Measures of Chongqing Municipality on the Administration of Elevator Safety

The first chapter _ always _ _

Article 1 In order to strengthen elevator safety, reduce elevator failures, prevent elevator accidents, and ensure personal and property safety, these Measures are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment and relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 These Measures shall apply to the supervision and management of elevator production (including manufacturing, installation, renovation and maintenance), operation, use, inspection and testing and elevator safety within the administrative area of this Municipality.

The elevators mentioned in these Measures include manned (cargo) elevators, escalators and moving sidewalks. The specific types, categories and varieties are determined according to the Catalogue of Special Equipment of the State Council.

Article 3 The people's governments of cities, districts and counties (autonomous counties) shall be responsible for leading the elevator safety work within their respective administrative areas, urging relevant departments to perform their duties of supervision and management according to law, and coordinate and solve major problems existing in elevator safety supervision and management in a timely manner.

Township people's governments and sub-district offices shall assist the relevant departments of the people's governments at higher levels to strengthen the daily inspection of elevator safety within their respective jurisdictions and establish an elevator safety management system.

Fourth _ city, county (Autonomous County) people's government special equipment safety supervision and management department is responsible for the elevator safety supervision and management within their respective administrative areas.

The construction administrative department shall, jointly with relevant departments, supervise and manage the elevator selection and configuration; The real estate administrative department shall, jointly with the relevant departments, establish a management mechanism for the use of elevator renovation and maintenance funds, and urge the property service enterprises to assume the responsibility for the safety management of elevator use; The fire control institution of the public security organ shall, jointly with the safety supervision and management department of special equipment, carry out the rescue and disposal of elevator accidents.

Education, commerce, health and family planning, transportation, tourism, sports and other relevant departments shall, in accordance with their respective responsibilities, do a good job in elevator safety supervision and management.

Article 5 Elevator manufacturing units, elevator installation, renovation and maintenance units and elevator operation and use units shall abide by laws and regulations, safety technical specifications and relevant standards, establish and improve elevator safety responsibility system, strengthen elevator safety management, and ensure elevator manufacturing, installation, renovation, maintenance, operation and use safety.

Article 6 _ Implement elevator safety liability insurance.

Elevator used in schools, kindergartens, hospitals, airports, stations, passenger terminals, shopping malls, stadiums, tourist attractions, exhibition venues, parks and other public gathering places shall be insured with elevator safety liability insurance in accordance with the Insurance Law of People's Republic of China (PRC) and relevant regulations.

Seventh _ special equipment safety supervision and management departments and relevant departments should strengthen the publicity and education of elevator safety laws and regulations and safety knowledge, and enhance public safety awareness and self-protection ability.

Elevator users, news media and industry associations should popularize and publicize elevator safety knowledge and common sense, and advocate civilized use of elevators.

Elevator manufacturing units, elevator installation, renovation and maintenance units, units engaged in elevator maintenance and special equipment inspection and testing institutions shall strengthen the publicity of elevator safety professional knowledge.

Eighth to encourage elevator safety science and technology research, encourage the use of advanced technology and scientific management means, improve the safety performance and management level of elevators, and enhance the ability of accident prevention and emergency rescue.

Article 9 _ Elevator-related industry associations should strengthen industry self-discipline, promote the construction of industry credit system, carry out industry information analysis and research, organize education, training and consultation, participate in the formulation of relevant standards, and improve industry service level and elevator safety management level.

Chapter II Production and Management

Tenth elevator production in accordance with the provisions of the state to implement the licensing system.

No unit or individual may forge, falsely use, alter, resell, lease or lend the license certificate.

Eleventh _ elevator manufacturing units shall ensure that elevator production meets the requirements of laws and regulations, safety technical specifications and related standards, and be responsible for the safety performance of the elevators they produce.

Twelfth elevator installation, renovation and maintenance must be carried out by the elevator manufacturing unit or its entrusted unit that has obtained the corresponding license according to law. Where an elevator manufacturing unit entrusts other units to install, renovate and maintain elevators, it shall conduct safety guidance and monitoring on their installation, renovation and maintenance, and conduct calibration and debugging according to the requirements of safety technical specifications. Elevator manufacturing units are responsible for the safety performance of elevators.

The entrusted unit shall not subcontract the elevator installation, renovation and maintenance business.

No unit or individual may engage in elevator installation, renovation and maintenance activities in the form of affiliation.

Thirteenth _ after the elevator installation is completed, the elevator installation unit shall hand over the elevator factory data, elevator installation technical data, elevator installation self-inspection report, elevator supervision and inspection qualified report and other technical data to the elevator user unit, and handle the written delivery procedures.

If the elevator installation unit fails to go through the delivery procedures or pass the supervision and inspection, no unit or individual may use the elevator except for debugging and testing in accordance with the safety technical specifications.

Fourteenth _ after the completion of elevator renovation and maintenance, the elevator renovation and maintenance unit shall hand over the relevant technical data and documents to the elevator user.

After the elevator transformation is completed, the elevator transformation unit shall paste the elevator nameplate in a prominent position of the elevator car, indicating the unit name, license number and other information.

Fifteenth elevator business units should check the elevator design documents, product quality certificates, installation and maintenance instructions, type test reports of main components, supervision and inspection certificates and other documents when selling elevators, and establish acceptance and sales records.

It is forbidden to sell the following elevators:

(a) Unauthorized production;

(two) the state has explicitly eliminated and scrapped;

(3) The safety performance is defective;

(four) the use of scrapped and refurbished parts assembled;

(five) does not meet the requirements of safety technical specifications and related standards;

(6) Other elevators prohibited by laws and regulations.

Sixteenth _ the construction unit shall carry out elevator selection and configuration in accordance with relevant regulations and standards; If the selection and configuration do not meet the relevant regulations and standards, the construction drawing design documents shall not be submitted for approval.

The construction unit shall, in accordance with the quality requirements of construction projects, technical standards for fire control of construction projects and technical specifications for elevator safety, build elevator shafts, machine rooms and other buildings and ancillary facilities related to elevator safety.

Construction units and construction units are prohibited from using elevators to carry construction materials, construction waste and other engineering construction operations.
