Article 2 These Regulations shall apply to the safety management of urban houses within the administrative area of this Municipality. The safety management of houses belonging to cultural relics shall be implemented in accordance with relevant laws and regulations.

The term "housing safety management" as mentioned in these Regulations refers to the safety management of old houses and the management of termite control in houses. Third city, county (city), jiawang district real estate management department (hereinafter referred to as the real estate management department) is the competent department of housing safety management.

City real estate management department can entrust the city real estate supervision institutions to implement housing safety management.

Planning, construction, urban management, industry and commerce, public security and fire control, safety production supervision and other departments and sub-district offices shall, in accordance with their respective responsibilities, coordinate the implementation of these regulations. Fourth real estate management departments should establish and improve the housing safety management system, strengthen the daily management of housing safety and the supervision and inspection of the prevention and control of dangerous houses. Article 5 The construction unit shall formulate a temporary management statute before the sale of the house, and make an agreement on matters such as the house safety obligations that the purchaser should perform according to law in the use and decoration of the house, and make it clear and clear to the purchaser.

The realty service enterprise shall inform the owner or user of the house of the prohibited acts and precautions related to the safety of the house in the decoration.

Property service enterprises or residents' committees shall discourage unauthorized demolition and reconstruction of houses in this area, and report to the local real estate management department in a timely manner. Article 6 The construction unit shall inform the buyer and user in writing of the main structure, load-bearing structure, seismic structure, fire prevention structure, design load and design service life of the house.

When the house is transferred or leased, the transferor or lessor shall inform the transferee or lessee in writing of the main structure, load-bearing structure, seismic structure, fire prevention structure, design load, design service life and structural transformation of the house. Seventh housing owners and users should use the house according to the design purpose of the house, and shall not change the structure of the house without authorization; When the house is found to be in danger, measures should be taken in time to eliminate the danger.

Citizens, legal persons and other organizations that have an interest in housing safety have the right to require housing owners, users or other responsible persons to take safety protection measures to eliminate dangers. Eighth it is forbidden to build a solid wall that exceeds the design load on the overhead floor.

It is forbidden to build basements under built houses. Ninth the following acts that affect the safety of houses shall be approved by the real estate management department, and shall be approved by other departments according to law, from its provisions:

Design units and housing safety appraisal institutions shall be responsible for the scheme issued by them. Eleventh real estate management departments should make a decision of approval or disapproval within ten working days from the date of receiving the application materials, and inform the applicant in writing. Article 12 The applicant shall carry out the construction according to the approved scheme.

The real estate management department shall supervise the licensing matters, stop the potential safety hazards in time, and order it to make corrections and take remedial measures. Thirteenth housing safety appraisal work, by the housing safety appraisal institutions established according to law, the conclusion of housing safety appraisal is the basis for the appraisal of housing safety. Fourteenth houses in any of the following circumstances, should be entrusted to the housing safety appraisal institutions for housing safety appraisal:

(four) no construction procedures or no construction permit put into use, and its safety has not yet been determined;

(five) it is planned to install large billboards on the completed houses and add new facilities and equipment such as water tanks and iron towers;

(six) other safety appraisal should be carried out according to law.

The appraisal of the first and fourth items in the preceding paragraph shall be entrusted to the owner or user of the house; The appraisal of the second item is entrusted by the real estate management department; The identification of the third item is entrusted by the responsible person; If the responsible person cannot be determined, it shall be entrusted by the owner or user of the house; The appraisal of item 5 shall be entrusted by the construction unit or executor.

Schools, shopping malls, restaurants, theaters, stadiums and other public buildings need to continue to use beyond the designed service life, and their owners or users shall entrust an appraisal at least once every three years.
