Measures of Anqing Municipality on Classified Management of Municipal Domestic Waste

Chapter I General Provisions Article 1 In order to standardize the classified management of municipal solid waste and promote the construction of ecological civilization, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of City Appearance and Environmental Sanitation and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the classification of domestic waste and related management activities in the urban built-up areas of Anqing City. Article 3 The classified management of domestic waste shall follow the principles of government leading, territorial management, market operation, participation of the whole people and gradual progress. Article 4 The municipal and district people's governments (including park management agencies, the same below) shall be responsible for organizing the implementation of classified management of domestic waste, establishing a joint meeting system, and coordinating and solving major problems in classified management. Establish a capital investment guarantee mechanism and a supervision and inspection notification system, and incorporate the classified management of domestic waste into the annual target performance appraisal scope. Township (town) people's governments and sub-district offices are responsible for the daily management of domestic waste classification within their respective jurisdictions, and guide and urge village (neighborhood) committees to do a good job in the classification, delivery and collection of domestic waste. Article 5 The urban management department is the competent department in charge of the classification of municipal solid waste, and is responsible for preparing the special plan for the classification of municipal solid waste, optimizing the guidelines and systems for the classification of municipal solid waste, and providing guidance and training, supervision and assessment, administrative law enforcement, etc. Used for the classification of municipal solid waste. The financial department is responsible for the overall integration of funds, ensuring the funds for the classification of domestic waste, and incorporating them into the financial budget.

The natural resources and planning department is responsible for the site selection and construction land guarantee of domestic waste classification treatment facilities.

The ecological environment department is responsible for the supervision and management of the prevention and control of environmental pollution caused by domestic garbage, guiding and urging the resource utilization and harmless treatment of hazardous wastes.

Housing and urban-rural construction departments are responsible for guiding and urging property service enterprises to implement domestic waste classification, and incorporate domestic waste classification into property management assessment.

The commercial department is responsible for guiding the development of renewable resources recycling industry and establishing a recycling system coordinated with domestic waste recycling.

Development and reform, education and sports, public security, transportation, agriculture and rural areas, cultural tourism, health, market supervision and management, government administration and other departments shall, according to their respective responsibilities, do a good job in the classified management of domestic waste.

Residents' committees, villagers' committees and owners' committees shall assist in the publicity and guidance of domestic waste classification and cooperate with them. Article 6 The municipal and district people's governments and relevant departments may encourage social capital to participate in the classified delivery, collection, transportation, disposal and recycling of domestic waste through investment subsidies, franchising and purchasing services. Article 7 The construction of facilities for the classified delivery and collection of domestic garbage shall conform to national standards or industrial standards. New construction, renovation, expansion of residential quarters, public buildings, public places and other construction projects, should be supporting the construction of domestic waste classified delivery and collection facilities, and synchronous design, synchronous construction, synchronous acceptance, synchronous delivery with the main project, and shall not arbitrarily change the nature of use.

If the existing facilities for putting and collecting domestic garbage do not meet the requirements of the classification standards, the District People's Government shall organize property rights units or business units to carry out construction and transformation.

No unit or individual may interfere with or hinder the construction, renovation and operation of domestic waste sorting facilities. Article 8 The municipal, district and township (town) people's governments, sub-district offices and relevant functional departments may set up domestic waste sorting supervisors within their respective jurisdictions by purchasing services, recruiting volunteers, entrusting residents' representatives or community workers, and property service personnel to undertake supervision and guidance. Article 9 The municipal and district people's governments shall establish an incentive and guidance mechanism for the classification of domestic waste, and commend and reward the units and individuals that have made outstanding achievements. Chapter II Classified Delivery Article 10 Domestic garbage is divided into recyclables, kitchen garbage, harmful waste and other garbage.

The municipal urban management department shall formulate guidelines for the classification of domestic waste, clarify the classification standards, labels, delivery rules and other contents, and announce them to the public. Article 11 Domestic garbage shall be classified at fixed points in time-sharing and centralized delivery. Units, families and individuals that produce domestic waste shall fulfill the obligation of domestic waste classification and bear the responsibility of domestic waste producers according to law. Any unit or individual shall, in accordance with the law, put domestic garbage at the designated place, and abide by the following provisions:

(1) Drain the kitchen waste and put it into a special collection container;

(two) hazardous waste should be placed in hazardous waste collection containers alone or handed over to hazardous waste transportation and disposal enterprises that meet the requirements;

(3) Large pieces of waste furniture, electrical and electronic products, etc. If it is large in size and needs to be dismantled and reprocessed, it should make an appointment for the recycling service unit of renewable resources to collect it at home, or put it separately at the designated garbage drop point.

Encourage the use of domestic waste classification system and intelligent recycling platform to improve the accuracy of domestic waste classification. Twelfth domestic waste classified into management responsibility system. In areas where property management is implemented, the property service enterprise is the responsible person, and in areas where property management is not implemented, the responsible person shall be determined in accordance with the following provisions:

(a) the office and management area of organs, organizations, military units, schools, hospitals and other enterprises and institutions shall be managed by the person in charge of the unit;

(two) stations, ports, cultural and sports venues, parks, squares, tourist attractions and other public places, the management unit is the person in charge of management;

(three) hotels, entertainment venues, shopping malls, shops, bazaars, exhibitions and other places of business, business management units for the management responsibility;

(four) the construction site of the construction project shall be managed by the construction unit; Land for construction projects that have not yet started shall be managed by the construction unit;

(five) urban roads, pedestrian bridges, underground passages and other facilities, the management unit is the person in charge of management;

(six) public waters, rivers and lakes and their management scope, and the management unit is the person in charge of management. If the person in charge of management cannot be determined in accordance with the provisions of the preceding paragraph or the person in charge of management is controversial, the person in charge of management shall be determined by the local township (town) people's government and sub-district office, and if it is still uncertain, it shall be determined by the local township (town) people's government and sub-district office in accordance with the principle of classified management, and report to the joint meeting of municipal and district domestic waste classification.
