Trial Measures for the Administration of China (Chongqing) Pilot Free Trade Zone

Chapter I General Provisions Article 1 In order to promote and guarantee the construction of China (Chongqing) Pilot Free Trade Zone, these Measures are formulated in accordance with the "Overall Plan of China (Chongqing) Pilot Free Trade Zone" approved by the State Council and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the China (Chongqing) Pilot Free Trade Zone (hereinafter referred to as Chongqing Pilot Free Trade Zone) approved by the State Council.

The implementation scope of Chongqing Pilot Free Trade Zone covers Liangjiang Area, Xiyong Area and Orchard Port Area, and the specific scope includes Yuzhong District, Jiangbei District, Shapingba District, Jiulongpo District, Nan 'an District, Beibei District, Yubei District, Liangjiang New Area and some areas of Xiyong Comprehensive Bonded Zone. Article 3 Chongqing Pilot Free Trade Zone will focus on institutional innovation, and build a comprehensive experimental zone integrating investment, trade and financial settlement facilitation, a new open economic system risk and stress testing zone, a system integration reform pioneer zone and an open platform collaborative development zone, and build an inland international logistics hub with multimodal transport as the core. Inland international trade center focusing on goods trade, modern financial center focusing on financial settlement facilitation, modern service industry operation center aiming at interconnection, and national important modern manufacturing base supported by scientific and technological innovation. Article 4 The Liangjiang area will focus on the construction of high-end industries and high-end factor gathering areas, the Xiyong area will focus on the construction of a demonstration zone for the transformation and upgrading of processing trade, and the Orchard Port area will focus on the construction of a multimodal transport logistics transshipment center.

The special customs supervision area of Chongqing Pilot Free Trade Zone focuses on exploring institutional innovation with trade facilitation as the main content, and carrying out bonded processing, bonded logistics and bonded services; Non-customs special supervision areas focus on exploring the opening of investment fields, the reform of investment management system, the improvement of post-event supervision, the promotion of financial system innovation, and the active development of high-end manufacturing and modern service industries. Article 5 Chongqing Pilot Free Trade Zone shall follow the principles of open investment, convenient trade, financial innovation, transparent policies, perfect services and efficient supervision, and build a business environment ruled by law, internationalized and facilitated.

Chongqing Pilot Free Trade Zone boldly explores, tries first, encourages innovation, tolerates failure, protects the initiative and enthusiasm of institutional innovation, and creates an environment of independent reform and positive progress. Article 6 Chongqing Pilot Free Trade Zone will deepen the pilot reform and opening-up in various fields, intensify stress testing, strengthen supervision and control risks.

Chongqing Pilot Free Trade Zone timely summarizes and evaluates the implementation effect of the reform pilot task, and copies and promotes the results with good pilot effect and controllable risks in accordance with the prescribed procedures. Chapter II Management System Article 7 The work leading group of Chongqing Pilot Free Trade Zone is responsible for organizing and leading the overall construction of Chongqing Pilot Free Trade Zone and coordinating major issues of Chongqing Pilot Free Trade Zone. Article 8 Chongqing Pilot Free Trade Zone Office (hereinafter referred to as Chongqing Pilot Free Trade Zone Office) takes the lead in promoting the construction of Chongqing Pilot Free Trade Zone and performs the following duties:

(1) Organizing the implementation of the master plan of China (Chongqing) Pilot Free Trade Zone, and coordinating and promoting various reform pilot tasks and reform and innovation measures such as investment, trade, finance and regulatory reform afterwards;

(2) To study and put forward policy suggestions for deepening various reforms and innovations in Chongqing Pilot Free Trade Zone;

(three) responsible for liaison, supervision and assessment of regional management institutions;

(4) Coordinating the relevant work of finance, customs, inspection and quarantine, maritime affairs and border inspection departments in Chongqing Pilot Free Trade Zone, and establishing a linkage and cooperation mechanism;

(5) Cooperate with relevant state functional departments to carry out national security review, anti-monopoly review and other related work in Chongqing Pilot Free Trade Zone;

(6) Release relevant public information of Chongqing Pilot Free Trade Zone and comprehensively evaluate the operation of Chongqing Pilot Free Trade Zone;

(seven) to carry out publicity, contact and exchange;

(eight) to undertake the daily work of the leading group of Chongqing Pilot Free Trade Zone;

(nine) other duties entrusted by the municipal government. Article 9 Within the scope of implementation of the Chongqing Pilot Free Trade Zone, local governments and management agencies of development zones and functional zones shall specify specialized agencies (hereinafter referred to as regional management agencies) to coordinate and promote the construction of the Chongqing Pilot Free Trade Zone within their own regions under the guidance of Chongqing Free Trade Office. Article 10 The relevant functional departments of the municipal government responsible for investment, trade, finance, post-event supervision and reform shall, in accordance with the requirements of the overall plan of China (Chongqing) Pilot Free Trade Zone, do a good job in the pilot work of system innovation and reform in related fields within the scope of statutory duties. Article 11 The central customs, inspection and quarantine, maritime affairs, border inspection, foreign exchange, finance and taxation units in Chongqing shall perform their duties according to law, implement relevant policies and measures of Chongqing Pilot Free Trade Zone, and support the reform and innovation of Chongqing Pilot Free Trade Zone. Chapter III Investment Opening-up Article 12 The Chongqing Pilot Free Trade Zone implements the system of national treatment plus negative list management for foreign investment before entry. In areas outside the negative list, foreign-invested projects shall be filed in accordance with the principle of consistency between domestic and foreign investment, except for domestic investment projects that are reserved for examination and approval according to the State Council regulations. Article 13 The Chongqing Pilot Free Trade Zone shall implement the commercial registration system of "one license, multiple photos and one yard", simplify the registration procedures of enterprise establishment, implement the system of independent declaration of enterprise name, electronic registration and simple cancellation of market entities, and try out the registration commitment system of enterprise residence (business premises) to create a relaxed and convenient market access and exit environment.
