Chapter I General Provisions

Article 2 These Measures shall apply to the operation and related management activities of rail transit within the administrative area of this Municipality.

Article 3 The term "rail transit" as mentioned in these Measures refers to the rail public passenger transport system such as subway and light rail.

The term "rail transit facilities" as mentioned in these Measures refers to rail transit tracks, tunnels, bridges and stations (including entrances and exits, passages, etc.). ), vehicle bases, parking lots, vehicles, electromechanical system equipment and facilities, and ancillary facilities such as power supply, communication, ventilation, environmental control, fire fighting, fare collection and other related equipment and facilities set up to ensure the operation of rail transit.

Article 4 The operation and management of rail transit shall follow the principles of safe operation, standardized service, high efficiency and convenience.

Article 5 The municipal traffic administrative department is the competent department in charge of rail transit operation, and is responsible for organizing the implementation of these Measures, and the daily supervision and management work shall be implemented by its subordinate rail transit operation and management institutions.

Public security, urban and rural planning, price, urban management and law enforcement, safety production supervision, fire protection and other departments shall, in accordance with their respective responsibilities, coordinate in the operation and management of rail transit.

The people's governments of counties (cities) along the rail transit, administrative committees of high-tech zones and other institutions shall cooperate with the municipal transportation administrative department to implement these measures and assist in the safety management and emergency response of rail transit facilities.

Article 6 The rail transit operating unit that has obtained the right to operate (hereinafter referred to as the operating unit) shall organize the daily operation and management of rail transit in accordance with the urban rail transit operation and management norms, undertake the responsibility of rail transit operation and management, stop acts that endanger the safety of rail transit operation, hinder the operation service or disrupt the operation order, and ensure the operation safety and service quality.

Chapter II Operation Safety Management

Seventh rail transit construction units in the planning and construction of rail transit projects, should seek the opinions of the municipal traffic administrative department and the municipal public security organs, consider the needs of safe operation, and reserve transfer and evacuation space.

After the completion of the rail transit project, the rail transit construction unit shall organize the preliminary inspection of the project; If the initial inspection is qualified, the rail transit construction unit shall conduct comprehensive debugging and safety inspection of rail transit facilities, and organize trial operation in conjunction with the operating unit. The trial operation period shall not be less than 3 months, and passengers shall not be allowed during the trial operation.

Eighth after the trial operation, the rail transit project shall be evaluated in accordance with the relevant provisions of the basic conditions of trial operation. If it passes the examination, it shall be put into trial operation after being approved by the municipal transportation administrative department and submitted to the Municipal People's Government.

Article 9 An operating unit shall bear the main responsibility for the operation safety of rail transit according to law, implement operation safety management, and perform the following operation safety responsibilities:

(a) the establishment of safety production management institutions, equipped with full-time safety production management personnel, establish and improve the safety operation system, ensure the necessary capital investment for safe production conditions, and find hidden dangers in the operation of rail transit, it shall take corresponding measures to control and eliminate hidden dangers in time;

(two) regularly organize the operation safety assessment of the rail transit operation network, and report the assessment results to the municipal transportation administrative department for the record;

(three) according to the relevant national standards to set up safety, fire fighting, rescue, evacuation and other equipment, equipment and other rail transit facilities, to ensure their normal use, regular testing and timely maintenance, update;

(four) set up safety, fire, rescue, evacuation and other guiding signs in accordance with the relevant national standards, and ensure that all kinds of guiding signs are correct, clear, complete and eye-catching;

(six) drivers, dispatchers, traffic attendants and other positions of staff after training, certificates;

(seven) other operational safety duties that should be performed according to law.

Article 10 An operating unit shall configure safety inspection facilities and equipment, formulate operation specifications for rail transit safety inspection, select qualified safety inspection units to conduct safety inspection, cooperate with public security organs to do a good job in public security and counter-terrorism work, and ensure the safety of passengers.

The security inspection unit shall conduct security inspection on the articles carried by passengers in the rail transit station, and accept the guidance and supervision of the public security organs on security inspection.

Eleventh rail transit operation and management institutions shall supervise and inspect the operation safety management of rail transit operating units, and put forward rectification opinions on the problems found in the inspection, and the operating units shall implement them as required.

Twelfth advertising facilities and commercial outlets should be set up within the scope of rail transit stations in accordance with the planning and layout plan. Advertising facilities and commercial outlets shall be set with fireproof materials, and comply with the provisions of fire laws, regulations, rules and technical specifications.

Operating units should strengthen the safety inspection and management of advertising facilities and commercial outlets within the scope of rail transit stations.

