, electricity, heating and communication systems are working normally;

(5) Metal and wooden parts are free from corrosion and damage;

(six) the import and export roads are smooth, and the orifice camouflage facilities are in good condition;

(seven) fire prevention and flood control facilities are safe and reliable. Ninth construction units should set up standardized signs of civil air defense projects, indicating the completion time, area, management and use of units. Relevant information relating to the nature, coordinates and protective capability of civil air defense works shall be kept confidential. Tenth construction units shall, within 30 days after the completion and acceptance of civil air defense projects, handle the transfer procedures with the project management unit and report to the competent civil air defense department for the record. If the project management unit is changed, it shall be reported to the competent civil air defense department for the record within 30 days from the date of handling the change procedures. Eleventh under the condition of not affecting the efficiency of civil air defense, according to the principle of paid use and unified management, encourage the development and utilization of civil air defense projects in peacetime.

Units or individuals who use civil air defense projects developed and constructed by competent departments for civil air defense in peacetime shall report to the competent departments for civil air defense at or above the county level for approval, obtain a certificate for the peacetime use of civil air defense projects, and go through relevant procedures such as fire control, industry and commerce in accordance with regulations.

Units or individuals who usually use other civil air defense projects shall go through the registration formalities with the local civil air defense authorities. Twelfth units or individuals that apply for the "Civil Air Defense Works Peacetime Use Certificate" shall submit the following materials:

(a) the civil air defense works in peacetime use registration form;

(two) to approve the special acceptance of civil air defense projects;

(three) the civil air defense project transfer book;

(four) the letter of intent for the lease of civil air defense projects;

(five) the use plan or decoration plan of the civil air defense project;

(6) Other necessary materials. Article 13 The competent department of civil air defense shall conduct an audit within 7 working days after collecting the above materials, and issue civil air defense works peacetime use certificates that meet the requirements, and refuse to issue civil air defense works peacetime use certificates that do not meet the requirements, and explain the reasons. Fourteenth the use of units, the use of functions, the use of scale changes, units or individuals must go through the formalities of change to the original approval of the use of civil air defense and other competent departments. Fifteenth in addition to the civil air defense works usually used for parking in residential areas, other units or individuals using civil air defense works shall sign a written contract with the civil air defense works management unit to clarify the scope of use, use, duration, rights and obligations. , and report to the local competent civil air defense department for the record within 15 days from the effective date of the contract.
