Completion data shall be compiled by the construction unit and then submitted to the construction unit. The Interim Measures for Settlement of Construction Project Price issued by the Ministry of Finance and the Ministry of Construction stipulates that after the completion of the project, both parties shall settle the project completion according to the agreed contract price, contract price adjustment content and claim requirements. Project completion settlement is divided into unit project completion settlement, single project completion settlement and construction project completion summary calculation.

The contractor shall complete the preparation of project completion settlement within the time limit stipulated in the contract. If it is not completed within the prescribed time limit and no justifiable reason is put forward for the extension, it is at your own risk.

2) Audit period of project completion settlement

After the completion of a single project, the contractor shall submit the completion settlement report and complete settlement data to the employer at the same time as the completion acceptance report, and the employer shall conduct inspection (audit) and put forward audit opinions according to the following time limit: (1) 5 million yuan, 20 days from the date of receiving the completion settlement report and complete settlement data.

(2) 5 million yuan to 20 million yuan, 30 days from the date of receiving the completion settlement report and complete completion settlement information; (3) 20-50 million yuan, 45 days from the date of receiving the completion settlement report and complete completion settlement data; (4) More than 50 million yuan, 60 days from the date of receiving the completion settlement report and complete completion settlement data.

The construction project completion summary shall be summarized within 15d after the final single project completion settlement audit is confirmed, and the audit shall be completed within 30 days after being sent to the employer.

3) Settlement of project completion price

The project completion settlement shall be subject to the contract period. If the actual construction period is earlier or later than the contract period, both the employer and the contractor shall implement the rewards and punishments measures stipulated in the contract.

4) Settlement of project price for out-of-contract claims and sporadic projects

If the employer requires the contractor to complete sporadic projects outside the contract, the contractor shall submit a construction visa to the employer within 7 days after accepting the employer's request, including the quantity and unit price of labor, the quantity and unit price of mechanical machine-teams, the materials and amount used, etc. If the employer fails to sign the visa, the contractor shall bear the responsibility.

5) Handling of matters not handled within the prescribed time limit.

After receiving the completion settlement report and complete settlement data, the Employer fails to give comments on the settlement report and data within the time limit stipulated in the Interim Measures for the Settlement of Construction Project Price or agreed in the contract, which shall be deemed as approval.

If the contractor fails to provide complete project completion settlement data within the specified time, and fails to provide or give a clear answer within 14d after being urged by the employer, the employer shall have the right to review according to the existing data, and the responsibility shall be borne by the contractor.

According to the confirmed completion settlement report, the contractor applies to the employer for payment of the project completion settlement. The employer shall pay the settlement money within 15d after receiving the application, and shall be liable for breach of contract if it fails to pay within the time limit.

The contractor may require the employer to pay the settlement price. If a deferred payment agreement is reached, the employer shall pay the interest on the overdue project payment according to the bank loan interest rate for the same period. If no deferred payment agreement is reached, the contractor may negotiate with the employer to discount the project, or apply to the people's court for auction of the project according to law, and the project discount or auction price shall give priority to compensate the contractor.