Thirteenth prohibit the following acts endangering the safety of rail transit operation:

(a) unauthorized movement, cover, damage to fire safety warning signs, evacuation signs, measuring facilities and safety protection facilities;

(2) Building obstacles, billboards or neon lights that affect traffic signals on the inner side of curves of ground lines and overhead lines of rail transit, and planting trees that hinder traffic observation;

(five) unauthorized operation of buttons and switch devices with warning signs, use of emergency or safety devices in non-emergency situations, improper use of rail transit facilities, endangering the personal and property safety of others or the normal operation of rail transit;

(six) deliberately interfere with the communication frequency of rail transit, damage or interfere with mechanical and electrical equipment, cables and communication signal systems;

(seven) unauthorized entry into the cab, track, tunnel, ventilation pavilion (well) or other areas with warning or prohibition signs;

(eight) placing obstacles on the track, throwing objects at trains, engineering vehicles, tracks, ventilation booths (wells), catenary and other rail transit facilities;

(nine) damage to tracks, tunnels, stations, vehicles, cables, mechanical and electrical equipment, subgrade, slope protection, drainage ditch and other equipment and facilities;

(ten) climbing, crossing or pushing fences, railings, protective nets, gates, vehicles, security doors, screen doors and other equipment and facilities;

(eleven) in the station, train cars, ventilation booths (wells) and other rail transit facilities within the scope of lighting an open flame;

(twelve) toxic, harmful, flammable, explosive, radioactive and corrosive substances are stored within 50 meters of the ventilation pavilion (well), station entrance and viaduct of rail transit;

(13) occupying the passage, stacking materials, parking vehicles, drying articles within 5 meters of the station entrance, ventilation pavilion (well), substation and cooling tower, or setting up facilities, construction operations and other acts that hinder passengers' passage and rescue and evacuation without approval;

(14) Throwing objects at the orbital operation area, or making kites, balloons, flying models, lanterns, etc. Entering or flying over the scope of rail transit facilities;

(fifteen) shooting movies, advertisements and other audio-visual products within the scope of rail transit facilities without the consent of the operating unit;

(sixteen) other acts that endanger the safety of rail transit operation.

Chapter III Operation Service Management

Article 14 The municipal transportation administrative department shall organize the rail transit operation management institution to formulate the rail transit operation service standard and passenger code, supervise and inspect the operation units to perform their operation service duties, make overall arrangements for the connection between ground transportation and rail transit, and ensure the normal operation of rail transit.

Fifteenth operating units shall perform the following service duties:

(1) If the running time of a train is delayed or adjusted for any reason, the public shall be informed in time through stations, train broadcasting systems, news media and the Internet;

(two) to establish a complaint acceptance system, accept passengers' complaints against violations of operational norms and service rules, and organize the handling;

(three) the operating unit staff should wear signs, civilized service;

(four) timely release the lost and found information of passengers on the information platform;

(5) Other service duties that should be performed according to law.

Sixteenth operating units shall make operational service commitments, announced to the public, and prepare the implementation plan of operational service objectives, and report to the municipal transportation administrative department for the record.

The rail transit operation management institution shall organize an annual evaluation of the implementation of the annual operation service target implementation plan of the operating unit, and report the evaluation results to the municipal transportation administrative department for the record. For the problems found in the assessment, the operating unit shall explain the reasons and make timely rectification.

Article 17 Within 500 meters around the rail transit station, the operating unit shall set up, maintain and update the external guiding signs of the rail transit station in accordance with the relevant norms, and shall not affect the established road traffic signs, traffic monitoring facilities and traffic status guiding screens and other related traffic facilities, and the urban management law enforcement, public security traffic management and other departments shall cooperate; Owners and users of surrounding properties are not allowed to set up rail transit guide signs without authorization.

Eighteenth rail transit fares shall be fixed by the government, and the operating units shall strictly implement the price laws and regulations and the fares determined by the municipal price department according to law, and shall not adjust them without authorization.

The operating unit shall regularly evaluate the fare under the guidance of the municipal transportation administrative department; If it is considered necessary to adjust the fare after assessment, the operating unit may put forward suggestions on fare adjustment to the municipal price department, and the municipal price department will put forward opinions on whether to adjust the fare after cost supervision and examination, and report to the municipal government for approval.

Due to special circumstances, the relevant departments of the municipal government require the operating unit to reduce the fare, and shall negotiate with the operating unit to reduce the fare and subsidy scheme.

