Can tenants not pay water and electricity bills when water and electricity are cut off?

Legal analysis: Under normal circumstances, the property has no right to cut off water and electricity. According to the "Regulations on Property Management in People's Republic of China (PRC)", if the owners fail to pay the property service fee within the time limit, the owners' committee shall urge them to pay it within a time limit; If it fails to pay within the time limit, the realty service enterprise may bring a lawsuit to the people's court. However, within the scope of property management, water supply, power supply, gas supply, heating, communication, cable TV and other units shall charge relevant fees to the end users. Therefore, both parties to the hydropower contract are suppliers and de facto owners. When the owner fails to pay the property fee, he can only urge to pay it through legal means, and has no right to stop water and power.

Legal basis: Article 165 of the Civil Code of People's Republic of China (PRC). If the actor infringes upon the civil rights and interests of others through fault, he shall bear the tort liability. If the actor is presumed to be at fault according to the law and cannot prove that he is not at fault, he shall bear tort liability.
