Article 1 In order to promote the healthy development of the housing rental market in Xuzhou City and standardize the housing rental behavior, these Measures are formulated in accordance with the provisions of the People's Republic of China (PRC) Urban Real Estate Management Law and the Xuzhou Urban Real Estate Transaction Management Regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the management of house leasing within the administrative area of this Municipality.

These Measures shall not apply to the short-term house lease that has obtained the special trade license of the hotel industry.

If there are other provisions on the lease of public housing, such provisions shall prevail. Article 3 The municipal, county (city) and district people's governments shall strengthen the overall coordination, organization and leadership of housing lease management, and bring housing lease into the comprehensive management of the community. Fourth city housing rental departments responsible for the formulation of housing rental policies, the construction of housing rental information platform, the release of housing rental prices and data monitoring, guidance, supervision and assessment of the city's housing rental market management; County (city) and district housing rental departments are responsible for the supervision and management of housing rental within their respective administrative areas. The housing rental management institution affiliated to the housing rental department specifically undertakes the daily work of housing rental management.

The public security organ is responsible for the public security management of the rental house. Other relevant departments shall, in accordance with their respective responsibilities, do a good job in housing lease management.

The town people's government and sub-district offices shall assist in the management of housing lease, and urge the parties involved in housing lease to handle the registration of housing lease in accordance with the provisions of these Measures. Fifth neighborhood (village) committees and property service enterprises shall assist the competent department of housing leasing to do a good job in the management of rental houses within the property management area, and provide relevant information about rental houses. Article 6 The people's governments of cities, counties (cities) and districts shall include the funds needed for housing lease management into the fiscal budget at the corresponding level. Seventh housing rental, real estate registration, market supervision, taxation, price, public security, education, housing provident fund and other administrative departments and institutions shall establish a housing rental information sharing mechanism. Eighth housing rental information platform shall regularly publish information on housing rental brokerage institutions, brokers, housing rental enterprises, the relationship between supply and demand; Provide online contract signing, filing, provident fund withdrawal, housing subsidy application and other services related to housing leasing for lease parties.

The competent department of housing leasing shall verify the authenticity of the house. Article 9 The lessor of a house shall be the owner of the house and other obligees as stipulated by laws and regulations.

The lessor of the house shall not lease the house to a natural person who cannot provide identification, a legal person or other organization who cannot provide business license or other approval documents. Tenth houses under any of the following circumstances shall not be rented:

(a) illegal construction;

(two) was identified as a dangerous house;

(three) does not meet the mandatory standards for safety, disaster prevention and other engineering construction;

(four) in violation of the provisions to change the nature of the use of housing;

(5) Other circumstances in which it is prohibited to rent out according to laws and regulations. Eleventh rental housing should be based on the original design of the room as the smallest rental unit, the per capita rental area of not less than five square meters. Twelfth housing lease parties shall conclude a lease contract according to law, and the lease contract shall have the following main terms:

(a) the name and contact information of the parties;

(3) The purpose and duration of the lease;

(4) Rent and its delivery method;

(5) responsibility for house repair;

(6) Sublease agreement;

(seven) the rights and obligations of both parties, the liability for breach of contract;

(eight) other terms that the parties think need to be agreed.

The competent department of housing lease shall provide a model contract text to the parties to the housing lease. Thirteenth housing lessors shall, from the date of the conclusion of the lease contract, register at the government service window or the housing rental information platform set up by the people's government and the housing rental department. If a lease contract is signed through a house leasing brokerage institution, the house leasing brokerage institution shall handle the registration and filing on its behalf.

If the lessor or leasing brokerage institution fails to register for the record, the lessee may register for the record.

If the contents of the lease contract change, the lessor or brokerage institution shall go through the formalities of alteration, extension or cancellation of the lease registration within fifteen days. Fourteenth housing lease registration shall submit the following materials:

(1) Housing lease contract;

(two) the identity certificate of the parties to the house lease;

(three) all of the housing or other legal ownership certificate;

(4) Other materials as prescribed by laws and regulations.

If you rent another person's house, you should also submit the certificate of the owner's authorization to rent or agree to sublease.

The application materials shall be true, lawful and valid, and no false materials shall be provided. Housing rental information platform to verify the housing, you can not provide the first paragraph (three) of the provisions of the materials. Fifteenth housing rental departments shall, within three working days, review the housing rental registration materials, meet the conditions, register them, and issue a certificate of housing rental registration; Those who do not meet the requirements for registration and filing shall be informed of the contents that need to be corrected at one time, and shall be registered and filed after correction.