Article 19 When the safety of rail transit operation is seriously affected by faults, natural disasters or emergencies, and measures cannot be taken to ensure safe operation, the operating unit may suspend operation, organize passengers to evacuate as soon as possible, report to the municipal transportation administrative department in time, and make an announcement to the public. Therefore, the affected passengers can ask the operating unit to refund the ticket price according to the current ticket purchase amount with valid tickets.

In addition to the circumstances specified in the preceding paragraph, if it is necessary to suspend the operation of rail transit due to major technical transformation, line construction and maintenance or technical safety problems, it shall be reported to the municipal transportation administrative department for approval before implementation.

Twentieth operating units shall cooperate with the municipal administrative department of transportation to do a good job in passenger flow guidance during major holidays, large-scale activities and other periods, and take temporary measures such as increasing capacity and limiting passenger flow according to the plan, and adjust the traffic plan in time to ensure operational safety.

Chapter IV Code of Conduct for Passengers

Article 21 Passengers should accept the guidance of the staff of the rail transit operation unit, wait in a safe area, consciously safeguard public health, take good care of rail transit facilities, correctly use elevators, automatic fare collection machines and other related equipment and facilities in rail transit stations, and bear corresponding liability for compensation if damage is caused.

Twenty-second passengers should hold valid tickets and implement the one-person-one-vote system, except those who can ride free of charge according to regulations.

Tickets will not be refunded after use. However, if passengers are prohibited from taking the bus or the operating unit has its own reasons, it may refund the ticket in accordance with the regulations.

Passengers carrying articles weighing more than 20 kg but not more than 30 kg, or articles with the sum of the overall dimensions of a single article greater than 1.4 m and not more than 1.6 m, shall purchase tickets equivalent to the passenger fare.

Passengers with one-way tickets should return their tickets when leaving the station; If it is not returned, the operating unit has the right to take back the ticket and treat it as having no valid ticket.

Twenty-third elderly people, disabled people, disabled police and active servicemen can enjoy preferential treatment or free rides in accordance with relevant regulations.

Preferential travel documents are for personal use only. Passengers holding preferential travel documents should take the initiative to produce preferential travel documents and actively cooperate with the inspection of the staff of the operating unit.

If there is no ticket or invalid ticket, the operating unit shall make up the fare according to the highest one-way fare of the gate station network; Holding forged or altered preferential travel documents or fraudulently using other people's preferential travel documents, the operating unit shall make up the ticket according to the highest one-way fare of the gate station network, and make up the ticket according to 5 times of the fare.

Forged or altered preferential travel documents, which constitute a violation of public security regulations, shall be transferred by the operating unit to the public security organ for legal treatment.

Twenty-fourth it is forbidden to bring the following items into the station:

(a) explosive, flammable and explosive, toxic, corrosive, radioactive substances and infectious disease pathogens;

(2) Guns, ammunition, controlled knives and various offensive weapons except for performing official duties;

(six) other items that affect public safety, operational safety or the personal and property safety of passengers.

The style and catalogue of articles prohibited from entering the station shall be announced by the public security organ and the municipal traffic administrative department, and shall be posted and displayed by the operating unit in the station.

It is forbidden to bring live animals into the station, except for guide dogs and military police dogs carried by blind people.

Twenty-fifth passengers should accept and cooperate with the safety inspection. Refusing to accept the inspection or finding prohibited items in the safety inspection, the safety inspectors shall refuse to enter the station or order them to leave the station; Those who forcibly enter the station, refuse to leave the station or disturb the order of the safety inspection site shall be discouraged and stopped by the safety inspectors. Violation of public security regulations shall be dealt with by public security organs according to law.

Twenty-sixth patients with mental disorders, drunkards or other people who are delirious, people with mobility difficulties and preschool children should be accompanied by healthy adults or guardians to enter the station.

The staff of operating units have the right to discourage disheveled people, patients with infectious diseases that endanger the health of others and other people who are not suitable for rail transit from entering the station.

Twenty-seventh passengers who take rail transit for more than the specified time limit from the time of the entrance gate shall pay the fare according to the highest one-way fare of the station network of the exit gate, except for the overtime ride caused by the operating unit.

If the passenger ticket fare is not enough to pay for the actual arrival ticket, it should take the initiative to make up the fare before leaving the station; Refusing to make up the fare, the operating unit shall collect the fare according to 5 times of the fare payable.

If the one-way ticket is overtime or overtravel, the passenger shall pay the fare in accordance with the provisions of the first paragraph of this article.

Twenty-eighth rail transit facilities prohibit the following acts:

(a) in the station or train, causing trouble after drinking, molesting others or committing other acts that violate public order and good customs;

(2) Running, fighting or walking in the opposite direction on escalators and movable platforms;

(3) Crouching in the car or in the station, spreading false news, lying down, stepping on the seat, using skateboards, skates, roller skates and other items, chasing and fighting, blocking the passage, begging, scavenging, staying overnight in the station, performing arts, singing and dancing, disturbing the order of riding and other acts that hinder and affect the smooth passage of passengers;

(4) Taking the escalator when the sum of the overall dimensions, length, width and height of large luggage or single articles weighing more than 20kg exceeds 65438 0.4m;

(five) not waiting in the prescribed area, not getting on or off the bus according to the regulations, which seriously affects the train order;

(6) Eating and drinking in the pay area of stations and train carriages, except for babies' eating and medicines taken by patients;

(eight) graffiti, unauthorized hanging items or posting, distributing leaflets (advertisements) and other items;

(nine) without authorization to set up stalls or engage in sales activities, to attract customers, soliciting customers and handling luggage and articles for profit;

(ten) other acts in violation of the safety order of rail transit operation, the appearance of rail transit facilities and the provisions on environmental sanitation management.

Chapter V Management of Protected Areas and Facilities

Twenty-ninth rail transit along the establishment of controlled protected areas and special protected areas, the specific scope in accordance with the relevant provisions of the "Fuzhou rail transit construction management measures".

The operating unit shall copy the specific scope of the control protected areas and special protected areas to the relevant competent departments of urban and rural planning, construction, land and resources.

Thirtieth operating units shall conduct inspections and inspections of rail transit protected areas, rail transit facilities and equipment. If it is found that it endangers or may endanger the safety of rail transit operation, it shall take immediate measures. Technical protection and monitoring of facilities and equipment along the rail transit shall be coordinated by relevant units and individuals along the line.

If it is necessary to adjust the scope of protected areas and special protected areas due to geological conditions or other special circumstances, it shall be proposed by the operating unit, audited by the municipal transportation administrative department, and determined after being reported to the Municipal People's Government for approval.

Thirty-first engaged in the following activities within the scope of the operating line of rail transit control protection zone, the owner or the construction unit shall formulate a protection plan for rail transit facilities, and after obtaining the consent of the operating unit, go through the examination and approval procedures according to the relevant procedures:

(a) new construction, renovation, expansion or demolition of buildings (structures);

(2) Drilling, foundation pit (trench) excavation, blasting, pile foundation construction, earth borrowing, filling, jacking, grouting and anchoring operations;

(3) Building new ponds, digging canals, quarrying and dredging, drilling wells for water and exploiting groundwater;

(six) other acts that may affect the rail transit facilities.

Thirty-second in the rail transit special protection zone, in addition to municipal, garden, sanitation and civil air defense projects, no other construction activities.

Thirty-third to control the construction behavior of the operating unit in the protected area, which may affect the safety of rail transit operation, the operating unit shall conduct on-site inspection, and the operating unit shall cooperate; In violation of the provisions of the provisions of article thirty-first, the operation unit is required to immediately stop the operation, and report to the construction administrative department, which shall handle it according to law.

In the process of operation in the rail transit control protection zone, the operating unit shall immediately stop operation, take corresponding safety protection measures, and report to the operating unit and the construction administrative department.

Chapter VI Emergency Response and Accident Disposal

Thirty-fourth municipal transportation administrative departments shall, jointly with relevant departments and relevant units, formulate emergency plans for rail transit emergencies, implement them after being approved by the Municipal People's Government, and organize regular drills.

Article 35 An operating unit shall, according to the emergency plan for rail transit emergencies, formulate special emergency plans for fire fighting, flood control, earthquake, power failure, health and epidemic prevention, anti-terrorism, explosion prevention and large passenger flow, establish emergency rescue teams, carry out emergency rescue training, and organize emergency drills regularly.

Article 36 When a safety accident occurs in the operation of rail transit, the operating unit shall immediately organize rescue in accordance with the principle of first rescuing the injured and then handling the accident, so as to reduce casualties and property losses, resume normal operation as soon as possible, properly protect the site, and report to the relevant competent department according to the emergency plan.

Where a safety accident affects the operation of rail transit, the operating unit shall inform the passengers of relevant information in time through stations and train broadcasting systems, notices or news media, the Internet, etc., and do a good job in the evacuation and transfer of passengers.

Article 37 When natural disasters, accidents, social security incidents and other emergencies occur during the operation of rail transit, the municipal transportation administrative department, the rail transit operation management institution and the operation unit shall promptly start the emergency plan and carry out rescue work according to the levels, responsibilities, measures and procedures specified in the emergency plan; Involving terrorist attacks and public safety emergencies, the public security organ shall launch corresponding anti-terrorism and public safety emergency plans and deal with them according to law.

The relevant departments of the Municipal People's Government, the county (city) people's government, high-tech zones and other institutions, as well as electric power, telecommunications, water supply, ground transportation operations and other units, shall implement emergency rescue and emergency support in accordance with the provisions of the emergency plan.

Relevant units and passengers shall obey the unified command of the on-site staff.

The release of rail transit emergency information needs the support of radio and television, mobile communication and other units, and relevant units should give priority support.

Chapter VII Legal Liability

Thirty-eighth operating units in any of the following circumstances, the municipal administrative department of transportation shall be ordered to make corrections within a time limit and impose a fine of 30 thousand yuan; If no correction is made within the time limit, causing serious damage to the public interest, the right to operate shall be recovered according to law:

(a) in violation of the provisions of article ninth of these measures, failing to perform operational safety duties as required;

(two) in violation of the provisions of the twelfth paragraph of these measures, advertising facilities and commercial outlets are not set up in accordance with the planning and layout plan;

(three) in violation of the provisions of the second paragraph of article nineteenth of these measures, without the approval of the municipal administrative department of transportation, suspend operations without authorization;

(four) in violation of the provisions of article twentieth of these measures, no measures have been taken to organize the evacuation of passenger flow, which has affected the operational safety;

(five) in violation of the provisions of the thirtieth paragraph of these measures, failing to carry out inspections and inspections as required and failing to take timely measures;

(six) in violation of the provisions of the first paragraph of article thirty-sixth, improper handling of safety accidents, resulting in damage to public interests.

Thirty-ninth operating units in any of the following circumstances, the municipal traffic administrative department shall order them to make corrections within a time limit, and if they fail to make corrections within the time limit, they shall be fined between 30,000 yuan and 60,000 yuan:

(a) in violation of the provisions of article fifteenth of these measures, failing to perform their service duties;

(two) in violation of the provisions of the sixteenth paragraph of these measures, the operation service commitment has not been announced to the public or the implementation plan of the operation service target has not been submitted for the record as required;

(three) in violation of the provisions of the first paragraph of Article nineteenth of these measures, the suspension of operations has not been reported and announced to the public;

(4) Violating the provisions of Article 35.

Fortieth, in violation of the provisions of Article 17 of these measures, the owners and users of surrounding properties set up rail transit guidance signs without authorization, and the urban management law enforcement department shall order them to make corrections within a time limit and impose a fine of more than 5000 yuan 1000 yuan.

Forty-first operating units in violation of the provisions of the eighteenth paragraph of these measures, without authorization to adjust the fare, the municipal price department shall order it to make corrections within a time limit, and shall be punished according to law; If no correction is made within the time limit, the municipal transportation administrative department shall recover the right to operate according to law.

Forty-second in violation of the provisions of article thirty-first, did not implement the special construction scheme or safety protection scheme, or in violation of the provisions of article thirty-third, refused to accept the safety monitoring of operating units, by the construction administrative department shall be ordered to stop work for rectification; If losses are caused, it shall be liable for compensation according to law.

Forty-third in violation of the relevant provisions of Article thirteenth, Article twenty-fourth and Article twenty-eighth, the operating unit shall order it to make corrections, and if it refuses to make corrections, it shall be reported to the relevant competent department for investigation in accordance with the following provisions:

(a) the destruction of rail transit environmental sanitation, report to the urban management law enforcement departments, urban management law enforcement departments shall be punished in accordance with the relevant provisions of the city appearance and environmental sanitation management;

(2) Those who endanger the safety of rail transit operation and disrupt the operation order shall report to the administrative department of transportation, which shall order them to make corrections and impose a fine of 1000 yuan to 5,000 yuan on individuals and units;

(three) constitute a violation of public security regulations, report to the public security organs, and be investigated and dealt with by the public security organs according to law.

Forty-fourth refusal or obstruction of the relevant competent departments, operating units or safety inspectors to perform their duties according to law, which constitutes a violation of public security management regulations, shall be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 45 If the relevant competent departments, operating units and their staff members fail to perform their duties as stipulated in these Measures, or commit other acts of dereliction of duty, abuse of power or corruption, the supervisory organ or the unit to which they belong shall order them to make corrections, and the administrative responsibilities of the relevant personnel shall be investigated according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VIII Supplementary Provisions

Article 46 These Measures shall come into force as of June 6, 2008.
